This Indenture made this Nineteenth Day of August in the
Year of our Lord One thousand Seven hundred and Sixty One Between
Thomas Rutland of Ann Arundel County leonard Wayman Sen.r of same
county and Leonard Wayman jun.r of Frederick County and Thomas
Sappington and Stephen Stewart of Ann Arundel County of the one Part
and Richard Maccubbin of the same county of the other Part Witnesseth
that the said Thomas Rutland Leonard Wayman Sen.r and Leonard Wayman
jun.r Thomas Sappington and Stephen Stewart for and in consideration of the
sum of five Shillings Sterling to them in hand paid at or before the Ensealing
and Delivery of these Presents the receipt whereof is hereby acknowledged
Have bargained and sold and by these Presents Do bargain and sell unto
the said Richard Maccubbin All those two Tracts or parcels of Land hereafter
mentioned Scituate lying and being partly in Prince Georges and
partly in Ann arundel Countys the one called Rutlands Purchase Enlarged
containing five Hundred Acres of Land more or less the other called Rutlands
Purchase Enlarged containing nine hundred and Ninety one Acres of Land
more or less And the Reversion and Reversions Remainder and Remainders
Rents Issues and Profits thereof and of each and every of the said Tracts of
Land with their and each of their Rights Members and Appurtenances
To have and to Hold the Same two Tracts or Parcels of Land before
mentioned with their and each of every of their Rights Members and
Appurtenances unto him the said Richard his Executors Administrators and
Assigns from the Day next before the Day of the Date of these Presents
for and during and unto the full end and Term of one whole ^year^ from thence
next ensuing fully to be compleat and Ended To the intent and purpose
that by force and Virtue of the Statute for transferring Uses into
Possession and of these Presents the said Richard Maccubbin may be in
the Actual Possession of the Premisses and be thereby enabled to take and
accept a grant and release of the Reversion and Inheritance thereof to him
and his Heirs to and for such Uses Intents and Purposes as shall be
therein expressed In Witness whereof the parties have hereunto set
their Hands and Seals the Day and Year first above written

Thomas Rutland of Ann Arundel County Leonard Wayman Sen.r of
same county Leonard Wayman Jun.r of Frederick County Thomas
Sappington and Stephen Stewart of Ann Arundel County of the one Part
and Richard Maccubbin of the same County of the other Part Witnesseth
that the said Thomas Rutland Leonard Wayman Sen.r and Leonard
Wayman jun.r Thomas Sappington and Stephen Stewart for and in
Hand paid at or before the ensealing and Delivery of these Presents
the receipt whereof is hereby acknowledged and for the Docking barring
and extinguishing all Estates Taile and all Reversions and remainders
thereupon expectant or depending of and in the Lands Tenements
and Hereditaments herein after mentioned and to make the same
Richard Maccubbin Compleat Tenant to the præcipe so as that
a Common Recovery may be had and Suffered against him to the uses
herein after mentioned Have remised released Enfeoffed and Confirmed
and by these Presents Do remise Release Enfeoff and Confirm unto
him the said Richard Maccubbin (in his actual possession now being
by virtue of a bargain and sale to him thereof made bearing date the
Day next before the Day of the Date of these Presents for one whole
year commencing from the Day next before the Day of the Date thereof
and by force of the Statute for transferring uses into possession) his Heirs
and Assigns All those two Tracts or Parcels of Land hereafter mentioned
scituate lying and being partly in Prince Georges and partly in
Ann Arundel Countys the one called Rutlands Purchase Enlarged
containing five hundred Acres of Land more or less the other called
Rutlands Purchase Enlarged containing Nine hundred and Ninety one
Acres of Land more or less together with all and Singular the Buildings
Improvements and Advantages to the same two Tracts or parcels of Land
belonging or in any wise appertaining and the Reversion and reversions
Remainder and Remainders Rents Issues and Profits of each of them and
all the Estate Right Title Interest Claim and Demand of the said
Thomas Rutland Leonard Wayman Sen.r Leonard Wayman jun.r Thomas
Sappington and Stephen Stewart of into or out of the same two parcels
of Land and every part thereof To have and to hold the same
Two Tracts or parcels of Land and Premisses with their and each of their Rights
Members and Appurtenances unto him the said Richard Maccubbin his Heirs
and Assigns to the intent and purpose that the said Richard Maccubbin may
be perfect Tenant of the Freehold of the said Premisses that a Common Recovery
may be had and Suffered against the said Richard Maccubbin in this present
Provincial Term and it is hereby declared by and between the Parties to these
Presents that whatsoever Common Recovery or Recoverys is are or shall be had
and Suffered during the present Term or any other Provincial Court shall be
deemed construed and taken to be and Enure to and for the use and Behoof
of him the said Thomas Rutland his Heirs and Assigns for ever and to or for
no other use intent or purpose whatsoever In Testimoney whereof the
parties to these presents have hereunto Set their Hands and Seals the Day
and Year first within written

Justices of the Provincial Court the within named Thomas Rutland
Leonard Wayman Sen.r Leonard Wayman Jun.r Thomas Sappington and
Stephen Stewart and acknowledged the within instrument of writing
to be their Act and Deed and the Lands and Premisses therein Specified
to be the right and Estate of the within named Richard Maccubbin his
Heirs and Assigns according to the true Intent and Meaning thereof
