      to be buried in my own burying place by my late dear dau., buried at Robert PECK's plant; mentions John COLLYER merchant in Bristol; water grist mill called Head's Mill to Joseph DOWNING (son of George DOWNING by Anne his wife); asks Anne the wife of George DOWNING to look after Elizabeth COLLYNS, an orphan, until she comes of age or marries; Sem RICHARDSON (son of James RICHARDSON) to stay with my ex. or return to his father which he pleaseth; Margaret BERRY (dau. of William BERRY);[Robert TALIAFERRO and Margaret his now wife]; in case the sd.       WHEREAS SEM COX and WILLIAM BERRY of the County of Richmond within the Dominion of Virginia took up and Pattent a certain tract of land containeing Three hundred and forty nine acres or thereabouts being bounded, begining att a Spanish Oak a corner tree of JAMES PHILLIPS, thence along the said line South twenty five degrees East two hundred and forty perches to a red Oak saplin, thence East North East One hundred twenty four perches to a red Oak standing in the line of ROBERT HARRISON, thence along the said line North North West four hundred twenty eight perches to a Hickory standing in the Line of JAMES KEY, thence along the said line South by East one hundred perches betwixt two white Oaks, thence binding upon said KEYs Land West and by South one hundred twenty perches to a Scrubby red Oake, thence South binding upon the Land of Coll, GAWIN CORBIN one hundred sixty nine perches to a Sassafras in another line of JAMES PHILLIPS, thence North sixty four degrees East one hundred perches to the first station containeing and being laid out for Three hundred fourty nine acres of land as in and by a Patent thereof made and granted to them the said SEM COX and WILLIAM BERRY and theire heires which bears date the Nineteenth day of December in ye year of our Lord 1704; which quantity of land is not yett devided between said SEM COX and WILLIAM BERRY and both of them being very desirous and willing that the same may be equally divided so that no notice hereafter may be taken of any Survivourship; IT IS THEREFORE hereby covenanted and fully agreed upon betweene the parties aforesaid that the DOEG SWAMP passing through the said Land shall be the division thereof and all the land lying on the South side of said Swamp the said SEM COX his heires is to have and the remaineing part or moyety of the land lying on the North side of said Swamp the said WILLIAM BERRY his heires to have; NOW KNOW ALL MEN by these presents that SEM COX for the summe of One thousand pounds of good sound merchantable leafe tobbacco and cask to him paid by WILLIAM BERRY for the use of his Daughter, MARGARETT BERRY, by these presents doth freely give bargaine sell unto MARGARETT BERRY and her heirs all his right title and interest whatsover of him the said SEM COX to his share of the said Land lying the South side the said Swamp: To have and to hold with the appurtenances unto MARGARETT BERRY her heires from and att the expiration of three yeares after the decease of said SEM COX to be holden of the Cheife Lord of the Fee thereof under the rents and services for the same due and accustomed, In Wittness whereof the parties aforesaid have to these presents sett their hands and seales the fifth day of Janry; in the yeare of our Lord God 1707

      I, Enoch Berry of the parish of Hanover .. give to my grandchildren by my daughter Winifred Berry two hundred pounds to be equally divided as they marry or come of age .. also two Negro women .. if my son in law Benjamin Berry thinks fitt to keep said Negroes till my grandchildren come of age or Marry that he give Security to King George Court .. I give the rest of my Estate to my son Thomas Berry .. also appoint my son Thomas Berry my executor .. this 24th day October 1763.
