      It is my desire to be buried in my burying place in my garden by my first wife.
      To dau. Sarah Contee, 1 guinea, having already given her what portion I could afford.
      To son Philip Richard Fendall, 1 guinea, having already given him what I could afford.
      To three grandchildren Benjamin Fendall, Eleanor Fendall and Elizabeth Fendall, 1 guinea each.

Benjamin Fendall for term of years by lease dated Jun 18, 1752, and which by the death of the sd Robert Yates, survived to the sd Benjamin Fendall, on which sd tract there is now erected one water grist mill, one bake house, with sundry other buildings and improvements, and the sd Benjamin Fendall, being so thereof possessed, departed this life, having first made his will dated Apr 6, 1764, and therein, after having disposed of some part of his estate, does direct that the rest of his real and personal estate be sold at public vendue by his executor, to wit, the tract whereon the testator then lived, called Battens Cliffs, one other tract purchased by the sd testator of Henry Thompson called part Three Brothers, one other tract called Beavers Lodge, the testator's water grist mills on Allens Fresh, together with the land condemned by virtue of a writ of ad quod damnum to erect the sd mills on, and appointed the above mentioned Thomas Contee and Henry Fendall executors who, in performance of the authority given to them by sd will, have sold at public vendue the sd tract of land, containing 20 acres, lying in Allens Fresh, whereon stands erected the water grist mill afd, unto the above mentioned James Swann, for 471 £sterling- This deed therefore witnesses that sd Thomas Contee and Henry Fendall, executors as afd, for sixty one £sterling .. hereby sell to sd James Swann, the residue of a term yet to come and unexpired, of all that tract of land in Cc and on d run called Allens Fresh, containing 20 acres whereon stands a water grist mill and bake house, and lately in the tenure and occupation of Benjamin Fendall, Esq, decd, leased to sd Benjamin Fendall and Robert Yates decd for the full term of 80 years, from the agent of Lord Baltimore, proprietor of Maryland, dated Jun 18, 1752 and recorded in the High Court of chancery of Maryland.       Benjamin Fendall vs Francis Meeke, Ex:r of Thomas Harrison. TrCa. Non pross per defect Repl'n.
      Francis Meeke, late of CC, planter, executor of the Will of Thomas Harrison, late of CC, decd, was attached to answer unto Benjamin Fendall of a plea of trespass upon the case.. Then sd Benjamin, by Philip Key, his atty, complains that whereas the sd Thomas, in his lifetime, to wit, on [blank month and day], 1733, at CC, owed sd Benjamin 931 lbs of tobacco, being for sundry articles lying properly in account [see below], and as a consequence, to sd Benjamin promised to pay sd sum when requested. But Thomas, in his lifetime, and Francis, since his death, sd sum, or any part thereof, to sd Benjamin, has not paid, although often requested, sd Francis, in particular, on Nov 11, 1735 at CC, and at divers other days and times since, to the damage of sd Benjamin 1863 lbs of tobacco and thereof he brings suit.

      CC, Nov 15, 1735. Then came Benjamin Fendall and made oath that the above account is, to the best of his knowledge, just and true, and that he never recd any part thereof, nor any satisfaction for the same. Sworn in open Court. Wit - Sam: Hanson, Cl:.
      And the afd Francis, by Sam:l Young, his atty, comes and prays licence thereof to imparl until next Jun CC Court, and he has it, and same day is given sd Benjamin, at which day, sd Francis, by his atty, prays further licence thereof to imparl until next Aug CC Court, and he has it, and same day is given sd Benja: here. And now here, at sd Aug Court, came the sd Benjamin and sd Francis by their attorneys, and sd Benjamin, by his atty, prays that the sd Francis to his Declaration afd against him may answer, and the sd Francis, by his atty, comes and says that he, sd Benjamin, his action afd, against him, to have or maintain ought not because he says that sd Benjamin did on [blank date], at CC, refuse to swear or affirm that no part of the tobacco mentioned in the account referred to in the Plaintiff's Declaration, has been paid, nor anything else given or delivered towards satisfaction thereof. And sd Francis further says that the sd Benjamin did, on [blank date], at CC, sue & implead the sd Francis as Ex:r, although Francis did, on [blank date], at CC, offer to the sd Benjamin to pay what appears to be really due on the account, being so proved either by oath or affirmation as afd, wherefore sd Francis prays judgment if sd Benja: ought not to be nonsuit and to pay the full cost.
      And afterwards, at sd Aug Court, the afd Benjamin, although called, came not. Ordered that sd Benjamin take nothing by his writ afd, and that the sd Francis go thereof without day, and that sd Francis do recover against sd Benjamin 185 lbs of tobacco for his costs and charges.

