This Indenture made this fifteenth day of February in the Year of our
Lord Seventeen hundred and fifty nine Between Dryden Forbes of Saint
Marys County Widow of the One Part and David Downie of Saint Marys County
Planter of the other Part Witnesseth That the said Dryden Forbes for and in
consideration of the Sum of Five Shillings Current Money to her in hand paid at or
before the sealing and Delivery of these Presents the Receipt whereof is hereby acknowledged Hath bargained and Sold and by these Presents Doth grant
bargain and Sell unto him the Said David Downie his Executors Administrators
and Assigns All that Tract or Parcel of Land lying and being in Saint
Marys County aforesaid near Saint Marys River called Dryden containing
four hundred and eighty three Acres and an half Acre of Land Together with
all Edifices Buildings Gardens Orchards Ways Waters Water Courses Commodities
Priviledges Improvements Emoluments Advantages and Appurtenances whatsoever
to the Same Tract or Parcel of Land belonging or appertaining and the Revers^i^on
and Reversions Remainder and Remainders Rents issues and Profits thereof
and of every Part and Parcel thereof To have and to hold the said Tract
or Parcel of Land and all and Singular the Premisses with its Rights
Members and Appurtenances unto the Said David Downie his Executors
Administrators and Assigns from the Day next before the Day of the date
of these Presents for and during and untill the full End and Term of one
whole year from thence next ensuing and fully to be compleat and
ended To the Intent and Purpose that (by force and Virtue of these
Presents and of the Statute for Transferring Uses into Possession) the
Said David Downie may be in the Actual Possession of the Premisses and
be thereby enabled to take and accept a Grant and Release of the Reversion
and Inheritance thereof to him and his Heirs for Ever In Witness
whereof the Parties to these Presents have hereunto interchangeably set
their Hands and Affixed their Seals the Day and Year first above written

This Indenture Tripartite made this Sixteenth day of February in the year
of our Lord Seventeen hundred and fifty nine Between Dryden Forbes of Saint
Marys County Widow of the first Part James Forbes of Saint Marys County Gentleman
of the Second Part and David Downie of Saint Marys County Planter of the third
Part Witnesseth that the said Dryden Forbes for and in consideration of the sum
of Three hundred and Ninety Eight pounds Nine Shillings and Six pence sterling
to her in hand paid by the said David Downie at or before the Sealing and Delivery
of these Presents the Receipt whereof is hereby acknowledged and for the docking
Barring and Extinguishing all Estates Tail and all Reversions and Remainders
thereupon expectant or depending of and in the Lands Tenements and Hereditaments
herein after Mentioned (by and with the Advice and Consent of the said
James Forbes testified by his being a Party to and his Sealing and Executing
these Presents) Hath granted bargained sold released and confirmed and by these
Presents Doth grant bargain Sell release and Confirm unto him the said David
Downie (in his Actual Possession now being by Virtue of a bargain and Sale to him
thereof made by her the said Dryden Forbes bearing Date the Day next before the Day
of the Date of these Presents for one whole year commencing from the Day next before
the Day of the Date thereof and by force of the Statute for Transferring uses into
Possession) his Heirs and Assigns All that Tract or Parcel of Land lying and being
in Saint Marys County aforesaid near Saint Marys River called Dryden
containing four hundred and Eighty three Acres and an half Acre of Land
Together with all Edifices Buildings Gardens Orchards Ways Waters Water
Courses Commodities Priviledges Improvements Emoluments Advantages
and Appurtenances whatsoever to the same Tract or Parcel of Land belonging
or appurtaining and the Reversion and Reversion Remainder and Remainders
Rents Issues and Profits thereof and of every part and Parcel thereof and also
all the Estate Right Title Interest use trust Property Claim and Demand whatsoever
of her the Said Dryden Forbes of in to or out of the aforesaid Tract or
Parcel of Land or any part thereof To have and to hold the said Tract
or Parcel of Land and all and Singular the Premisses with its Right Members and
Appurtenances to him the said David Downie his Heirs and Assigns To the Intent and Purpose that the said David Downie may be and become perfect Tenant
of the Freehold and Inheritance of the said Premisses that a Common Recovery
may be had and Suffered against him in such Manner as is herein after
mentioned And for that Purpose it is hereby covenanted granted and agreed
by and between all the said Parties to these presents that before the End of the
next ^April^ Provincial Court one or more Writ or Writs of Entry Sur Disseisin en le Post
shall and may be brought and Prosecuted by and in the name of him the said
James Forbes as Plaintiff or Demandant against him the said David Downie
as Tenant or Defendant of and for the aforesaid Tract or Parcel of Land and
Premisses with the Appurtenances by Such Name or Names Quantity Quality
Number or Content of Acres or other Certainties and Discriptions as shall be apt and
Convenient in that behalf To which Writ or Writs the Said David Downie shall
Appear gratis in his proper Person or by his Attorney or Attorneys lawfully
authorized and shall Vouch to Warrant the Premisses the Said Dryden Forbes who
Shall likewise appear gratis in her Proper person or by attorney or attorneys
lawfully authorized and shall and will Enter into the said Warranty and
after Imparlance make Default and such further and other Proceedings
Shall be therein so that one or more good and Perfect Common Recovery
or Recoverys with Double Voucher shall and may be had Suffered and perfected
and executed in all things according to the usual form of Common Recoverys
with Double Voucher for Assurance of Lands in Such Cases used and accustomed
And it is hereby further Covenanted granted Concluded Declared and fully
agreed by and between all the Said Parties to these Presents that from and
after the Suffering and perfecting the said Recovery or Recoveryes as well
these Presents and the Assurance ^hereby^ made as also the Common Recovery
or Recoverys so as aforesaid or in any other Manner to be had Suffered
and perfected shall be and Enure and shall be adjudged construed deemed
and taken and are and were Meant and intended and are hereby
declared to be and Enure to the Recoveror or Recoverors in the said Recovery
or Recoverys named or to be named and he and they and his and their Heirs
Shall stand and be Seized of the Tract or Parcel of Land aforesaid and Premisses and every part thereof to and for the only proper use and Behoof of him the said
David Downie his Heirs and Assigns for Ever and to or for no other Use Intent
Purpose whatsoever In Witness whereof the Parties to these Presents have hereunto
Interchangeably Set their Hands and Affixed their seals the Day and Year first

and David Downie parties to the within Deed and did acknowledge the same
to be their Several Act and Deed to and for the Uses Intents and Purposes within
mentioned and the Land and Premisses therein Mentioned to be the Right and
Estate of the said David Downie his Heirs and Assigns for Ever according to
the Purport and true meaning of the same Deed
