      At the request of Robert Yates of Charles County, the following deed was recorded on April 17, 1744.
      March 1, 1743 from Charles Bruce of Charles County, Gent:, to Robert Yates and Sarah, his wife, of Charles County, for 15,000 lbs tobacco, and for the execution of a deed of even date with these resents, by which deed he, the said Robert and Sarah relinquished their right of dower to 2 tracts of land, and for divers and other good causes, Charles Bruce hereby sells to Robert Yates and Sarah, his wife, or the survivor of them, the 3 following tracts of land, during their natural lives; that is to say, one tract of land in Charles County near Wicomico River side, being one moiety of the land which originally was the land of William Marshall of Charles County, and assigned by said Marshall to Walter Bayne, which assignment was dated Sep 29, 1664, and afterwards conveyed by Walter Bayne and Martha, his wife, to Mary Contee by deed dated Oct 3, 1709, and also divided between Colo: John Fendall, and John Bruce, natural guardian to the said Charles Bruce. The land is bounded by a read oak standing in the woods by the land of Charles Yates, containing and laid out for about 225 acres. But as the tract of land (to wit the whole 450 acres) was divided during the minority of the said Charles Bruce, which division is not good and available in law, but of necessity the tract must or may be divided again, between the heir or devisee of sd Colo John Fendall, and Robert Yates or Sarah, his wife, or the survivor of them, the one moiety of the wole tract so divided, which, by choice or otherways, may happen to fall to their lots by any division so made, between the heir or devisee of sd John Fendall and Robert Yate or Sarah, his wife, or the survivor of them, according to the metes and bounds at such time hereafter made and fixed, for and during their natural lives, another tract of land called Himslays Marsh, lying on the west side of Wicomico River in Charles County, adjoining the land of Colo John Fendall and Charles Yates, bounded by the edge of Wicomico Marsh, containing and laid out for about 70 acres, as appears by patent granted to Madm Mary Hamsly on May 2, 1723, and also aother tract of land called Hemesley Meadows, lying on the west side of Wicomico River in Charles County, adjoining the land of Colo John Fendall and Thomas Marshall in Charles County, bounded by Wicomico Marsh, Clarks Run, containing and laid out for about 130 acres (as appears by patent, granted to Madm Mary Hemsley on May 2, 1723).

      At the request of Charles Bruce of Charles County, the following deed was recorded on May 3, 1744.
      Know that Robert Yates of Charles County, and Sarah, his wife, relict and executrix of John Bruce, late of Charles County, Gent., deceased, for and in consideration that Charles Bruce of Charles County, son and heir at law of sd John Bruce, has by deed dated with these presents, made over to sd Robert Yates and Sarah, his wife, the 3 following tracts of land (that is to say), one trace being near Wicomico River in Charles County, being one moiety of the tract of land that was conveyed by Walter Bayne and Martha, his wife, to Mary Contee, by deed dated Oct 3, 1709, and as it was afterwards divided between Colo. Jno Fendall and John Bruce, natural guardian to the above mentioned Charles Bruce, being laid out for about 225 acres. The 2nd tract is called Hemsleys Marsh, lying on Wicomico River in Charles County, is laid out for 70 acres. The 3rd tract, called Hemsleys Meadows, lying on the River afd and in Charles County, is laid out for 130 acres. In consideration of the above deed, we will, next Dec 25, forever relinquish our right of dower to 2 tracts of land in Charles County, one called Hatton's Point, and the other, Chesnut Point, late the proper estate of said John Bruce.

