Pursuant to the order of last Mar CC Court, Commission issued to examine witnesses touching the bounds of 2 tracts of land in CC, the one called Fern, and the other, Salisbury, in possession of John Parnham, as follows, viz - To John Briscoe, George Hatton, Samuel Chunn, & Peter Wood of CC, Gent (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land). The petition for Commission, dated Aug 11 in the 27th year of our Dominion, was presented at CC Court before Justices Robert Hanson, Gent, and his Associates. Signed Aug 14, 1741 - Edmd Porteus.
And now here, Samuel Chunn and Peter Wood, return the Commission afd, with the certificate and depositions following, viz - We did meet on the afd land on Sep 23 and Oct 3, 1741 and then and there did examine all such witnesses as to us were offered, as by the several depositions hereunto annexed may appear. Sep 23, 1741. The deposition of William Scot, age about 48, who says that the Run where he now stands, being on the west side of Pils' fresh, and near the Bridge somewhat above the sd Bridge, was always in his remembrance called the Mane Run and has heard several old Standers call it so, viz, Henry Norris, Daniel Murphey, William Thorn, and John Scot Sr. Signed - William (W his mark) Scott.
Sep 23, 1741. The deposition of William Hows, age about 53, who says that about 19 years ago, he was getting boards for Mr. John Parnham, decd, and some differences arose, whereupon Francis Knot, who was concerned in getting the sd boards, went to John Scot Sr, who came and said the Run, which is now called the Back Run, on the east side of Pils' Fresh, was no run, and that the Run where this Deponent now stands, was always called the main Run. The deposition of Edward Stonstreet, age about 67. who says that this run where he now stands, being on the west side of Pils' fresh, and about 60 yards above the main Road or bridge which is over the sd Run is and was always by him deemed the main Run of the sd Fresh. Sep 23, 1741. The deposition of Robert McHon, age about 68, who says that about 32 years ago, he was at work on the east side of Piles' fresh, and [t]he same small run which Run about 27 years ago, he heard called the Back Run by John Scot Sr and several others, who said, "let us go to the Back Run and catch fish", which accordingly we did. Sep 23, 1741. The deposition of Benjamin Chunn, age about 45, who says that being in company with John Scott Sr, about 25 years ago, several others being in company fishing on the west side of Pils' fresh, being near the place where this deponent now stands, and the sd John Scot said, "let us go to the Back Run", whereupon we went to a small run to the eastward from where he now stands, and after some time, sd Scot said let us go back to the main Run, which we did, and came near to this place where he now is, being on the west side of Pils' fresh and some small distance above the Bridge. Sep 23, 1741. The deposition of Capt. James Murray, age about 37, who says that on the 22nd instant, he conversed with Mr. Richard Edelen, who said that the Run commonly called the Back Run, being on the east side Pils' fresh, was a small Run, and that the Run on the west side of the sd Swamp was always called and deemed to be the main Run of Pils' fresh. Sep 23, 1741. The deposition of Thomas Sympson, age about 47, who says that about 17 years ago or more, he was running the lines of a tract of land called St. Thomas' and reversing the sd lines, he came to the place where he now stands, which line directed him over the run, whereupon Thomas Sympson Sr told him he must go no further, saying that St. Thomas' began on the west side of Pils' mane Fresh, which is the place where this deponent now stands, and he further says that about 10 days ago, he was in company with Edward Price Sr of St. Mary's County, who went with him about 50 yards above the Bridge standing on Pils' fresh, and on the west side thereof, and the sd Price told him that that was the main Run of the sd Branch and that he would swear it. Oct 3, 1741. The deposition of Edward Aprice, age about 77, who says that the Run where he now is, being on the west side of Pils' Fresh, and about 60 yards above the Common Fording Place or Bridge over the sd Run, was always, in his remembrance, deemed the Main Run, and he further says that about 60 years ago, he lived with Capt. Piles and was at the taking up of 2 tracts of land which we are ascertaining the bounds of, and at the survey of the sd land, he was a chain bearer, which land bounded on the west side of the sd Run, and the Run on the east side of the sd Swamp falling into the Main Run just above the Plank Bridge commonly called the Back Run, was never deemed the main Run but was always counted a small branch of the sd main Run. The deposition of Richard Edelen, aged about 70, who says that the place where he now is, being on the west side of Piles' fresh, and about 60 yards above the Common fording place or main Road over the sd Run, was always deemed the main Run of the sd Fresh, and that he heard Thomas Sympson Sr, decd, declare on oath that this was the main Run of sd fresh, and he further says that about 27 years ago, he got several timber trees, between this place and a run commonly called the Back Run, which was then a small run and not counted otherwise. The deposition of Thomas Burch, age about 55 years, who says that the run where he now is, being on the west side of Pils' fresh and about 60 yards above the main Road or Common fording place over the sd Fresh was always deemed the main Run, and he further says he heard Thomas Sympson Sr, decd, declare on oath, that this was the main Run of the sd fresh and that he got timber near the sd Run for Mr. John Parnham.
