THE WILL OF JAMES ROY
"In the name of God, Amen. I, James Roy, being very sick and weak, but in perfect senses and memory do constitute and appoint this to be my last will and testament, leaving Major Francis Thornton my sole executor. Viz., that is to say, after my just debts and ... is paid, I leave to my son Thomas Roy all my land, only reserving for my daughter Elizabeth Gordon, now wife to John Gordon, her life in part of the said land, to hold, occupy, and enjoy till her, the said Elizabeth Gordon's death, and no one to hold under her any longer. Also, I leave to my son Thomas Roy four Negroes, that is to say: Sipped, Jack, Cate, and Jenney. And all the rest of my worldly goods I leave to be equally divided betwixt my five daughters, except what Negroes and Mulattoes over and above the four left to my son Thomas Roy, which my daughter Elizabeth Gordon is not to have any claim in by reason she has already received her due share of the slaves above named. Negroes and Mulattoes being four in number to be equally divided betwixt my daughters Effey Roy, Isabella Roy, Mary Roy, and Sarah Roy. And all the remainder to be equally divided betwixt my said daughter Elizabeth, Effey, Isabella, Mary, and Sarah. And to my son David Roy I leave one shilling sterling and no more. In witness whereof I have hereunto set my hand and seal this sixteenth day of April anno. one thousand seventeen hundred and forty-one." Signed, sealed, and delivered in the presence of Edwd. The deposition of Edward Herndon, aged thirty-three years being sworn, deposits that on Thursday at night the 16th of April, 1741 the deponent witnessed the will produced in Court of James Roy deceased. And on Saturday morning following when he went to bleed... the deceased, on last desire, he told him there was something... that should have been mentioned in his will which was that he had some cash by him, two double loans, and four pounds due from Thos. Edmondson. And after paying for the corn and some to her trifles there would be fifteen pounds lift, which he desired might be applied to the schooling of his son Thomas Roy, and that he believed he was in his proper senses at the time. And further this Deponent leyeth not."
Edward Herndon. On motion of Francis Thornton, the executor of James Roy deceased, the Court took the deposition of Edward Herndon which was ordered to be annexed to the said deceased's will. John Waller, Court Clerk "At a Court held for Spotsylvania County on Thursday, July 7th 1741: The last will and testament of James Roy deceased: being sworn to and exhibited by Francis Thornton, Jr., being the executor therein named, was proved by the oath of Edward Hendon, John Gordon, and Elizabeth Gordon the witnesses thereto, and the said executor having entered into bond with John Taliaferro being his security, and acknowledged the same in court, and having taken the oath as the court directs, and certificate in due form is granted him for obtaining court of probate. And it is ordered that Edward Herndon, Joseph Howard, William Berry and Thomas Ship, or any three of them, being first sworn before some magistrate of this county do appraise all such of the said deceased's estate as shall be produced and shown them by said Executor, and make return of their processing therein."
