      Note:
      Richard Helm Foote, married a daughter of the Rev. William Stuart, of "Cedar Grove," in King George County, Virginia. The Rev. William Stuart was of Scotch descent, and was nearly related to the Royal family. His father was a captain in the army of Prince Charles Edward during the Scotch Rebellion of 1745. The Rev. Dr. Stuart had two brothers, Dr. Gibbon Stuart and John Stuart, a lawyer, and two sisters, one of whom was Mary, who married, first, Mr. Massie, and afterwards Mr. Dade. The other sister married Mr. Fitzhugh, of "Boscobel," Stafford County, Virginia.

      Page 252-254 In Name of God I PHILIP ALEXANDER of saint Pauls Parish in County of Staf ford being sick but of sound memory do make my Last Will & Testament in manner following that is to say First I give to my Eldest Son JOHN ALEXANDER all that tract of land whereon I now live with all the lands I have purchas'd thereto adjoyning together with all appurtenances. Also I give my second son PHILIP ALEXANDER all my lands with the appurtenances .. thereunto belonging in Parish of Truroe & County of Fairfax to hold forever. 1 also give my son Philip a tract of land containing 1051 acres which I bought of Mr. ROBERT MASSEY with all appurtenances being at Brent Town in the County of Prince William to hold forever I also give unto my third son WILLIAM ALEXANDER a tract containing 1075 acres which I bought of Mr. RICHARD FOOTE Attorney of SAMUEL HAYWARD, Consull at Gant with all appurtenances belonging being at Brent Town in County of Prince William to hold forever. I also give to my Daughter FRANCES STUART a morning ring besides her fortune already paid. I also give to my Daughter JANE ASHTON as much money as will make her fortune of 500 pounds which Ballance will appear in Mr. HENRY ASHTON'S account where I have paid near all the sum above mentioned. I also give to my daughter SARAH FENDALL as much money as will make her fortune up five hundred pounds which ballance will appear in Mr. JOHN FENDALLS account. All the rest I desire may be equally divided among my said three sons as they come of age, and as for the slaves that shall be allotted My dear Wife SARAH ALEXANDER as her thirds thereof my desire is that after her decease they the third part of the slaves and increase may be equally divided amongst my three sons. It is likewise my will that my three sons be constantly kept at school until they come to the age of 18 years, and then bound or put out either to a Doctor County Court Clerk or a Lawyer which they shall choose at that age until they arrive at age of 21 years and I do appoint Sarah Alexander my said Wife, John Alexander my said son & my friends Mr. RICHARD BERNARD, Mr. RICHARD FOOTE, Colo. HENRY FITZHUGH JUNR. & the Revd. WILLIAM STUART Executors of this my last Will & Testament .. and lastly I do hereby revoke all wills made by me formerly .. 12th July 1753.

      Page 49-52 In Name of God Amen This 9th day of April 1748 I DAVID STUART of Parish of St Pauls County Stafford Colony of Virginia Clk being at present in perfect health of body .. & knowing uncertainty of my life being desirous to settle ay worldly affairs do make this my Last Will & Testament First my soul into hands of God -- my body to be buried as my Exrs. shall be thought most convenient as for worldly goods My will is I first do revoke & make void all wills formerly made Imprimis I give to my beloved Wife JANE STUART during her live her choice of two Negroes besides what the Court of England & the Laws of this Colony provides with my riding chair, Horses & Harness all which at her death to return to be equally divided with her thirds among my Children hereafter mentioned Vizt. WILLIAM STUART, JOHN, SARAH and CHARLES STUART. item I give to my Son Wiliam 646 acres of land upon Broad run in Prince William County together with 460 acres in Fairfax County commonly known by Sandy Run failing heirs I give to my son John and heirs of his body. Item I give to my son Charles Stuart and his heirs failing heirs to my Daughters MARY MASSEY and Sarah Stuart and heirs failing such heirs to any next heir. Item I give to John 427 acres in Prince William County called the Bushey ridge at the white marsh failing heirs to my Son Charles failing heirs to William and failing heirs to my daughters .. Item I give to Charles all lands and edifices in Westmoreland and Stafford County & failing heirs to William. Item unto my Son William a Negro girl in Lieu of 3000 pounds of Tobo left him in Legacy by JOHN ALLAN deced together with all my Books & papers, negro not to be appraised.
      Item my son Charles have all my guns Swords & pistols with my watch & all wearing apparrell And my will .. if my son John should return from Barbados & not have to the value of 500 pounds from his Uncle GIBBONS in that case .. there shall be raised out of my Estate 100 pounds current money in order to build him a convenient dwelling house where he shall judge most proper upon his land in Prince William County and finally I appoint my beloved Wife Jane Stuart and my loving Son William Stuart Exrs. .. and I do appoint my son William guardian to my son Charles untill he arrives at age of 21 years but not to remove him from his Mother and I leave in legacy to my Daughter Mary Massey all the Debts of money or Tobacco due to me from the Estate of SIGISMOND MASSEY Deceas'd In Witness

      THIS INDENTURE made this Eleventh day of January in year of our Lord one thousand seven hundred and eighty six Between PHILIP STUART of County of PRINCE GEORGE and State of MARYLAND of one part and WILLIAM GIBBONS STUART of County of King George and State of Virginia of other part; Witnesseth that PHILIP STUART for sum of Seven hundred pounds current money of Virginia to him in hand paid by WILLIAM GIBBONS STUART by these presents doth bargain and sell unto WILLIAM GIBBONS STUART his heirs all that tenement situate in County of King George whereof JOHN STUART, late of said County, died seized and which said JOHN STUART in his Last Will and Testament names as the first lot or dividend in the Division of his Lands in said County between his Sons, describing the said lot or dividend in the following manner, vizt., all the high lands on South side of MACHOTICK DAM and all the low grounds adjoining the main Stream of said Dam from the New Bridge upwards," as may more fully appear from the Will ( now remaining of Record in the County Court of STAFFORD). and also all the Timber reserved by the said Will out of the second Lot therein named for the use of the first lot. And also all lands pastures profits commodities and appurtenances to the tenement belonging to have and to hold the tenement and premises unto WILLIAM GIBBONS STUART his heirs and PHILIP STUART for himself and his heirs the tenement and premise himself .and his heirs warrant and forever defend by these presents: In Witness whereof PHILIP STUART hath to this Indenture set his hand and affixed his seal the day and year first above written
