      Bond. Jun 25, 1739. I, John Pridgett of PG, am bound to Charles Beall in the just sum of 15 £sterling, to which payment truly to be made, I bind myself. Whereas sd Pridgett, having received full satisfaction for some differences in a certain conveyance of land from sd Beall to sd Pridgett, if Pridgett forever hereafter acquits Beall from all damages and other troubles that may hereafter arise for Beall from a tract of land called Huntington, now in possession of John Abbington's heirs, and likewise from a tract of land called Fringship, now in possession of the family of Stodderts, from this time and forever hereafter, then the afd bond to be void.       Abbington's Ex'rs vs William Cawood. D't. 1408. Henry Darnall Sect' for Costs. Judgment by Non Sum.
      William Cawood, late of CC, planter, was summoned to answer unto Andrew Scot and Mary, his wife, Executors of the Will of John Abbington, late of Prince Georges County, Gent, decd, of a plea that he render unto them 1408 lbs of good, sound merchantable leaf tobacco in cask, convenient in Prince Georges County or CC to some landing place on the river Potomack, which from them he unjustly detains. And whereupon the sd Andrew and Mary, his wife, Ex'rs afd, by Henry Darnall, their atty, say that whereas the sd William, on Aug 17, 1738, at CC, by his Bill Obligatory, did bind himself to pay unto the sd John Abbington of Prince Georges County, Gent, 1408 lbs of tobacco in cask convenient in Prince Georges County or CC to some landing place on the river Potomack by Oct 10 next ensuing the date of sd Bill Obligatory. Yet the afd William, although requested by sd John Abbington in his lifetime, to wit, the afd Oct 10 in the year afd at CC, and by the sd Andrew and Mary, his wife, after the death of the sd John, has not paid sd sum, to the damage of the sd Andrew and Mary, Ex'rs afd, 2000 lbs of tobacco, and therefore they bring suit. And the sd Andrew and Mary, his wife, Ex'rs, bring here into Court the Letters Testamentary of the afd John to show that they are the Ex'rs of the Will of the afd John and have the administration thereof.
      And the afd William, by Samuel Young, his atty, comes and prays licence to imparl until next Jun CC Court, at which Court, sd William, by his atty, prays further licence to imparl until next Aug CC Court, at which Court, sd William, by his atty, prays further licence to imparl until next Nov CC Court, at which Court, sd William, by his atty, prays further licence to imparl until next Mar CC Court. And now here, sd Andrew and Mary, by their atty, prays that the sd William to his declaration against them may answer, and the sd Samuel Young, atty of the sd William, says that he is not informed by his client of any answer for the sd William to the sd Andrew and Mary, his wife, Ex'rs afd in the plea afd for him to be given, and nothing other thereof does he say.
      Ordered that sd Andrew and Mary do recover against sd William, his debt by occasion of the premises, to 1408 lbs of tobacco, and 302 lbs of tobacco for costs and charges.
