Orange Co. VA Will Book 4, page 74: October the 28th 1802 the twenty eight dayes of October in the year of our Lord one Thousand aite hundred and two. This is the last will and Testament. Betty Smith my doter is to have a negor gearle by the name of Poley or pay in the value thereof. My son James a negor man by the name of Randel it is my desire for him to pay the value of him if he think fit Milley James my grand-daughter. I give my land to Milley Atkins her equal part with her brothers. Witness my hand and seal. Mildred James (seal).
Witnesses: Fanny Edwards, Mary Edwards, William Edwards.
At the Court held for Orange County at the Courthouse on Monday the twenty-fifth day of April 1803 This last will and testament of Mildred James deceased was proved by the oath of William Edwards a witness thereto ..

Samuel James (d. 1755)
Samuel was a farmer. He died young. His will in Orange County, Virginia, dated Dec. 14, 1754, was probated February 27, 1755. He bequeathed his estate to his wife, Mildred, during her lifetime or widowhood, and directed that in case she died or remarried, his brother, Thomas James, should be executor and divide his estate among his children. His children were not named in the will.

Mildred Talliaferro
Mildred qualified as executrix of her husband, Samuel James, with William Taliaferro her security, in the sum of one hundred pounds. (will bk. 2, Page 200). At a court held for Orange County September 23, 1754, on the motion of Mildred James, her tithables were ordered to be added to the lists. (Orange Co. Order bk. 1754-1763).
Mildred James, together with Co. George Taylor, Erasamus Taylor, Sarah Slaughter and Betty Slaughter, stood as sureties at the christening of Nicholas Taliaferro, born 30th October, 1757, son of William and Mary (Battaile) Taliaferro of "Newington on Mountain Run, Orange County, and grandson of John and Mary (Catlett) Taliaferro. (Wm. & Mary Quarterly: Vol, 1, Page 147).
In 1785, William Bell, in the State Enumerations, listed Mildred James as the head of a family, with three white souls, one dwelling and two other buildings. (Heads of family, Virginia., 1790).
She appears on the Orange County personal property returns for 1783, charged with one tithable, three houses, six cattle, and her slave being exempt. She petitioned the General Assembly for the arrears due on the pension her late son, Catlett, soldier of the Revolutionary War. An Act passed, December 15, 1791, directed same to be paid. (Hening, Vol. 13, Page 322).
Her will dated October 29, 1801, was probated April 25, 1803. Jos. Atkins, her son-in-law was executor, with Spencer Atkins his security. She mentions her daughter, Betty Smith, son James, graddaughter, Milly James, and leaves her land to Milly Atkins, "her equal part with her brothers." Her sons, Catlett and Stephen had died during her lifetime. She does not mention John, who is thought also to have died during her lifetime. (Orange Co. Will bk. 4, Page 74).

**Although Wingfield states that son John was thought to have died during her lifetime, documents show that this is incorrect. John is shown in on a document (a land transaction) dated 1804, along with his siblings, James, Spencer, Elizabeth and Mildred and their spouses selling 12 acres of property in Orange County, Virginia, owned by his mother. **Source: Dorles Repass
