      THIS INDENTURE made the twenty second day of June in the year of our Lord one thousand seven hundred and forty one Between THOMAS HARRISON of the County of Prince William gent of the one part and WILLIAM HENRY TERRETT of the said County gent & MARGARET his Wife of the other part WHEREAS the said THOMAS HARRISON by Deeds of Lease and Release bearing date respectively the tenth and Eleventh days of March in the year of our Lord one thousand seven hundred and Eighteen did grant unto SIMON PEARSON late of the County of STAFFORD gent Deced (Father of the said MARGARET) & to his heirs forever all the title & demand of him the said THOS. HARRISON to all that tract or parcels of land containing two hundred Eighty & nine acres & one half of an acre each of them lying and being then in the Parish of Overwharton in the County of STAFFORD (but since the Division of the said County of STAFFORD lying in the Parish of Truro in the County of Prince William) being the equal moieties or halves of two eighth parts of a greater tract of land containing four thousand six hundred and thirty nine acres granted to JOHN WEST, WILLIAM HARRISON, THOMAS PEARSON & the said THOMAS HARRISON scituate lying and being on the Main Run of GREAT HUNTING CREEK as by PATENT bearing date the twenty third day of December in the year one thousand seven hundred and Six & divided into eight parts by RICHARD WATTS of WESTMORELAND COUNTY on the twenty Second day of March one thousand seven hundred and fourteen as by the several plats drawn by him may appear both which eighth parts as aforesaid whereof those two tracts & parcels of land thereby sold & confirmed by the said THOMAS HARRISON to the said SIMON PEARSON & his heirs forever as aforesaid the equal! moieties & halves are bounded as followeth Vizt. one Eighth part begining at a white Oak standing on the INDIAN BRANCH the end of the Seventeenth Course of the aforesaid PATENT extending thence North West to the line of FITZHUGHs Great Tract of land thence on the said Line North to an Oak thence North East to an Oak thence South East to a white Oak thence South West to the INDIAN BRANCH where the begining is, the other eighth part begining at a marked Gum tree standing at the end of the twenty second Course of the said PATENT thence North West to a Hickory standing on the main North Branch of GREAT HUNTING CREEK run thence South East to a black Oak tree thence South East to a red Oak thence South East to the begining Gum with all rights to the said premises as by the said Deeds of Lease and Release may fully appear & WHEREAS the said SIMON PEARSON Deced by his Last Will &TESTAMENT in Writing among other things did give unto the said MARGARET his Daughter & the heirs of her body the moiety of the first abovementioned Eighth part with divers remainders over & Whereas HENRY FITZHUGH Esqr, by a late Survey of the great Tract of land abovementioned adjoining upon the said first above mentioned Eighth part path taken in & included a great part of the said first abovementioned Eighth part within the bounds of the said Tract of Land whereupon Differences have arisin between the said WILLIAM HENRY TERRETT & the said THOMAS HARRISON touching the Construction of the said THOMAS HARRISONs Deeds to the said SIMON PEARSON & whether the said THOMAS HARRISON was by the Covenants in the said Deed of Release contained oblidged to make good and warrant unto the said SIMON PEARSON his heirs the full Quantity of two hundred Eighty nine acres & an half of land or the said SIMON PEARSON his heirs were only entitled to an equal moiety of the said first abovementioned Lot or eighths part of land whether the same contained more or less for Determining which differences the said WILLIAM HENRY TERRETT & THOMAS HARRISON agreed to abide & perform the award order and arbitrement of ZACHARY LEWIS, MOSELEY BATTALEY & JOHN MERCER gent or any two of them concerning the said premises & Whereas the said ZACHARY LEWIS and MOSELEY BATTALEY made and published their award in Writing under their hands and Seals bearing date the twelfth day of November one thouand seven hundred and forty of and concerning the said premises in the words following: "To all People to whom this present Writing of Award shall come ZACHARY LEWIS & MOSELEY BATTALEY gent of SPOTSYLVANIA COUNTY Arbitrators indifferently chosen Elected & Named by and between THOMAS HARRISON & WILLIAM HENRY TERRETT both of the County of Prince William Gent to arbitrate & Determine of for upon & concerning a certain matter in Controversy and Debate between said THOMAS HARRISON & WILLIAM HENRY TERRETT relating to a certain parcel or Dividend of land being in the County of Prince William aforesaid on the Branches of GREAT HUNTING CREEK begining at a white Oak standing in the INDIAN BRANCH the end of the seventeenth Course of a PATENT containing four thousand six hundred thirty nine acres granted to JOHN WEST, WILLIAM HARRISON, THOMAS PEARSON & the said THOMAS HARRISON extending thence Now to the line of FITZHUGHs great Tract of land thence on the said Line No, E. to an Oak tree thence No. E. to an Oak thence So, E, to a white Oak thence So, W. to the INDIAN BRANCH where the beginning is the same being one of the Lots sold by THOMAS HARRISON to SIMON PEARSON late of STAFFORD COUNTY Gent deced described in Deeds of Lease and Release bearing date the Tenth and Eleventh days of March in the year 1718 made between said THOMAS HARRISON by the Name of THOMAS HARRISON of the Parish of Overwharton & County of STAFFORD of the one part & SIMON PEARSON of the said Parish & County of other part & Whereas the aforesaid WILLIAM HENRY TERRETT hath a title to two hundred and Eighty nine & an half acres of land being a moiety of the aforementioned Lot of Land having intermarried with MARGARET one of the Daughters and Devisees of the aforesaid SIMON PEARSON Now Know ye that we the said Arbitrators having taken upon us the charges of the said Award and willing to set the said parties at peace by making a final End and determination concerning the premises in Controversy & having heard and Examined their proofs & allegations do declare this our award concerning the same in manner following first we do Award what remains of the said Lot of Land untaken away by a Survey lately made by HENRY FITZHUGH Esqr. if the same do not exceed Two hundred Eighty nine acres and an half being one moiety of the Land to the benefit of said WILLIAM HENRY TERRETT & MARGARET his Wife and issue of said MARGARET pursuant to the last Will of the said SIMON PEARSON Deced finally we do determine that said THOMAS HARRISON his heirs shall be free from any suit whereby to compel him or them to make an Satisfaction for what land in the said Lot shall be wanting to make up the quantity of two hundred eighty nine and an half acres of land and if it shall be found upon a just Survey of said land that there is above the quantity of two hundred eighty nine acres and an half of land remaining untaken away that such overplus shall be to the use of the said THOMAS HARRISON and his heirs, In Witness we the Arbitrators have put our hands & Seals this twelfth day of November 1740. Now This Indenture Witnesseth that said THOMAS HARRISON for the performance of the said Award hath granted unto said WILLIAM HENRY TERRETT & MARGARET his Wife & unto the heirs of the body of the said MARGARET under the Last Will & Testament of the said SIMON PEARSON deced Two hundred Eighty nine acres & an half of land with all and Singular the appurtenances & the said THOMAS HARRISON hath appointed JOHN MINOR of the said County of Prince William gent his true & Lawful! Attorney for him to enter and quiet possession and Seisin thereof for him and in his name to deliver unto the said WILLIAM HENRY TERRETT & MARGARET his Wife.
