Husband, CHARLES ASHTON ( ) was broken by Mr. RICH: FLYNTs his viz ( ) Mrs. LYNDSAYes House & Company wch: caused y( ) slight ye sd. MrsLYNDSAYes Company; Thereupon ( ) yt: opportunity & send by Goody DAWSON to desire ( ) come & speake wth: me, yor: Depont., Whereupon ( ) mayd. ELIZ: to aske me yor: Depont. if it were in ( ) Depont: made answer it were, then ye sd. I did know what I had to doe then, but ye sd: Mrs LYNDSAY upon yt: answer sent word back againe, by ye sd: JOANE HENLY, (as she said), yt: if i would have patience till her Husband went abroad againe, she would give me such satisfacon as should content me in satisfyinge her in one of ye two thinges she required of her & in ye meane time sent JOANE HENLY to my Husband to know of him wt. she should doe in this businesse, Whereupon he sent her word (as my Husband told me) he would not advise her at all, for she had will enough to manage her owne businesse, And as soon as her Husband was gone abroad, she, ye sd. Mrs. LYNDSAY, & JOAN HENLY came to a heape of Quarters yt: lyes in ye Path to Mr. GRIFFINGs & ye sd: JOANE HENLY came & fetched me, yor: Depont., to Mrs. LYNDSAY, & when I came to her she & I satt downe & then ( ) sd. Mrs. LYNDSAY told me yt: she would confesse the truth lest I should tell Mr. LYNDSAY any thinge of her; Whereupon she said wth: fallinge tears beg & intreat of me yt: I would con ceale ( ) she should reveale unto me wch: should be ye naked truth ( ) wt; past between ye sd. Mrs. LYNDSAY & my Husband, Whereupon I told her I would. Then first she craved p:den of God & afterwards of me & confessed to her shame she had diverse times committed carnall copulacon wth: my Husband & sd. yt he had injoyed as much as Mr. LYNDSAY for ye time he had injoyed her Company; Then I asked her how she durst wish ye grownd to open & she to be swallowed up imediately if ever she ( ) any such act wth my Huband, Whereupon she sd ( )llinge to have concelaed it from me but yt: her ( ) as she sayd did trouble her to think how falsly she had wished such a Judgmt. to fall upon her; but she hoped God would forgive her & I likewise & she further tole me though she did such a thinge wth: my Husband, she thought she did not wrong, me yr: Depont. in it, for she sd: she & I yor: Depont. were Sisters in inequity, Whereupon I askt. her how she could think she did not wronge me & what she meant by sayinge we were Sisters in Iniquity; She ye sd: Mrs. LYNDSAY then told me yt: my Husband had told her I was his Freind & not his Wife, for he was a bachilour still, but she did now see it was for his owne ends he told her such a lye; Whereupon ye day beinge could she desired to put a period to or: discourse till she had opportunity to send for me to her House & then I should learn ye truth of all thinges & within a short time after she sent JOANE HENLY to invite me, yor: Depont., to Mrs. LYNDSAYs to dinner, none being there but my selfe, Mrs. LYNDSAY & JOANE HENLY, & after dinner Mrs. LYNDSAY falling into her former discourse took me by ye hand before JOANE HENLEY & carried me into her Chamber & then sayd: to confirme wt: have formly told you, I will spew you how he & I did endeaver to get ye barr out of ye Window wth :a knife yt: I might let him into me in ye night & my Servants not see him, but we could not gett it out; Whereupon I thought of making a Door at ye end of ye Shedde wch: I caused to be made & gave a pair of gloves to WALTER PRICE, my hired Servt., & then I lett him out & in at all times when he came unknowns to any body, & further Mrs. LYNDSAY did acknowledge to yor: Depont: yt: the reason yt: moved her to lett my Husband have ye Carnall use of her was by reason she had a desire to have a Child by my Husband like my Daughter, ELIZ:, & I made her this answer; you may see God was not willinge to fulfill yor: unlawfull desire.       WHEREOF YE FORT SHALL BE BUILT
