Will of Daniel Stewart
Charles County, MD
In the name of God Amen, I Daniel Stewart of Charles County in the province of Maryland being in a low and weake condition but of sound mind and memory Thanks be to God therefore but Considering the uncertainty of this life and being Desirous to Settle the Estate where with it hath pleased God to blesse me do it in the following
Imprimis I give and bequeath unto my son James Stewart part of my Tract of Land Called Daniels Conclusion beginning at a bounded White Oak the Original beginning of Daniels Delight and Running thence south West and by South forty eight perches thence south East and by East forty perches Thence South six degrees east fifty perches thence the whole breadth of the Land and thence to the first bound Tree which said Parcel of land I give to the said James Steward his heirs & assigns forever I also give to the said James Steward one feather bed and furniture forever.
Item I give and bequeath unto my son Roby Steward all the Remaining part of my Tract of Land Called Daniel's Conclusion to him and his heirs and assigns forever.
Item I give and bequeath unto my Son Daniel Steward a negro Girl named Rachael to him and his heirs and assigns forever.
Item I give and bequeath unto my Grand Daughter Edith Steward Daughter of William Steward one Cow and Calf at her Choice one pot and pan & to her heirs and assigns forever.
Item I give and bequeath to my Children hereafter mentioned (to wit) Thomas Steward, James Steward, William Steward, Roby Steward Ann Young, Sarah Hamilton, Charity McGraw and Rebeccah McDaniel all the Remaining part of my Estate to be equally divided among them which I give to them and their heirs and assigns forever.
Whereas Mary my wife did while she was a widow and when a Treaty of Marriage was had between us, To wit, on the 16th day of January 1748/49, enter into a bond Relative thereunto payable to Roby Steward in the Sum of fifty pound Sterling to which I refer my Executor[s] and which I desire may be by them fully Complyed with According to the True intent & meaning thereof.
Lastly I do hereby nominate Ordain Constitute and appoint my last Will and Testament hereby Ratifying this and this only to be such In Witness whereof I have hereunto set my hand and affixed my Seal this 3rd Day of March One Thousand Seven hundred and sixty Six- Signed Sealed published and Declared by Daniel Steward This 3rd march 1766 to be his last will and Testament in the presence of As Witnesses Requested by the said Steward his his

sst 11th June 1766 Came Thomas Roby Senior Roby Warnall and Alexander Roby the three subscribing Witnesses to the foregoing Will who being duly and solemnly sworn on the holy Evangelists of Almighty God do depose and say that they saw Daniel Steward the Testator sign and Seale the said Will and heard him publish and Declare it to be his last Will and Testament and that at the time of his so doing was to the best of their apprehensions of sound and Disposing mind and memory and that they severally Subscribed as Witnesses to the said Will in the presence of the Testator and at his Request which probate was Taken. The widow Renounces Will and insists upon what the Law will Allow her

On the date of probate, 11 June 1766, the three witnesses above appeared before Dan. Jenifer, Deputy Commissary, and testified to the authenticity of the will; however, Mary Stewart, the wife of Daniel Steward who also appeared at probate, renounced the will and insisted upon what the law would allow her.

Mar 10, 1723 from Alexander Hamilton of:,CC, planter, to Daniel Stuart of CC, planter, for the rents, & services hereafter expressed and for divers other good causes, the 11 year lease of all that part of the tract of Iand whereon the sd Alexander now dwells, which lies between Portobacco Branch & Wm Boswells Branch. The yearly rent (after the 1st 3 years) is 500 lbs of tobacco in cask on Nov 4. Daniel agrees to plant 100 apple trees within the next 2 years (provided Alexander shall find & deliver the-same to sd Daniel for that end) a Rd to keep the apple trees well fenced. At the request of Jacob Latimer the following Deed was recorded on 12 June 1764 and made on 3 April 1764 between John Robey Sr and Mary his wife of Charles County in the Providence of Maryland and Jacob Latimer of the same county. John Robey Sr and Mary received 950 pounds of tobacco for a tract of land called Roby’s Help (twenty six acres) from Jacob Latimer. Land adjacent to Daniel Stewart’s land called The Three Brothers. Witnessed by Dan Jenifer of St Thomas and Joasis Hawkins. Mary Robey relinquished her right of dower.

Pursuant to the order of last Mar Court, Commission issued to examine witnesses touching the bounds of a tract of land lying in CC called Delradie, in possession of William McPherson. The Commissioners appointed (not being related to the Petitioner, contiguous proprietor, nor interested in sd land) are Thomas Stone, Saml Hanson Jr, William Theobalds, and John Pain. And now here, Thomas Stone, Saml Hanson Jr, and William Theobalds, certify that they executed the within Commission and took several depositions. Apr 20, 1736. The deposition of Daniel Stuart of CC, aged about 58, who declares that about 8-9 years ago, he was present at a survey made (by Colo Robt: Hanson, then Surveyor of CC) on a tract of land called Delradie, for Wm: McPherson, at which time, this deponent, at the request of the sd McPherson, bounded a red oak standing on the south side of a Stony Hill, which he understood to stand in the NW line of a tract of land called Bryerwood, belonging to Thos: Mudd, which tree was bounded for the beginning tree of sd land called Delradie. I, Mary Wilson of CC, bind myself to Roby Stewart of CC in the just sum of 50 £sterling money of GB this Jan 16, 1748/9, to warrant that Mary adheres to the following marriage agreement between her Daniel Stewart: if Mary Wilson survives Daniel Stewart, Mary is to abide by Daniel's will and testament, otherwise to be content with the third of one plantation and to release her dowry of any other plantation, and to have the third part of all his personal estate excepting what Negroes Daniel dies possessed of, which Negroes Mary obliges herself to release.
