Exrx. of the Last Will and Testament of THOMAS DURHAM deced., do make a true and perfect Inventory of all the goods chattles and creditts of the said deced., and the same so made do exhibit into the County Court of Richmond att such time as she shall be thereto required by the said Court and the same goods chattles and creditts do well and truly administer according to Law, And further doe make a true and just account of her actings and doings therein when thereto required by the said Court and also do well and truely pay and deliver all the Legacies contained and specified in the sd. THIS INDENTURE made in the yeare of our Lord God 1686 and in the second year of the Reigne of our Sovereigne Lord James the second &c. and with JOHN INGOE and MARY his Wife of the one part and THO: DERHAM of the other part all livers in the County of Rappa., Planters, Witnesseth that the sd JOHN INGOE and MARY his Wife for One thousand Five hundred pounds of good sound Merchantable Tobb: and caske to him the sd JOHN INGOE truly paid do fully and absolutely sell unto the sd JOHN DERHAM his heirs all that parcell of land be it more or less by Greement of parties being on the North side of Rappa: River and on a branch of MORATICO CREEK being part of a greater tract of land which the abovesd. JOHN INGOE purchased of Mr. WILLIAM FAUNTLEROY the sd parcel! of land be it more or less beginning as followeth beginning at a corner red Oake standing by a branch called the CATTAILE BRANCH from thence along the line that parts JOHN INGOE and WM, SMOOT to a Stake that stands on MORATICO CREEK nere an old field formerly called by the name of MADISINS OLD FIELD and from thence along the line of the sd INGOE to a corner white Oake standing upon the abovesd Branch and from thence runing up the sd to the corner red Oake where it first began including the hereby granted parcell of land be it more or less and also all the profits belonging with all woods waters housing fencing appertaining To have and to hold with all their rights and privileges to be hereby granted to sd THO: DERHAM his heires forever subject nevertheless to the quit rents which shall be come due and payable for the premisses unto his Majties his heirs and he the sd JOHN INGOE the hereby granted premisses will defend unto THO: DERHAM according to the true meaning hereof In Witness whereof JOHN INGOE and MARY his Wife have hereunto seu their hands and seales this 4th day of July 1686

Know gee that I the said WILLIAM SMOOT for a consideration received and for the great love that I have & beare unto DOROTHY DURHAM, Wife of THO: DURHAM of the County aforesaid & her Children, do give & make over unto the said DOROTHY DURHAM & her Children a certaine parcel of Land lying in Richmond county conteyning Sixty two acres be it more or less bounded as followeth vizt., beginning neere the head of a Branch at an Cake standing neere the Spring of THOMAS DURHAM neere the Branch that issueth out of MORATTICO CREEK running alonge the line of the said WM. SMOOT SENR. S: E: to a line of Mr. ROWLAND LAWSONs, thence alonge the said line S: S: W: to the line of Mr. GRIMES, thence alonge the said GRIMES line N: W: to the line of CLARE, thence alonge the said CLAREs line N: N: E: from thence up the said branch where it first began; To have & to hold the said Land from me the said WILLIAM SMOOT & my heirs to the said DOROTHY DURHAM & her Children & their heirs, And if in case the said DOROTHY DURHAM die that then the said Land shall come to THO: DURHAM, Eldest Son of the said DOROTHY, & his heirs, if in case that he die without issue that then the said Land shall come to MARY DURHAM, Eldest Daughter of the said DOROTHY DURHAM & her heirs; And if in case she shall happen to die without issue that then the said Land shall come to the Fourth, fifth, sixth &c. Children of the said DOROTHY & their heirs but in case of want of issue that then the said Land shall descend & come to ANN FOX, Wife of WM: FOX of the County of LANCASTER & her heirs forever. INGO and JAMES INGO both of County of Richmond of one part and THOMAS DERRAM of the other party; as Wittnesseth that JOHN INGO & JAMES INGO doth bargaine sell unto THOMAS DERRAM his heires one parcell of land containeing Fifty acres of land be it more or less situating in the County of Richmond and Parish of FARNHAM being some part of the land that was by JNO: INGO and JAMES INGO taken up by and by them Patented att the Proprietors Office in the yeare of our Lord one thousand seven hundred and four lying att the South East side of the CATTAILE BRANCH att a Stake, thence Extending along the line of the Maine Patent to a Stake standing neare the Maine Road by MADISONs old Field, thence North North West to the abovesd CATTAILE BRANCH, thence extending downe the said Branch to place where it first began the same is for a valuable consideration by us reced; it being the sume of Two hundred and fifty pounds of good tobbo: Given under our hands and seales this 12th day of June 1705

Betweene MARY GILBERT [nee Mary Smoot] of the Parish of NORTH FARNHAM in the County of Richmond, Widdow, of one party, & THOMAS DURHAM of NORTH FARNHAM in the County of Richmond, Planter, and DOROTHY his Wife of the other party; Wittnesseth that MARY GILBERT for good and valuable consideration in hand payd by these presents do give bargaine sell and confirme unto THOMAS DURHAM and DOROTHY his Wife theire heires a certaine plantation tract of land scituate in the Parish of NORTH FARNHAM in County of Richmond upon a Branch of FARNHAM CREEKE called the BRIERY SWAMP, containeing by estimation Fifty acres now in the tenure and occupation of WALTER WRIGHT and bounded beginning att a corner red Oake upon the abovesaid Swamp and running from thence to another corner red Oake binding upon the land of WILLIAM SMOOTE and from thence to a corner Stake binding upon the land of said SMOOT, from thence to a small Gumm on the Edge of the BRYERY SWAMP and from thence downe the said Swamp along to the place where it first began; To have and to hold the said Fifty acres of land with all houses orchards profitts and appurtenances unto the said land belonging unto THOMAS DURHAM and DOROTHY his Wife and theire heires; subject nevertheless to the Rents and services which shall grow due for the said land unto the Lord of the Fee; In Wittness whereof MARY GILBERT have hereunto put her hand and seal the day month and year above written
