      want my whole estate to be kept together under the direction of my brother, William Barton Smoot and my sister, Elisabeth Smoot, for the maintenance and education of my children until my son Philip Baron Smoot arrives at age 16.
      To my son Alexander - If my son, Alexander Smoot, indemnifies his uncle, Wm Barton Smoot for a Negro boy he sold John Somerville, then I give sd Alexander all the lands I possess in CC or elsewhere, when his brother Philip arrives to the age xvii. But if Alexander refuses to indemnify his uncle, then I give my land to be equally divided among my 3 sons, Wilks, Geo. Clark, and Philip Barton Smoot.
      To my son Alexander - a Negro boy named Tom, now in the possession of his grandmother.
      To my 5 children - As soon as my son Philip arrives at age 16, then my will is that my whole personal estate with the increase and profits, shall my equally divided among my 5 children, Susanna, Milks, Geo Clark, Philip Barton, and Francis Smoot,
      My brother Wm Barton Smoot and my sister, Elizabeth Smoot are to have the management of my children.

      George Clarke Smoote
      (17-- - 1779)

      George Clarke Smoot, son of Barton and Susannah Mackall (Clarke) Smoot, was born in Charles County. He married Sarah, the widow of John Fendall. On February 8, 1765, Philip Richard Fendall and George Smoot and Sarah his wife executors of John Fendall late of Charles County, deceased, petitioned Daniel Jenifer, Gent., Deputy Commissioner, for a settlement of the estate.

      George Clarke Smoot established his seat in William and Mary Parish, where his ancestors previously had lived many years. In 1772 he and Anne Douglas were named executors of the will of Benjamin Douglas Jr.

      The will of George Clarke Smoot was dated July 22, 1779, and proved in Charles County on October 20, 1779. He directed that his estate be maintained and administered by his brother William Barton Smoot and his sister Elizabeth Smoot for the support and education of his children until his son Philip Barton reached the age of 16 years. He willed his son, Alexander, all land in Charles County, and the residue of the estate to his children. The instrument was witnessed by James Cotterell, Abel Wakefield, and Mary Wakefield.

      The inventory of his personal effects was filed on March 14, 1780, with Susannah Smoot and John Attaway Clarke as the kinsmen. The executors of George Smoot paid taxes on 30 acres of "Baker's Addition" lying in William and Mary Parish in 1783.

      The additional and final account of Anne Douglass and George Clark Smoot, executors of Benjamin Douglass Jr., late of CC, deceased, viz -
      Debts include: the balance of a former account, exhibited into Orphan court on July 19, 1777, amounting to 165 £7 shillings 7.75 pence; money in the hands of Benjamin Marshall; money; received of Henry Fendall, of Benjamin Gwin, of Joseph Gwinn Sr.; crop tobacco received of William Shaw in the year 1772. The whole amount; 174 £0 shillings 3-1/4 pence.
      Disbursements went to: John and James Jamieson; John Bruce; Walter Hanson, Register, for stating, passing, and recording this account. Balance to be disposed according to the deceased's will: 167 £16 shillings 8-1/4 pence.

      Whereas I, Philip Richard Fendall, having formerly purchased at the sale of the personal estate of the decd John Fendall, my brother, 2 female Negro slaves named Jenny and Eve, and paid and accounted for the same in the estate of sd John Fendall, and which purchase was by me made for the only use and behoof of Nelly Fendall, now decd, and Elizabeth Ann Fendall, my nieces and the infant daughters of the sd John Fendall, in joint tenancy, and which slaves were accordingly given by me to them and left in the possession of Sarah Fendall, the mother of the sd infant children (now the wife of George Smoot) as their natural guardian for their use and benefit, and since the death of the sd Nelly, both the sd slaves and their increase have devolved to and become the property of the sd Elizabeth Ann, as survivor.
      Now for the further and better assuring of the sd Negro slaves and their increase to be the absolute property of the sd Elizabeth Ann Fendall, and for the love I have for sd Elizabeth Ann, and for 5 shillings to me paid by sd Elizabeth Ann, I, by Thomas Contee, my atty in fact, appointed by CC power of atty dated [blank month and day], 1777, I give sd Elizabeth Ann Fendall the afd slaves named Jenny and Eve, and a Negro child named Rachael, the daughter of the sd Jenny, and their future increase.
