      Indenture tripartite between John Clagett, Jr. of Montgomery County, Maryland of the 1st part Sarah Clagett of PGCo of the 2nd part and Martha Clagett of PGCo of the 3rd part. Whereas Thomas Clagett, late of PGCo, deceased by his last will and testament bearing date August 5, 1737 and proved November 23, 1737 {this record references the wrong Thomas Clagett, it should be his grandfather Thomas Clagett whose will was dated July 25, 1701 and proved November 16, 1703} and recorded in Liber No. 20 folio 822 did bequeath to his son Richard Clagett 200 acres of land to be laid out of his tract called "Greenland" and lying back from the waterside in the freshes of Patuxent River containing and surveyed for 700 acres and to begin at the end of the land called "Weston" and did bequeath to his son John Clagett 200 acres to be laid out of the same tract of "Greenland" and to my loving wife Sarah Clagett, the remaining 300 acres of Greenland adjoining to the "Woodyard now in possession of Col. Henry Darnall and the surplus equally divided. And whereas by a late survey on Greenland the corrected courses and distances are given containing within the meets and bounds 757 ¾ acres, 57 ¾ acres of which is surplus and whereas by the recited will of Thomas Clagett the surplus land is to be equally divided between his sons Richard Clagett and John Clagett therefore the proportion of the surplus to each to be 16 ½ acres. And that part allocated to Richard Clagett is now in possession of his son Edward Clagett in that part allocated to John Clagett did in his lifetime did by his last will and testament bearing October 11, 1768 bequeath to his three daughters and Clagett, Sarah Clagett and Martha Clagett all his estate equally divided and no division thereof made; and the said Ann Clagett dying intestate her brother Thomas Clagett claimed the 3rd part of Greenland as heir at law to his sister who by his last will and testament bearing date January 5, 1778 bequeath the said part of "Greenland" to his son John Clagett (the party to this tripartite indenture).
      Now this tripartite indenture witness that we John Clagett, Jr., Sarah Clagett and Martha Clagett by mutual consent and agreement have divided the aforesaid part of "Greenland" containing 216 ½ acres in manner and form hereafter expressed each receiving 72-1/6 acres. In witness whereof we have hereunto et our hands and affixed our seals this August 10, 1779, John Clagett, Sarah Clagett, Martha Clagett in the presence of David Craufurd, Frank Leeke

      Indenture made August 11, 1779; John Clagett, Jr. of Montgomery County, Maryland in consideration of 434 pounds 3 shillings currency paid by John Smith Brookes, merchant has sold 45-7/10 acres out of part of a tract called "Greenland" containing 72-1/6 acres his 3rd part of 216 ½ acres lately divided between him and his two aunts, Sarah Clagett and Martha Clagett by a tripartite deed of partition bearing date August 10, 1779 and bounded by the main road that leads from a ford of Charles Branch commonly called Trumps Ford towards upper Marlborough Town.       Indenture made August 11, 1779; John Clagett, Jr. of Montgomery County, Maryland in consideration of 251 pounds 8 shillings and 8 pence currency paid by Sarah Clagett and Martha Clagett has sold 26 ½ acres out of part of a tract called "Greenland" containing 72-1/6 acres his 3rd part of 216 ½ acres lately divided between him and the said Sarah Clagett and Martha Clagett by a tripartite deed of partition bearing date August 10, 1779, 45-7/10th acres which part the said John Clagett this day sold and conveyed unto Mr. John Smith Brooke and the remainder of the said dividend or 3rd part is intended to be sold and conveyed unto the said Sarah Clagett and Martha Clagett and bounded by the main road that leads from a ford of Charles Branch commonly called Trumps Ford towards upper Marlborough Town.
