      IN THE NAME OF GOD, Amen. the Ninth day of February one thousand seven hundred and thirty two, I ELIZABETH MIDDLETON of Westmorld. County & Cople Parish being very sick and weak of body but of perfect mind and memory thanks be given to Almighty God therefore, calling to mind ye mortality of my body, do make & ordain this to be my Last Will and Testament, that is to say, First, I give and recommend my Soul into ye hands of God that gave it me & body to be buried after decent manner at ye discression of my Executor, nothing doubting but at ye General! Resurrection I shall receive ye same again by ye mighty power of God;
      Item. I give & dispose unto my two Daughters, MARY MIDDLETON and ELLIS [Alice] MIDDLETON all and singular my whole Estate only what is excepted hereafter. JOHN MIDDLETON, my Grand Son, and BENJAMIN MIDDLETON, THOMS: MIDDLETON & ROBERT MIDDLETON, my Sons, I give unto them every one an English Shilling and likewise JNO: BROWN, my Son in Law, I give to him one English Shilling. It is my desire that my Estate may be deviled between my two Daughters, MARY MIDDLETON and ELLIS MIDDLETON by two or three of ye Neighbours without coming to an Appraisment. Know yee that we WILLIAM ALLEN of STAFFORD County and JOHN BROWNE of NORTHUMBERLAND County in consideration of the love & affection we bear unto DANIEL MARR of STAFFORD County, the God Son of me the above named WILLIAM ALLEN as also for the sume of Five shillings to us in hand paid by DANIEL MARR, do by these presents give and confirme unto the abovesaid DANIEL, the God Son of the above named WILLIAM ALLEN, all that parcell of land lying in County of Richmond and neare the GREAT MARSH RUN of RAPPA: being part of a tract of Seven bundred and thirteene acres granted to WILLIAM ALLEN and JOHN BROWNE by Deed out of the Proprietors Office dated Setpember the twenty fifth one thousand seven hundred and ten, being one third part in the right of the said tract begining one hundred & eighty poles from the Second Corner tree mentioned in the Deed and extends thence South fifty seven degrees East by a course of line trees through the said tract to the hack line and againe from the begining in the second line of the Deed one hundred and eighty poles along the said second course of the Deed to a marked tree and thence South fifty seven degrees East through the tract to the back line including Two hundred and Thirty and five acres as will more plainly appear by the Surveyors Land Register in STAFFORD County, To have and to hold the Two hundred and Thirty five acres of land unto DANIELL MARR his heirs as Wittness our hands and seals the first day of June one thousand seven hundred and fourteene

      In the ejectione firma between Thomas Thrustout plt & Ann Marsh def, Richard Bryant, John Gilbert, Thomas Dickenson, William Peck, Robert Johnson, William Strother, Neal McCormack, John Farguson, John Price, Henry Berry, Rush Hudson & Robert Strother were sworn a jury to try the issue who having heard the evidence & arguments of both parties withdrew & sometime after returned the following verdt (viz) we find a proprietors deed for 541 a. of land in King George Co granted to John Brown 8 Apr 1723, we find a plat of the sd land under the hand of John Copedge dated 22 Jan 1722/3, we find a lease in writing under the hand of John Brown the lessor of the plt dated 25 Jan 1724 for 100 a. of the sd land made to George Mash & Ann his wife the now def for the term of 21 years, we find a counterpart of the sd lease under the hands & seals of George Mash & Ann Mash dated the same day & year, we find John Brown procured 100 apple trees for the sd George & Ann Marsh to plant on the plantation, we find the sd George & Ann Mash have planted out seventy odd apple trees & have as many in a nursery as will make up 100, we find the sd Ann Mash has barked five while oaks for tanning her own leather, we find the sd plantation of the def is on the n side of Browns Run & within 200 & odd strides of commons line, if upon the whole the court shall adjudge the law be with the plt we find for him 1 shilling damage otherwise we find for the def, Richard Bryant foreman, which verdt is admitted to record & the plt has time till next court to consider the sd verdict.