      At the request of John Marshall & Josias Marshall the following Award was recorded January 20, 1806
      State of Maryland, Charles County, Sct; know all men by these presents that we the subscribers having been appointed arbitrators any dispute which has arisen between John Marshall and Josias Marshall respecting the place or spot intended to be "trickling Valley or run of water" contained in the last will and testament of their deceased father Thomas Marshall bearing date January 15, 1801. Having heard all the allegations of the parties and examine the ground and maturely considered all the circumstances of the case with reference to the said will, do award and determine that the place or spot where we have this day planted a Locust post and stone is the place which in the judgment of the majority of us was intended by the aforesaid will "trickling water or run of water" and from whence a Southwest line was to be drawn to the 3rd line of "Charley". We hereby certify that we have planted in the presence of the parties interested and also in the presence of sundry other persons, Viz; Josiais B. Ford, James Tubman and John Adams.       At the request of Thomas Marshall the following deed was recorded this 30th day of May Anno Domini 1807. This indenture tripartite made this twenty first day of March in the year of our Lord one thousand eight hundred and seven between William Latimer and Rebecca Latimer his wife of Charles County in the State of Maryland of the one part Burford Cottrell of the same county and state of the second part and Thomas Marshall of Marshall Hall, of the county and state aforesaid on the third part whereas a certain William Marshall late of William and Mary Parish in Charles County aforesaid in the year of our Lord one thousand seven hundred and ninety three died seized and possessed in fee simple of all those tracts parts of tracts or parcels of land lying situate and being in Charles County aforesaid herein after mentioned contained comprehended and included within the meets and bounds courses and distances herein after expressed being part of three tracts of land called Poquashet, Walker and the Brothers, and whereas the said William Marshall died interstate and without will leaving three daughters to wit Rebeckah above mentioned party to this instrument of writing- Elizabeth now the wife of a certain Robert Augustus Beall of Prince Georges County in the state of Maryland- Mary now the wife of Benjamin Bradley Beall of Prince Georges County aforesaid who inherited as co heiresses coparceners or tenants in common all the before mentioned tracts parts of tracts or parcels of land from their aforesaid father William Marshall and whereas heretofore to wit on the seventeenth day of February in the year of our Lord one thousand seven hundred and ninety five a certain indenture or instrument of writing was made and executed by and between the above mentioned William Latimer and Rebeckah Latimer at the time Rebeckah Marshall and the aforesaid Burford Cottrell and a certain William Kirk Patrick since deceased and whom the said Burford Cottrell hath survived that in case a marriage was solemnized between the said William Latimer and Rebeckah Marshall that the said Rebeckah should during the coverture have hold use occupy and enjoy solely and exclusively for her own use and benefit all the lands and other property she might be intitled to by decent device bequest or in any other manner and farther that the said Burford Cottrell and William Kirk Patrick or the survivor of them should have and hold all and singular the lands and property of her the said Rebeckah in trust never the less for the uses and purposes therein mentioned and to for the use benefit and behoof of such persons as the said Rebeckah during her coverture by deed or instrument of writing might direct and appoint as by the said indenture or instrument of writing duly executed bearing date as aforesaid and recorded among the land records of Charles County aforesaid reference being thereto had more fully and at large appear and whereas shortly afterwards a marriage was legally had and solemnized by and between the said William Latimer and the said Rebeckah Marshall and whereas after the marriage of the said William Latimer with the said Rebeckah Marshall and also after the intermarriage of Elizabeth Marshall above named with the above mentioned Robert Augustus Beall and also the intermarriage of the before mentioned Mary Marshall with the above named Benjamin Bradley Beall upon the petition of the said Robert Augustus Beall and Elizabeth his wife, and the said and the said Benjamin Bradley Beall and Mary his wife a commission was awarded by the court of Charles County aforesaid directed to the commissioners therein named commanding them the said commissioners to divide the lands of the before mentioned William Marshall between his heirs and representatives if the same would admit of division without injury to the parties concerned and if the said commissioners should be of opinion that the said lands could not be divided without injury to the parties interest in the same that then and in such case they should certify the same to the court of Charles County aforesaid and further that the said commissioners should value the said lands and make return of such valuations to the court and whereas the said commissioners did make return to Charles County Court that the said land would not admit of division without injury to the parties concerned and did also certify the value of the said lands which said return of the said commissioners was confirmed by Charles County Court aforesaid and whereas the said William Latimer did in behalf of his said wife Rebeckah aforesaid who was the eldest daughter of William Marshall aforesaid elect to take the lands for and on behalf of the said Rebeckah at the valuation made by the commissioners aforesaid and did with his wife the said Rebeckah and a certain Phillip Marshall and Robert Yates as securities execute bonds to the aforesaid Robert Augustus Beall and Elizabeth his wife and the said Benjamin Bradley Beall and Mary his wife agreeable to the order of the court aforesaid to secure the payment of the money which became due payable to the said Robert Augustus Beall and Elizabeth his wife and to the said Benjamin Bradley Beall and Mary his wife for their several and respective parts or shares of the land aforesaid which said bonds were seen and approved of by Charles