      IN THE NAME OF GOD Amen, I ELIZABETH FOOTMAN of Parish of Copley and County of Westmoreland being very sick and weake of body but of perfect mind and disposing memory, thanks be given unto God for the same, do constitute make and ordain this writing to be my Last Will and Testament, revoking all other former Wills by me made either verbal or written and do ordain this to be my Last Will and no other; And first of all I bequeath my Soul into the hands of God that gave it with a Christian hope of Salvation thro: the merrits of Christ Jesus my Saviour, and I will that my body be decently interred at the discretion of my Executors hereafter named; And as touching such worldly Estate as it hath pleased God to bless and endow me with in this life, I give devise and dispose of after the following manner. I will that all my just and lawful debts be paid.
      Item. I give and bequeath unto my Daughter, FRANCES YOUELL, all my Cloths and wearing apparel of every kind andnature also my riding horse and saddle, also my Great Looking Glass, and my Desk that stands in the Hall and it is my will and desire that neither the Cloaths, Horse, Saddle, Glass nor Desk shall be appraised, but delivered to my Daughter without.
      Item. I give and bequeath unto my Grandaughter. ELIZABETH YOUELL, my Negro man named Prince that was given to me by the Last Will and Testament of my Husband, JOHN FOOTMAN, deceased. and it is my will and desire that my Son in Law, BATTERAW YOUELL, should have the use of the said Negroe and be accountable unto the aforesaid ELIZABETH YOUELL for the worth of him when she either marries or comes of age;
      Item. I give and bequeath unto my Grandaughter, ELIZABETH YOUELL, one of my Gold Rings and my Gold boles and Silver tumbler and two Silver spoons and the feather bed and furniture that I lie in myself;
      Item. I give and bequeath unto WILLIAM RICE, SENIOR, three barrells of Indian Corn. It is my will and desire that the remainder of my Estate be equally divided amongst my three Children.
      Lastly, I nominate ordain and appoint my two Sons, WINDOR KENNER, RICHARD KENNER and my Son in Law, BATTRAW YOUELL, whole and sole Exors. of this my Last Will and Testament; In Witness whereof I have hereunto set my hand and seal this 10th day of May 1744

      THIS INDENTURE made this 8th day of June in the year 1749 Between JAMES MAXWELL & RACHELL his Wife of the Parish of Washington in the County of WESTMORELAND of one part and BERTRAND EWELL of the Parish of Dettingen in Prince William of the other part Witnesseth that the said JAMES MAXWELL &RACHELL his Wife for the sum of Seventy pounds Sterling money of England have granted unto the said BERTRAND EWELL in his actual possession now being by virtue of an Indenture of Bargain and Sale for one whole year & by force of the statute for transferring uses into possession and to his heirs assigns two certain parcells of land containing in both pieces Two hundred and Sixty one acres the first parcel! being on the South side of OCCOQUAN RIVER. in the Parish of Hamilton in County of Prince William containing One hundred and Eighty acres which said peice of land was granted to RICHARD CRUPPER from the PROPRIETORS OFFICE by PATENT bearing date the Twenty Eighth day of February one thousand seven hundred & twenty Eight Nine and by the said RICHD, CRUPPER sold to JAMES MAXWELL party to these presents by Deeds of Lease &Release bearing date the thirteenth fourteenth days of August 1740 as by the said PATENT & Deeds may appear & Is bounded Beginning at a forked red Oak standing on a hill side on the said River extending thence So Et to a small Hiccory thence So. Wt to a Box Oak thence No West to a red Oak thence No Wt to a white Oak on a hill side near the said River thence down the said River No Et to the beginning. the other parcell of land containing Eighty acres & Joyns the lower side of the above tract & so down OCCOQUAN to the Land of Collo FITZHUGHs thence with his lines to a box Oak Corner of the above tract & being part of a PATTENT granted to JOHN WARNER for Four hundred &Fifty acres of land bearing date the 19th day of March 1729 & was by the said JOHN WARNER sold to RICHARD CRUPPER by Deeds bearing date the 25th Augt, 1740 & was by the said RICHD.       Know all Men by these Presents, that We Bertrand Ewell, Lynaugh Helm, William Ashmore, Darby Gallahue and John Peyton are held and firmly bound to Henry Lee, Wm. Blackwell, James Scott, Howson Hooe and George Brett, Gent. Justices of the Court of Prince William County, now sitting, in the sum of one thousand pounds, To the Payment whereof well and truly to be made to the said Justices, and their Successors, we bind ourselves, and each of us, our and each of our Heirs, Executors and Administrators, jointly and severally, firmly by these Presents. Sealed with our Seals, this twenty fourth day of May in the Year of our Lord One Thousand Seven Hundred and fifty six and in the XXIX Year of the Reign of our Sovereign Lord GEORGE, the Second. The Condition of this Obligation is such, That if the above bound Bertrand Ewell administrator of the Goods, Chattels, and Credits of Humphrey Pope deceased, do make, or cause to be made, a true and perfect Inventory of all and singular the Goods, Chattels, and Credits of the said Deceased, which have, or shall come to the Hands, Possession, or Knowledge of him the said Bertrand Ewell or into the Hands and Possession of any other Person or Persons for him and the same so made, do exhibit or cause to be exhibited into the County Court of Prince William as such Time as he shall be thereunto required by the said Court, and the same Goods, Chattels, and Credits, and all other the Goods, Chattels, and Credits of the said Deceased, at the Time of his Death which at any Time after, shall come to the Hands, or Possession of the said Bertrand Ewell or into the Hands, or Possession of any other Person or Persons for him do well and truly administer according to Law: And further do make a just and true Account of his Actings and Doings therein, when thereto required by the said Court, and all the Rest and Residue of the said Goods, Chattels, and Credits, which shall be found remaining upon the said Administrators Account, the same being first examined and allowed by the Justices of the Court for the Time being, shall deliver and pay unto such Person or Persons respectively; as the said Justices by their Order or Judgment shall direct, pursuant to the Laws in that Case made and provided and if it shall hereafter appear, that any Last Will and Testament was made by the said Deceased, and the Executor or Executors therein named, do exhibit the same into the said Court, making Request to have it allowed and approved accordingly, if the said Bertrand Ewell being thereunto required, do render and deliver up his Letters of Administration, Approbation of such Testament being first had and made in the said Court: Then this Obligation to be void and of none Effect, or else to remain in full Force and Virtue.