      Whereas p Act of Assembly bearing date ye 23d. 7ber last, It was enacted yt: a FORT should be erected by ye last of Apr: next in YEACOMAKO RIVER for ye defence of all such ships as shall arrive in ye sd: Countyes as p ye sd: Act relacon thereto being had more at large appeares, We ye aforesd: Col: PET: ASHTON, &c. being chosen comitionated & appoynted by ye respective County Co: of this Associason to see ye sd; Act put into effectual execution; Upon a serious debate & consultacon had therein (being sounded ye depth of ye Waters & strictly surveyed & Xd. what places best suit for a FORT), can find byt 3 places yt: can any way be convenient for ye designs, BARREN POINT, ye FERRY MANS POINT & LEVY POYNT. For ye first we find ye Breadth of ye Channell in ye place to be such a ship may passe up ye River neare 3/4 of a mile from it; at ye FERRYMANs POINT wee found ye ship soe infested wth: OYSTER SHELLS yt: it could not conveniently be wrought upon (ye place soe remote from Inhabitants yt: upon any emergency men could not suddenly be raised for ye defence of a FORT their); At LEVY POINT wee found many conveniencyes wch: ye other two places wanted, ye Grownd good to work on, ye scituacon commodious, there being better then 3 fathoms of water for more then a Mile above ye 3d: poynt at low water, good shoalinges on both side ye River for landing (when ye ships of or: friends & allyes may securely ride under ye p:teccon of a FORT there); have thought good & doe accordingly order yt: a FORT be built by ye tyme aforesd: on LEVY NECK POINT.
      Ordered yt: a HOUSE be built near ye place designed for ye FORT for ye entertaining of ye workemen & labour:rs yt: shall be imployed about ye sd: worke yt: ye sd: House be 40 foot long nine foot pitch & 20 foot wide, yt: their be a partition made at 15 foot wth: an inside Chimney therein & a Chimney in ye middle of ye other Rooms, & ordered yt: JNO: GARNER & another assistant whome he shall require, shall (all other work layd aside) forthwith build ye sd: HOUSE;
      It is ordered yt; Capt. JOHN LEE, pvide wt: nayles shall be convenient for ye buildinge of ye sd: HOUSE by ye 20th of this Instant at ye furtherest;
      It is ordered yt: Mr. NICK OWEN, Mr. CHARLES ASHTON & Mr. JNO: WEBBER be Overseers over ye sd; Worke & yt: in ye first place they appoynt ye ground whereon ye sd: HOUSE shall be built (good regard being had yt: reasonable distance be allowed from ye lines of ye FORT), & yt; ye sd. Overseers presse what men artificrs: lsbour:rs or others wth: wt: material] shall be needful for ye sd: Work or any thing relating thereto; Ordered yt: warrts. issue out to presse to secure at ye 2 Mills at LITTLE WICOCOMAKO & UPER MACHOTIACK forty barrells of Corne, 20 barrlls: at each Mill, for yt: it may be ready at ye FORT (weather permitting) by ye 20th of February next; Col: ASHTON & Majr: MORTON have promised to take care ye 20 barrells. shall be brought from LITTLE WICOMAKO & Col: SPENCER 20 barrlls: from MACHOTIACK by ye sd: tyme;
      Ordered yt: 400 lb. of PORKE & caske be provided by ye 20th of Febr: next, wch: Lt. Col. HEN: MEESE hath promised to take care yt: it shall be brought downe (weather permit-tinge) by ye sd: tyme; also a hdd. of SALT wch: Col. PET: ASHTON hath promised to procure by ye tyme aforesd.;
      Ordered yt: ye CORNE, MEAT & SALT aforesd. be deposited into ye hands of ye Overseers aforesd& to be distributed by them according to their discrecons:
      It is ordered yt: ye Overseers aforesd: doe receave ye GREAT GUNS (when brought downe) at ye place (commonly called BRADDOCKS HOLE) at high water mk: there to remayne untille further ordr:,
      Ordered yt: 2500 foot of Two Inch PLANCK be provided for ye wood aforesd., wch: Capt. JOHN LEE hath promised to provide & bring to ye place of ye FORT, by ye tyme aforesd., for wch: Planck he is to be allowed 2 pounds & a half of tobacco & cask p foot; Mr. JOHN WEBBAR is hereby ordered (as INGINEER ) to trace out ye lines of ye FORT, & ake (wth: ye other Overseers) yt: all thngs relating to ye worke be effectually done until! ye 20th of February & from yt: tyme as ENGINEER of ye sd: FORT to manage & oversee ye businesse untill ye last of Aprill next, for wch: he is to be allowed Sixteen hundred pounds of tobacco & cask;
      Ordered yt: 8 prs: of WHEELS after ye manner of FIELD CARRIAGES for GREAT GUNS be made very strong, fowr: foot diameter, such wheels Col: PET: ASHTON & Majr. ISAAC ALLERTON path promised to provide, & cause to be brought to ye FORT by ye 20th of March next;

      Ordered yt: this COMMITTEE be adjourned untill ye 20th of Febr: next.