      At the request of Benjamin Fendall and Robert Yates, the following articles of partnership was recorded on Jun 18, 1745.
      Apr 6, 1745 between Benja. Fendall of CC, Gent, and Robert Yates of CC, Gent, who agree to enter into partnership in building, completing, carrying on, and maintaining a water mill sufficient to accommodate and carry 2 pair of stones, together with a wooden dam, situated across the Fresh Run of the Water commonly called Allens Fresh, and on the east side thereof to build the said mill on the tract of land called Charles Borough, being in cc and now in possession of sd Benja. Fendall. The partners are to have equal risk and equal interest in the premises. It is agreed that Fendall will make over one moiety of 2 acres whereon sd mills are intended to be built, unto ad Yates, and also to grant Yates liberty to cut down and carry off any timber from that parcel of land called Charles Burrough. Fendall, for 5 £sterling, has sold to Yates one moiety of 2 acres in cc on the east side adjoining the Fresh Run of Aliens Fresh, being part of the tract of land called Charles Burrough, the 2 acres being bounded by the north corner at the east end of the bridge as it now stands over sd Fresh Run of water. Also conveyed from Fendall to Yates, is enough white oak trees from the land called Charles Burrough to finish his moiety of the mill. Fendall and Yates mutually contract to begin to build the mill. Know that we, Robert Horner and James Nivison of CC, Gentleman, executors of the will of Robert Yates, late of CC, decd, are bound to Benjamin Fendall of CC, Gentleman, in the sum of 100 £sterling. We bind ourselves this Mar 9, 1757, Whereas many disputes have arisen between Robert Horner and James Nivison, executors as afd, and sd Benjamin Fendall, concerning the property of a servant man called John Thorn and concerning other servants & sundry horses, cattle, hogs, beds, bedding, household furniture and other utensils belonging to and used with a water mill and bake house standing on Allens Fresh, formerly in possession of the deed Robert Yates and the sd Benjamin Fendall, and whereas the parties above mentioned want sd disputes amicably settled between them, they have mutually chosen Messrs George Johnson and John Hall as arbitrators and have given full power to choose a 3rd person if they differ, who are finally to settle the whole matter in controversy between them, now the condition of this bond is such that if afd Horner and Nivison comply with the award and final determination of sd George Johnson and John Hall, arbitrators as afd, the award to be delivered to the parties by the 20th of this instant ensuing, then the above bond to be void. Benjamin Fendall, in his lifetime, was possessed of 20 acres on Allens Fresh in CC, granted unto Robert [Yates] and sd Benjamin Fendall by a lease dated Jun 10, 1752, and by the death of sd Robert Yates, survived to sd Benjamin Fendall, on which tract there is now erected 1 water grist mill, 1 bake house with sundry other buildings and improvements, and Benjamin Fendall, being thereof possessed, died, having first made his will, wherein he directed that his water grist mills on Allens Fresh, together with the land condemned by virtue of a writ of ad quod damnum to erect sd mills on, should be sold. The afd Thomas Contee and Henry Fendall, Benjamin Fendall's executors, sold the tract of land to sd James Swan. This deed therefore witnesses that James Swan, for 235 £10 shillings sterling and for divers other good causes, sells to Thomas Contee one moiety of the tract of land situated as afd.