      Dec. 1774 - Bertrand Ewell and Jesse Ewell, both of Prince William Co., lease to Leonard Milstead of Prince William Co., Va., Ann Milstead his wife, and Cornelius Milstead his son, during the longest liver of them all, for the yearly sum of 6 pounds current money of Virginia on the 1st day of January 1778 and the same every year thereafter, together with the Quit rents of said land, that parcel of land containing 150 acres, beginning at the Fork of the Warehouse Roads at a red oak extending No.E. to a hickory in the Line of Cornelius Kincheloe's land and the head of a Bottom, thence down the said Bottom to a branch and with the meanders thereof to the Coal Pitt Branch, thence down the same the several meanders to a marked poplar on the West side thereof, thence So.Wt. to a forked pine on the Main Road to Quantico Warehouses, thence up the said Road the several meanders to the beginning, with liberty to have 2 plantations on the aforesaid premises, together with all houses, buildings, orchards and appurtenances belonging.       Jan. 1777 - Bertrand Ewell and Jesse Ewell of Prince William Co., lease to Joseph Stephens of Prince William Co., his wife Mary Stephens, and his son William Stephens, for the life of the longest liver of them, for the yearly sum of 4 pounds current money of Virginia, 100 acres, the bounds of which adjoin the land of Cornelius Kincheloe and a corner of the land leased to Leonard Milstead and James Pilcher.

      THIS INDENTURE made the Seventh day of May one thousand seven hundred and Sixty one Between BERTRAND EWELL of the County of Prince William of one part and EDMOND JENNINGS of the said County of other part Witnesseth that said BERTRAND EWELL for the yearly rents and Covenants on the part of the said EDMOND JENNINGS to be paid and performed hath granted to Farm lett unto said EDMOND JENNINGS all that parcel of land containing one hundred acres in the County of Prince William and Parish of Dettingen joyning the lands of Mrs. MARGARET YOUNG, Mr. ALLAN MACRAE, the lands leased to JOHN LATTIMORE and the BEAVERDAM RUN including the houses and Plantation with leave to get any Timber or firewood for the Plantations use of any other the said EWELLs lands not leased out. To Have and To Hold the said land to the said EDMOND JENNINGS during the natural lives of said EDMOND JENNINGS and his Wife CATHERINE and for the life of the longest liver of them paying yearly Five hundred pounds of tobacco and Cask with the quitrents and taxes of the said land on or upon the first day of January every year and if it be unpaid upon the first day of February then it shall be lawfull for said BERTRAND EWELL to reenter and have again and the said EDMOND JENNINGS his heirs and assigns shall not committ any waste upon the premises nor sell any of the wood In Witness whereof the parties have set their hands and seals

      THIS INDENTURE made this twenty eighth day of May in the year of our Lord one thousand seven hundred and Fifty and in the twenty third year of the reign of our Sovereign Lord GEORGE the second Between JOHN CARR of the County of Prince William & Parish of Detingen of one part and BERTRAND EWELL of the County & Parish aforesaid of other part Witnesseth that sd JOHN CARR for the sum of Thirty pounds Virginia Currancy do sell unto said BERTRAND EWELL his heirs & assigns a par- cell of land containing Fifty acres bounded beginning in the line of Mr. JOHN GRAHAM on the Run nigh JOHN CARRs house and in the MAIN ROAD running from thence up the several meanders of the sd Run the Weadth of ye sd CARRs land to a marked line then with that line crossing the WAREHOUSE ROAD to a Branch that runs nigh the WAREHOUSES then with that Branch the several meanders to Mr.JOHN GRAHAMs line then with his line to the Beginning including the Plantation where the sd BERTRAND EWELL now lives To Have and To Hold the said parcell of land & premises unto ye sd BERTRAND EWELL his heirs & assigns forever without the Lawfull hindreance of the said JOHN CARR or of any other person whatsoever (except COLO. EWELL Deced of ye Colony of Virginia of other part Witnesseth that the said RALPH FALKNER, EDWARD NEALE & JOHN TRIPLET for the sum of Six hundred pounds Virginia Currancy paid by the said BERTRAND EWELL & ye heirs of CHAS. EWELL deced have sold and confirm unto the said BERTRAND EWELL & the heirs of CHAS. EWELL deced in their actual possession by virtue of a bargain & sale for one year and by force of the statute for transferring uses into possession and to their heirs forecer all those four tracts of land containing Two thousand acres being in the Parish of Dettin gen and County of Prince William on the OCCOQUAN RIVER one tract was bought of MR. CARTER, one track of MR. GREGG, one track of COLO. FITZHUGH and one track taken up by the sd Compa. relation being had to ye sd purchases of tracks of land will appear and all houses Forges, Mills, Damms and appurtenances whatsoever belonging To Have and To Hold unto the said BERTRAND EWELL his heirs and assigns forever and unto the Heirs of CHAS. EWELL their heirs & assigns forever and the said RALPH FALKNER, EDWARD NEALE & JOHN TRIPLETT for themselves agree with said BERTRAND EWELL & with the heirs of CHAS. EWELL deced that they now are the true and lawful' & rightfull owners of Three fourths of all the said lands Forges Mills Hereditaments above mentioned and that they path power to sell three fourths of sd lands foreges mills and premises unto ye sd BERTRAND EWELL his heirs & assigns and unto the heirs of CHARLES EWELL deced & their heirs & assigns two fourth of the said lands forges mills unto BERTRAND EWELL and one fourth unto the heirs of CHARLES EWELL deced forever which is in exchange with EDWARD NEALE for one fourth of the LANCASHIRE FURNACE in BALTIMORE COUNTY in MARYLAND and with one fourth of ye said OCCOQUAN lands, forges Mills & other the premises in Virginia which belonged to the said CHARLES EWELL deced as by articles acknowledged in Prince William County Court and PARTNERSHIP with the sd Compa, makes the heirs of CHAS. EWELL deced and their heirs hold forever one half of ye said lands Forges & mills & other premises and by a purchase of Cash paid BERTRAND EWELL & his heirs To Hold the other half of ye sd lands Forges & Mills & other the premises are equally to be held by BERTRAND EWELL & his heirs & the heirs of CHAS.       KNOW ALL MEN by these presents that we BERTRAND EWELL of Prince William 320 County, SOLOMON EWELL of LANCASTER COUNTY in the Colony of Virginia Gentlemen and JAMES CRAIK of CHARLES COUNTY in the Province of MARYLAND Surgeon are bound unto JOHN SEMPLE of CHARLES COUNTY in the Province of MARYLAND Merchant in the just sum of Ten thousand pounds Current money of Virginia this Eighth day of April in the year one thousand seven hudnred and Sixty Three
      WHEREAS JESSE EWELL and JAMES EWELL Sons of CHARLES EWELL deced have for the sum of Two thousand Four hundred pounds Virginia Current money sold unto JOHN SEMPLE all their right whatsoever that they have unto all and every Forge and Forges Saw & Grist Mill or Mills on the Waters of OCCOQUAN RIVER in the County of Prince William together with all their right to the following parcels of land to wit that parcel of land which was purchased of JOHN GREGG & conveyed by ELIZABETH GREGG the Widow & Relict of said JOHN GREGG containing One thousand and Seventy acres and that other tract in the same County purchased of JAMES CARTER containing Two hundred acres. that other tract in the same County containing fifty acres purchased of WILLIAM FITZHUGH and that tract of land in the County of Prince William purchased of COLO. WILLIAM FITZHUGH containing One thousand acres and also that other tract of land formerly taken up by CHARLES EWELL as Waste and confirmed to him by Deed containing Two hundred and Twelve acres Together with the Slaves called Joe, Harry, Georg, Chaise. Ben and Kitt and all the Waggons Carts Stocks of Horses Cattle & tools & implements and every other article whatsoever which was rented unto JOHN BALLENDINE by BERTRAND EWELL for himself and as Executor to his Brother CHARLES EWELL Deceased by Articles of Agreement bearing date the third day of February one thousand seven hundred and fifty five and hath put said JOHN SEMPLE into the immediate possession but for as much as the said JESSE EWELL and JAMES EWELL are by reason of their tender age incapable at this time to convey the above lands etc. the above BERTRAND EWELL, SOLOMON EWELL & JAMES CRAIL have become bound that so soon as the said JESSE & JAMES EWELL arive to full age they shall in due form of Law convey the said lands etc. unto the said JOHN SEMPLE and untill such conveyances executed permit said JOHN SEMPLE his heirs to use the above lands etc, that then the above obligation to be void otherwise to remain in full force
