      Will of Captain John Ashby (ca.1707 -1769)
      The following certified copy of the will of Captain John Ashby (ca.1707-1789) was obtained in 1938 by his descendant, EEe late Eppert Rudolf McKay (1902-1964) of Boston, Mass., from C. C. Brannon, then clerk of the circuit court of Frederick Co., Va. A copy of it, under the seal of the Frederick County court, was sent to the present compiler.

      In the Name of God amen, I John Ashby of the county of Fauquier and State of Virginia being weak in body but of sound mind and memory Praised be god, and calling to mind the uncertain State of man in this Transitory life, Do make this my Last will and Testament in manner following,
      First I recommend my soul to God who gave it, trusting that in & through the merits and intersession
      of his son my ever Blessed saviour Jesus Christ, to obtain a full pardon and remission of all my sins, and my body I desire may be buried in a Christian like and Decent manner according to the discretion of my Executors hereafter named, touching my Temporal Estate wherewith it hath been pleased God to bless me with; I give devise and despose of the same as follows to wit,
      Item, I give and bequeath to my son Nathaniel Ashby the tract of Land in Frederick County and whereon he now lives known by the name of the south west Marsh, and Likewise five hundred acres of my land, that I own on a Place callid Bare grass near the falls of Ohio, together with the following Slaves to wit, Floro, Toney, antony, Pegg, Allen, which are now in his possession and likewise, Charles, Old Daniel, Yancy, Sinah, and Harry, the five last mentioned Negroes is now in my possession and likewise all the stock he has in his possession except a very good Cow & Calf which Nathaniel Ashby is to let my Daughter Sharlott have at age or marriage all the above mentioned articles I give to him & his Heirs, forever.

      Item, I give and bequeath to my son Lewis Ashby and his Heirs forever all my lands on Shanadore River in Frederick County and whereon he now lives and likewise five hundred acres of my Land on Bear grass near the falls of Ohio, it being the half of one Thousand Acres of Land given to me for my Military Services the the said Land I leave to be Equally Divided according to Quality & Quantity and Likewise the following Slaves to wit, hill, antony, Nen, David, Soloman, Nett, Pegg, Betty, Hannah, Winney, all now in his possession and my clock and all the stock he has now in his Possession, Except a choice Cow and Calf which he is to give to my Daughter Charlott at age or marriage all which I give to him and his Heirs forever.
      Item, I give to my Daughter Elizabeth Peters? Sons by John Peters one thousand acres of my land on Elkhorn Creek in Kentucky it being the one half of a two Thousand acres given to me for my Military Service & Likewise I give her the following Negroes to wit, Frank, Benn, Winn, Heth, Adam, Young Daniel and Stephen now in her possresslion the within Mentioned its my will that they be Divided and there increase amongst her children that she had by John Peters so as not to clash with John Peters' Will and I Likewise give her negro old Will Mimey & Meley these last three she is to have during her lifetime and after her Decease and after her Death they are to be Equally divided amongst her children by John Peters, I give her my new bofat and her choise of my chests and I give hir one third of the money that my Land sells for in Fauquier after fifty pounds of the money is paid Nancy Smith I leave her one third likewise of what my Stock and furniture sells for after my just Debts are paid out of the money the sd Land in Fauquier and Stock sells for.
      Item, I give to my Daughter Jane Darnall the Land I bought of Wm Parks that she has now in her possession and Likewise one Thousand acres of Land on Elkhorn Creek in Kentucky, I give to Jane Darnallts sons by Joseph Darnall and Likewise I give her the following negroes, to wit, Tom, Fann, Will, son of Sall Deold. Lucy, Jude, now in her possession, during her lifetime and after her Death to be Equally Divided amongst her children by Joseph Darnall it is further my will that the'above mentioned Negroes shall not be sold by Joseph Darnall or her Self, I give negro Clarey, to Lewis Darnall her son, I likewise give her a chest the next choice of Betty Peterses.
      Item, I farther give to my Daughter Jane Darnall one third of the money that my land and Stock and furniture sells for after my Just debts are paid and Nancy Smith gits her fifty pounds I farther give my oldest Bofatt.
      Item, I give to Edward Ashby my House and Lot in Winchester and my out Lot and If ever any Land is obtained by the Land Warrant I bought of Thos Delay Shumate for five hundred acres I give Two hundred'and fifty acres of the said Land to Edward Ashby & I give him the following Negroes, to wit, Spencer, Nilly, Isaac, Ben, Tom, & a Bed.
      Item, I give to my Daughter Nancy Smith Two hundred and fifty acres of Land I bought of Thos. Delay Shumate if ever obtained and the following Negroes to wit, Tinah, & Luce and I give her and fifty pounds for the trouble and Expense she has taken in Keeping my Daughter Sharlott and likewise will take in keeping her.
      Item, I give to my Daughter Sharlotte the following Negroes, to wit, young Daniel, young Will, Sall, Jude,
      Joshua, Rolly and a young Horse at fifteen pounds worth saddle & bridle worth five pounds and my new dish & Watch and the one third of what my land and Stock and furniture Sells for only the Horse saddle & Bridle the price is first to come out of the said money arising from the sd Land Stock & furniture it is my farther will that if she shall die without an Heir that all that I give her shall be Equally divided among all my Children.
      Item, I give the House and Lott I am at Law for in the General Court if Ever obtained to all my Children
      to be Equally Divided or the money arising therefrom, I farther Leave the money that Jacob Moore justly owes me that I am at Law with him for if recovered to be Equally Divided amongst all my Children.
      And Lastly I appoint my sons to wit, Nathl Ashby Lewis Ashby to be my whole & sole Executors and Manigers of this my Last Will and testament and it is farther my will and desire that my son Nathaniel Ashby shall see to the bringing up of my Daughter Sharlotte in a christian and creditable manner Hereby Revoking all other wills before, by me made In testimony whereof I have hereunto set my hand and affixed my Seal this October 1788.

