      Joseph Williams, late of CC, planter, was attached to answer unto Humphrey Bell of a plea of trespass upon the case -
      And whereupon sd Humphrey, by Philip Key, his atty, complains that whereas the sd Joseph, on Mar 6, 1735, at CC, owed Humphrey 2308 lbs of tobacco, being the balance of an account, as by the particulars thereof herewith into Court brought may appear, and Joseph promised to pay Humphrey sd sum, but has not, although often asked to, particularly on Nov 10, 1736 at CC, and at divers other days and times, to the damage of Humphrey 4616 lbs of tobacco, and thereof suit is brought.

      Feb 7, 1736. Then came Mr. John Parnham and made oath that this account is just and true and that he has never recd any part thereof more than he has therein given credit for, or any satisfaction for the same, and I also certify that the Book of Accounts of the sd John Parnham, wherein that part of the account which is dated before Nov 6, appears to me to be proved upon Nov 6, 1736, before Robert Yates, & yearly every year before. Sworn to and certified by - John Briscoe.
      And sd Joseph, into Court here, in his proper person, comes and nothing in bar of the action afd of sd Humphree [sic] does he say. Ordered that sd Humph: do recover against sd Joseph, his damages, to 2308 lbs of tobacco, and 430 lbs of tobacco for his costs and charges. And afterwards, at Mar Court, came here in his proper person, the Defendant, and upon this, sd Defendant is committed into the Custody of the Sher:, George Dent, Gent:, by occasion of the premises, there to remain &c.
