    • Thomas BELT, made 26 Sept. 1822, pr. [9?] Dec. 1823, Washington Co., MD, Wills, C:242.

In the name of God, Amen, I Thomas Belt of Hagers Town in the state of Maryland, being sick and weak in body, but of sound and disposing mind, memory & understanding, considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God to call me home, do therefore make and publish this my last will and testament in manner and form following; that is to say

First & principally, I commit my soul unto the hands of Almighty God and my body to the earth to be decently buried at the discretion of my executors hereinafter named. I give and devise unto my nephew Thomas Walter Belt, the plantation on which I formerly [resided] now under lease to Barton Bea[ ], known by the name of part of [Song] Meadow Enlarged & Turkey Buzzard adjoining lands of William O. Sprigg, Otho [H] Williams and others, to him the said Thomas Walter his heirs and assigns forever: also I give & bequeath to my said nephew Thomas Walter all my plate.
Item. I give and devise unto my brother [James] Belt of Prince Georges County, Md., all that lot and part of a lot with the improvements thereon situate in South Potomac Street formerly owned by David [Harry] and now under lease to Mrs. Sarah Harry, to the 1st April 1825, to him the said James, his heirs and assigns forever. I also give and devise to the said James, a meadow lot adjoining the above described property immediately opposite to the dwelling of Joseph [Boyd] to him, his heirs and assigns forever.
Item. It is my will & I hereby direct my executor hereinafter named to sell and dispose of my stone house & lot situate in West Washington Street Hagers Town formerly owned by the Hagers Town Bank & now under lease to W. William [Price], and the proceeds thereof to be equally divided between my brothers Josiah, Levin & Loyd their heirs and assigns forever.
Item. It is my will & I hereby direct that my servant Tom be emancipated and that he have the use of the house in which he now resides with the acre of land adjoining it during his natural life.
Item. I devise and bequeath all the rest and residue of my estate both real & personal after paying my just debts and funeral expences to be equally divided between my friend Daniel Sprigg and my niece Mrs. Schroeder daughter of my late brother Jeremiah, their heirs and assigns forever.
And lastly, I do hereby constitute and appoint Daniel Sprigg to be sole executor of this my last will and testament, revoking and annulling all former wills by me heretofore made, ratifying and confirming this and none other to be my last will and testament. In testimony whereof I have hereunto set my hand and affixed my seal this twenty sixth day of September in the year of our Lord one thousand eight hundred and twenty two, 1822. Thomas Belt

Signed Sealed, published and declared by Thomas Belt the above named testator [ ] for his last will and testament in the presence of us, who at his request, in his presence and in the presence of each other have subscribed our names as witnesses thereto. Wm. [O] Sprigg, Henry H. Gaither, D. G. Gott

[_ on the ninth] of December 1823 came Daniel Sprigg and made oath that the aforegoing is the true and only will of Thomas Belt, late of said county, deceased, that hath ever {come} to his hands and possession and that {he} doth not know of any other. At the same time came Henry H. Gaither and David G. Gott two of the three subscribing witnesses to said will and made oath that they did see the testator therein named sign and seal this will that they heard him publish, pronounce and declare the same to be his last will and Testament, that at the time of his so doing he was to the best of their apprehension of sound and disposing mind, memory and understanding and that they subscribed their names to this will in the presence and at the request of the Testator and that they saw the other subscribing witness do the same.
