Lease. May 12, 1741 from John Courts of Charles County, Esq, to Henry Barnes of Charles County, bachelor, for and in consideration of sd Henry Barnes overlooking the hands & stock of hogs & cattle, horses, etc, and for the covenants hereafter mentioned and for other good considerations, the lease of a tract of land called Crowches Gift in Page on the north side of the Main Fresh Run at the head of Mattawoman or St. Thomases Cr, bounded by the land of Jno Clark, containing and laid out for about 500 acres. To have and to hold, from Mar 25 next during the term of 14 years. Courts agrees to procure house carpenters to build and repair all such dwelling houses, tobacco houses, barns, stables, com houses, Negro quarters or what other houses is thought convenient and necessary for the plantation by sd Barnes, and there to put and keep two good working hands, finding them sufficient clothes and working tools, and also there to put hogs, cattle, and horses, what is thought necessary by sd Barnes for the use of sd plantation and towards raising of a stock. Barnes agrees to keep two good working hands on the plantation, and to find them sufficient clothes and working tools and to provide nails towards building and repairing all such houses as he thinks necessary for the plantation, and there to put an equal stock of hogs, horses, cattle, &c with sd Courts, and to overlook sd plantation and hands. Courts and Barnes are to provide an equal number of working hands and there put an equal number of stock, and at the end of the term, Courts and Barnes will split the stock equally. Pursuant to the order of last Jun Court, Commission issued to perpetuate the memory of the bounds of a tract of land called Bergen apzone, lying in CC, in possession of Mark Penn, John Brown, and Anne Anderson. Commissioners appointed: Robert Yates, Charles Yates, John Maddox, and John Howard, Gent (not being any way related to the Petitioner, contiguous Proprietor, nor interested in the sd land). And now here, Charles Yates, John Howard, & John Maddox, return to this Court the preceding Commission with the subsequent certificate and the following depositions:
We met on the premises on Oct 10, 1738, and in the presence and hearing of the parties then present, took the several depositions which are hereto annexed. Signed - Charles Yates, John Maddox, John Howard.
CC. The deposition of Mr. John Courts, age about 46, who says that about 30 odd years ago, Mr. Thomas Harris and several others told this deponent that a locust post that stood near a small run between Mr. Thomas Harris' Plantation and where Edward Anderson lived and on the south side of sd run near the same stood a bounded locust, and they told this deponent it was a boundary of Richard Morris' Land.
The deposition of John Wilder, age about 46, who says that Mr. William Penn told this deponent that he was along with Mr. Manning when he ran the land called Bergen apzone, and that old Thos: Warren came by and showed them the 2nd bound tree of the Cabin Land and said he had reason to know it, for he was whipped at it.
CC. The deposition of John Macneale, age about 37, who says that about 8 years ago, this deponent was riding in company with Edwd Anderson, and that the sd Anderson told this deponent that the place where Mark Penn had placed his brick kiln, was the place where the bound tree of the land that the sd Mark Penn bought of Cleborn Lomax, it being the place expressed in the deposition of John Hamill.
CC. The deposition of John Philpot, age about 46, who says that about 10 years ago, that he was in company with several persons, and when they came near Mr. Hanson's Gate, this deponent was told that the place where Mr. Hamill and John Macneale has sworn to in their depositions, was the place where the 1st bound tree of the land stood that Mark Penn bought of Cleborn Lomax.
John Hamill, age about 46, declares that some time about 9-10 years ago, this deponent, in company with Wm Penn, decd, came to a gate then and now called Samuel Hanson's Gate, and upon the south side of the sd Gate, there was then a brick kiln, whether burned or not this deponent cannot remember, but that the sd William spoke the following words to this deponent: fore God my brother Mark has not all his kiln upon his own land for in that corner of the kiln stood the bounded locust post, the beginning of Bargon upzen, and this deponent further says that by sundry other persons since then, was told that the brick kiln afd was built where the bounded post of Bargon upzon stood.

Commissioners appointed: Gustavus Brown; Samuel Hanson, John Hanson, and Benjamin Douglas, Gent (not being any way related to the Petitioner, contiguous Proprietor, nor interested in the sd land).. And now here, Gustavus Brown and Samuel Hanson return to the Court here the Commission afd with the following certificate and the subsequent depositions -
We certify that we met on the lands within mentioned on Sep 5, 1738, and then and there took the depositions of Mr. John Courts, Ralph Shaw, Edwd Gilpin, Colo. Robert Hanson, and Leadstone Smallwood, which depositions are hereto annexed. Signed -- Gustavus Brown, Saml Hanson.
CC, Sep 5, 1738. John Courts of CC, Gent, age about 46, says that about 31-32 years ago, he was with Col. John Contee, Joseph Manning, and some others, the sd Joseph Manning being then Surveyor, was running a dividing line between the sd John Contee and Mr. William Chandler, that they began at a marsh side near Portobacco Cr, and to the best of his remembrance, at a white oak standing near the place afd, and ran a course up into the woods 'til their number of perches (as he understood) was out, and not finding any boundary there, they went some small distance forward in the same course, but how far he can't exactly tell and there by the directions of sd Contee, bounded a hickory standing at the head of a Stony Valley near a branch and is the same tree which for some time past has been reputed to be the dividing tree of the land afd. And this deponent further says that at the time when the sd hickory was marked as afd, it was then a small young tree and did not appear to have been marked before then. Signed - John Courts.
CC, Sep 5, 1738. Ralph Shaw Sr of CC, age about 53, says that about 15-16 years ago, he saw the tree mentioned in the above deposition, which seemed then to be a small, thriving tree, which sd tree seemed not to have been long bounded. Signed - Ralph Shaw Sr.
CC, Sep 5, 1738. Edward Gilpin of CC, age about 35, says that about 13 years ago, he saw the tree mentioned in John Courts' deposition, which was then a growing young tree, which sd tree appeared to him then not to have been long bounded, and that Geo. Goodrich informed him it was the dividing tree between Colo. John Contee and Mr. William Chandler. Signed - Edward Gilpin.
Robt. Hanson, age about 58, says that about 1722, he was surveying Mr. William Chandler's land at Portobacco, and he ran an east course from a white oak of sd land, commonly called Earlys Oak, to find a bounded beech, another boundary of sd land, which course fell short of the place. But when the number of perches was out, Leadstone Smallwood showed sd Chandler and this deponent the place where he said his father had told him the sd beech stood, and that there was then some part of a fallen beech lay by the place, which place is in a branch near'a cliff and is the place where the deponent now stands, and further, the deponent says that he made use of the sd place as a corner of the sd land, and ran a south course from thence, and then a west course to Portobacco Cr for the sd Chandler, and has since made use of it in other surveys. CC, Sep 5, 1738. Leadstone Smallwood of CC, age about 51, declares that upwards of 20 years ago, his, sd Leadstone's father brought him to the place mentioned in Colo. Hanson's deposition, and that there was some part of a fallen beech lay by the place afd and told this deponent that it was a bound tree of Mr. William Chandler's land, and ordered him to mark a sapling that stood by the place afd that he might remember it again, and he accordingly marked a dogwood sapling, which is now standing at the sd place.
