      Recorded Jul 7, 1740. I, Barbara Allen of CC, for 10,000 lbs tobacco, have sold to Philip Key of St Mary's County, 1 Negro wench named Hannah, 2 feather beds, 3 iron pots, 1 steer, 2 cows, 1 cow calf, 1 cow yearling, 30 hogs, 3 pewter basins, 4 pewter dishes, 9 pewter plates, 1 great chest, 1 large table, 1 lesser table, 1 trunk, 4 chairs, 1 brass kettle, 1 looking glass, 1 young horse, & 1 draught mare. If, however, I, sd Barbara Allen, pay sd Philip Key 10,000 lbs tobacco with interest on Nov 10 next, then this present sale to be void.       James Butcher vs Benjamin Allen. Cond: attachment.
      The Sheriff was commanded that of the goods, chattels, and credits of Benjamin Allen, late of CC, planter, within his bailiwick being, he should attach 1468 lbs of tobacco damages, and 800 lbs of tobacco for costs that had accrued and that further might accrue in prosecuting the writ of attachment afd, and when the same he had attached, or any part thereof, that he should have it before the Justices at next Nov CC Court, then and there to be condemned and for the use of James Butcher, unless the sd Benjamin should come then and there and answer unto the sd James of a plea of trespass upon the case, and that by good & lawful men of his bailiwick he should make known to the garnishees, that they be before the Justices as afd, to show cause &c. And now here, came the afd James by Phil: Key, his atty, & offered himself against the sd Benja: of the plea afd, and the Sheriff returns to the Court the writ thus endorsed -
      I certify that on Oct 8, 1735, I attached in the hands of Barbara Allen the whole damages and costs within mentioned, of the effects of the within mentioned Benja: Allen, and I have made known to the above mentioned garnishee that she be at the time and place within prescribed before the Justices afd, to show cause why the same effects so attached in her hands should not be condemned, and sd James Butcher have thereof execution before Thos: St:Clare & Walter Hanson, 2 good and lawful men of my bailiwick, as I am hereby commanded. So answers Geo: Dent, Sher:.
      And the sd Barbara, into Court here in her proper person comes and says that at the time of laying the attachment, she had and still has, in her hands, as Admix of Joseph Allen, decd, of the effects of the afd Benjamin, 12 £15 shillings and no more. Because sd James cannot deny the averment afd, but admits the same to be true, he prays condemnation of the sd 12 £15 shillings, with execution to him to be adjudged. Ordered that sd James have condemnation of the sd 12 £15 shillings in the hands of sd Barbara as adm'x of sd Joseph Allen, and the effects of the afd Benja: by the Court here adjudged, and that the sd James have thereof execution of the goods and chattels of the sd Joseph Allen in the hands of the sd Barbara remaining to be administered.