      At a District Court held at the Town Dumfries the 13th day of May 1789 -
      This Will and codicil were proved by the oaths of Original Young and George Blackemore witnesses thereto and ordered to be recorded and on the motion of Nathaniel Ashby and Lewis Ashby the Executors therein named who made oath according to Law and together with Martin Pickett, George Blackemore and Augustine Smith their securities entered into bond in the penalty of seven thousand pounds conditioned as the Law directs, Certificate is granted them for obtaining a probate thereof in due form.       Item I give unto my loving son ALEXANDER JEFFRIES one Negroe man named James.
      Item I give unto my beloved son MOSES JEFFRIES one Negro girl named Hannah, but my intent is that, if he should make sale of the said Negros or dispose of her to any person whatsoever, that it shall be lawful for my son JAMES JEFFRIRE or heirs to possess the said Negros, and her increase. Item I give unto my beloved son James two Negros girls in his possession, the one named Dinah, & the other Bridgett and their increase & also all my moveable Estate in his possession after I dispose Of such legacies to the rest of my children as I shall think proper to bestow upon them in manner following.
      Item I give unto any beloved son GEORGE JEFFRIRE one Negro woman named Sarah and her increase.
      Item I give unto my beloved son JOHN JEFFRIRE one Negro woman named Toby also one feather bed.
      Item I give to my beloved son JOS. JEFFRIRE one Negros woman named Jane to him and heirs but my intent is that if she should have any increase before he is possessed with her, they shall fall to my grand daughter MARY JEFFRIRE daughter to James or her heirs.
      Item I give unto my beloved Daughter RACHAEL LANGE, one feather bed & furniture and four head of sheep & 2 head of cattle to her and heirs .. Item I give unto my beloved Daughter LUCRETIA VENT a feather bed & furniture also three head of sheep to her and heirs. But my intent is that my Executor shall keep those negroes together until my Just Debts and funeral Expenses are paid. And lastly I do appoint my loving son James Jeffrire and my beloved son John Jeffrire my whole Executors of this my last will & Testament .. 25th March 1761. Alexr Jeffrire