      Ordered yt: ye Overseers of ye FORT take care yt: every thing relating thereto be as speedily (as may be) effected according to ye instructions given them.
      Ordered yt: WARRTS. issue out of Levy Twenty five men out of COPLE PARISH to be at ye FORT ye 9th of ye next month, there to continue aft worke until! ye 23d.of ye sd. month & yt: ye like levy be made of 25 men out of FAIREFIELD PARISH to be at ye FORT ye 23d. of ye sd. month, & there continue at worke until ye 7th of April, & yt: ye like levy of 25 men be prest out of WASHINGTON PARISH to be at ye place aforesd: ye 7th of April, & there continue at worke until! ye 21 of April & yt: ye like levy of 25 men be presst out of LEE PARISH to be at ye place aforesd: ye 21st April & there continue at worke until! ye 5th of May, yt: ye Constables of each respective Parish convey ye men prest by them at ye p:cise tymes appoynted by this order to be Overseers of ye FORT at LEVY POYNT & yt: ye Constables for each two men prest. as aforesd. presse a RUG;

      Whereas Mr. CHARLES ASHTON, one of ye Overseers of ye FORT is very weak. & incapable to discharg ye trust reposed in him, it is ordered yt: in case his distemper continues, WM: JALLON, supply his plaice
      It is ordered yt: Mr. THO: MATHEW forthwith: cause his SMYTH to make 8 shovel's plates 4 Mattocks, 12 grubbing hoes, 16 plates for ye GUNS, 16 Staples wth: bolts, 8 rings wth: Staples, 16 linchpins for ye AXLETRLEE of ye CARRIAGES, 16 Ax rungs, & yt: Mr. JNO; WEBBAR give directions about ye same;

      Upon serious consideracons of ye greate & urgent necessity wch: doth now ly upon most men for ye managing of their Crops, whereby such numbers of men cannot be pressed as may soe speedily carry out ye work at ye FORT, as by ye Law may be expected & is required wth:out great p:judsmt. to ye inhabitants of this Associacon; It is hereby ordered yt: ye severall Constables of this Associacon wthin their severall limitts & p:mises, doe forthwith : presse ten able men such as may best be spared to work at ye FORT, & in yt: work to continue untill ye same be completely finished;
      It is further ordered at this Committee yt: Mr. CHA: ASHTON & Mr. NICH: OWEN who were formly appoynted Overseers of ye FORT, be discharged from ye Trust to them comitted unlesse very urgent necessity require their assistance; & yt: Mr. JOHN WEBBAR be ye sole Overseer of ye sd: worke;
      It is further ordered yt: their be committed ye Powr: of Lt. Col. HEN: MEESE 8 lb. Sterl: money to purchase 80 drmy culberin round Shot/ of 4 inches diameter, 20 longer & 20 crosse barre shott ditto; 20 sakar shott of 3 inches diameter, S longer & 3 crosse barre shott, ditto, 40 minion round shott at 2 1/2 inches diameter, 10 longer & 20 crosse barre, ditto, 2 drmy culberin Ladle, 1 sakar ladle, & 1 minion ladle, 1 Flag & 1 drum & 20 fire- lock musketts;
      It is further ordered yt: there be 30 ells of Canvas provided to make ticking for Lodging to accomodate ye workmen & 10 yds. of trading cloth for covering;