County Court aforesaid all which by reference to the records of Charles County Court will fully and at large appear and whereas the said Rebeckah Latimer by virtue of the proceedings aforesaid become intitled to the whole of the aforesaid lands, now therefore this indenture witnesseth that the said William Latimer and Rebeckah his wife for and in consideration of the sum of one thousand and sixty three pounds ten shillings current money of Maryland to them in hand paid or secured to be paid at and before the unsealing and delivery of these presents by the aforesaid Thomas Marshall (of Marshall Hall) the receipt whereof is hereby acknowledged and the said Burford Cottrell for and in consideration of the promises and for and in consideration of the sum of five shillings current money to him in hand paid by the said Thomas Marshall (of Marshall Hall) the receipt and payment whereof is hereby acknowledged and with the consent privity and approbation of the aforesaid William Latimer and Rebeckah his wife testified by their signatures to these presents have given granted bargained sold aligned and confirmed unto him the said Thomas Marshall (of Marshall Hall) his heirs and assigns forever all those tracts or parts of tracts or parcels of land being part of three tracts called Poquasket, Walker, and the Brothers situate lying and being in Charles County aforesaid and beginning at the post… omitted land dimensions … Mentions John Campbell,s part of Walker and William and Be it remembered that on the twenty first day of March in the year of our Lord one thousand eight hundred and seven Personally appear William Latimer Rebeckah Latimer his wife and Burford Cottrell of Charles County the parties grantors within named before us the subscribers two of the Justices of the peace of Charles County aforesaid and severally acknowledge the writing and above deed or instrument of writing to be their act and deed and the lands and premises therein mentioned and thereby bargained and sold to be the right and estate of the within named Thomas Marshall (of Marshall Hall) party grantee also therein named his heirs and assigns forever according to the purport true intent and meaning of the said deed or instrument of writing and the acts of assembly in such cases made and provided, and we further certify that the said Rebeckah Latimer being by us privately examined apart from and out of the hearing of her husband whether she doth make her acknowledgement of the same deed willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband or fear of his displeasure.       Memorandum that on the special petition of Thomas Hanson Marshall preferred to the justices of Prince George's County, Maryland on the 4th Tuesday in November in the 2nd year of our Dominion and so forth for a land commission which was issued on December 8, 1773, in these words, to wit, Prince George's County Court, Maryland the right Hon. Henry Hartford, Esq. absolute Lord and proprietary of the province of Maryland; to Messrs Nathaniel Newton, Richard Clagett, Hezekiah Wheeler and Thomas Clagett of PGCo Gentleman, whereas Thomas Hanson Marshall is seized of a tract called "Charley" and preferred his petition in writing to our county court held at Upper Marlborough Town for a commission to examine evidence to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract.       whereas a commission empowering us to examine evidences to prove the bounds of to prove the bounds of "Charley" we intend to meet on March 15th next. We met at the said tract of land and being on the south side of the road that leads out of Pomonkey Neck to Piscattaway between a plantation of Mrs. Elizabeth Bealls and Susanna Dyar's and near to John Emerson, Jr.'s fence we took the following depositions
      Nathaniel Halley aged 44 years or thereabouts declares about 20 years ago Malcolm McBean showed me a tree and said it was the last or corner tree of Mr. John Beall's land and sometimes after he saw some person surveying and went to them and it was Mr. Hodgkinson's, George Parker and Edward Cole and as they were running out a line Mr. Parker wrote over for Mr. Beall and after some time Mr. Parker and Mr. Beall came together to the place where they and stop then Mr. Beall took Mr. Thomas Marshall aside after some time Mr. Parker was called to them in a little time after they all came to this said tree and went on surveying down to the nex. Sometimes afterwards he was in company with Mr. George Parker riding to Port Tobacco and he asked Mr. Parker what passed between him about the tree and he told me Mr. Beall's reason for not showing him the tree when he first came until he asked Mr. Marshall whether it be of prejudice to him or not and that Mr. Marshall said it would not then Mr. John Beall showed Mr. Parker the said tree and told him it was his last corner tree and further saith not
      Thomas Marshall aged about 59 years declares about 45 years ago he was with Thomas Marshall running from the river the 1st line of "Charley" they stopped and the number of perches were out and Thomas Marshall asked what they should do and William Marshall the deponent's father made answer and said not to go from that place where there was the tree where they begun the 2nd course at which was either red or black oak or near the place that Nathaniel Halley declared it to be above
      William Webster aged about 79 years declares about 30 years ago about 15 yards north east from the above place Mr. John Beall and this deponent were standing at the corner of Beall's fence and by the road and Beall told him he had the road cleared upon the back line of his land and on the outside of said land and they were standing at the corner of the aforesaid fence Mr. Beall told him the fence stood within the line between his brother Marshall and him and this deponent saw several marked trees about 10 or 12 feet without the fence and this deponent asked Mr. Beall what those trees were marked for and he's told him they were his line trees between him and his brother Marshall but did not show or tell him any bounded tree of his the said deals land.
      John Dunn age 68 years or thereabouts declares about 45 years ago there was a bridle path that went near this place he saw a bounded red oak and when he was in company with Duncan Ferguson, Mr. William Marshall or William Dyer he asked what that tree was and one of them told him it was a bound tree of Col. Fendalls but of what land he does not remember
