      The Will of Thomas W. Gaines of Stokes County, NC.
      "In the name of God, Amen. I, Thomas Gaines of Stokes County and State of North Carolina, being in low state of health, but of sound mind and memory, do this day, being the eighth day of January and in the year of our Lord One Thousand Eight hundred and Eleven, do make, ordain and constitute this to be my last will and testament, in form and substance as follows, To wit:
      And first I recommend my soul to God, who gave it through Jesus Christ, Amen. And second, do leave my worldly estate in the following manner viz: -
      I give to my beloved wife, Susannah Gaines (in case she survives me) the whole of my estate, real and personal, during her natural life, or so much thereof as she shall choose for her support, if she shall make choice of the former mode, my desire is that my Executors, immediately after her death, prove to appoint three fit men in order to allot off my Estate as I shall hereafter describe, otherwise if she shall make choice of the latter mode that is, only a part of my Estate, my desire is that my Executors proceed without delay. So soon as such choice shall be made, to make the necessary arrangements agreeable to the mode already pointed out for dividing the balance of my estate in the following manner and
      first my will and desire is that my son, Phillip Gaines, have no part of my estate for the following reasons, I wish it understood that I have as much real love and affection for him as any of the rest of my children, but having at his first out done more for him then the others and as he has since told me that he was satisfied, without having part of my estate, real or personal.
      As it has been a long time since I have seen my son Richard Gaines, and as I know not whether he is dead or alive, my will and desire is that he shall have no part of my Estate either real or personal, but
      I give and bequeath to his daughter Louisa Gaines, one horse and saddle worth Eighty dollars and two hundred dollars in money:
      The balance of my estate I desire to be equally divided between my following children, to wit: James S. Gaines, Elizabeth Bohannon, William D. Gaines, Henry P. Gaines, Fanny Cardwell, Susannah Smith, George W. Gaines and Francis T. Gaines - except two hundred and fifty dollars, which I wish to be deducted out of Elizabeth Bohannon's part on account of a bargain which I gave Philemon Bohannon in a tract of land I sold him on Reedy Creek, and except one hundred dollars to be deducted out of Susannah Smith's figure.
      And further my will and desire is that such of my children as have been last mentioned which have not been fixed off with a bed and some other necessaries for house keeping shall be made up equal with the rest. Whenever my estate shall be laid off into lots, I wish my Executors to choose some person to draw in behalf of the legatees. My desire is that John Martin and Johnson Clements be my Executors to this my Last Will and Testament, to see the same executed according to its true intent and meaning."

      THIS INDENTURE made the 8th day of Decr 1770 Between WARNER WASHINGTON Gent and HANNAH his Wife of County of Frederick and in Colony of Virginia of one part and THOMAS GAINS of County of Culpeper and Colony Afd. Witnesseth that said Warner Washington and Hannah his Wife for sum of Fifty pounds Currency by these presents doth grant unto said Thomas Gains his heirs 600 acres of land in Culpeper County and Bromfield Parish in the Goard Vine fork of Rappahanock River and on the Branches of Blackwater Run the same being part of 3250 acres of land granted by the Right Honourable THOMAS LORD FAIRFAX Proprietor of the Northern Neck in Virginia to WILLIAM FAIRFAX Esqr. of Fairfax County and by said William Fairfax Esqr. was granted unto said Warner Washington and the said 600 acres of land is Bounded Begining at two white oaks a Corner made for DANIEL DELANY and runs thence N. to three chesnut oaks on a spur of the TAYLORS MOUNTAIN thence N. to a chesnut oak by a small branch thence to a pine and black oak marked WFX thence So. to three red oaks another Corner made for Daniel Delany thence with his line South to the Beginning . .

MYNN THURSTON & EDMOND TAYLOR of County of Frederick Gent Whereas Warner Washington Gent and Hannah his Wife have sold unto Thomas Gains the fee simple estate of 600 acres in County of Culpeper and said Hannah cannot conveniently travel to our said County Court of Culpeper to make acknowledgement of said conveyance We do give unto you power to receive the acknowledgement which said Hannah shall be willing to make whether she doth the same freely without his persuation and when you have received her acknowledgement and examined her that you openly Certify us thereof in our said Court. Witness JOHN JAMESON Clerk of our said Court at the Ct house the 8th day of Decr in the fourteenth year of our Reign.
      Fred, County Sct In Obedience to the Order & Commission within We Charles Mynn Thurston & Edmond Taylor did Persionly go to the within named Hannah Washington and Exd. her privily and apart from her husband touching her conveyance of land to Thomas Gains in County of Culpeper when she the said Hannah delcared she did acknowledge the same freely without threats of her husband and was willing same should be recorded in County Court of Culpeper. In Witness this 8th day of Decr 1773.

      This Indenture of Feofment was partly provd by oaths of John Strother and James Gains two of the witnesses thereto which was ordered to be Certified and at another Court held for the said County the 21 day of Octr: 1776 was fully proved by the oath of Edmond Taylor another witness and together with the Commission thereto annexed and Certificate thereon endorsed ordered to be recorded.

      THIS INDENTURE made the nineteenth day Feby 1776 Between WILLIAM KILBY of County of Culpeper of one part and THOMAS GAINS of County afsd Witnesseth that said William Kilby in consideration of sum Fifty pounds current money doth hereby grant unto said Thomas Gaines in his actual possession now being by force of Virtue of a certain Indenture of Lease of a parcel of land containing seventy two acres which was Willed to the said William Kilby by his Father JOHN KILBY being in County of Culpeper and bounded Begining at a red oak on the old line of a Deed granted to the Father of the said William Kilby by the Right Honourable the Proprietor of the Northern Neck and Corner to JOHN KILBY thence N. to a red oak in another of the Deed lines thence with that line N. to white oaks near a branch thence S. to three pines on a stoney ridge to the beginning and the reversion & reversions of every part thereof and all the Estate right of we the said William Kilby and FRANCES his Wife in the said land .

      THIS INDENTURE made this 15 June 1778 Between THOMAS GAINES and SUSANNA his Wife of County of Culpeper of one part and JACOB CRIM of County aforesaid Witnesseth that said Thomas Gaines and Susanna his Wife for sum one hundred and Forty pounds current money of Virginia do grant to said Jacob Crim his heirs forever two Tracts of land in County aforesaid which land was purchased by said Thomas Gaines of WILLIAM KILBY and FRANCES his Wife as by Deed 19th February 1776 and recorded in our said County Court containing seventy two acres and bounded begining at a red oak in the line of a Deed granted to the Father of said William Kilby by the Right Honourable LORD THOMAS FAIRFAX Proprietor of the Northern Neck and Corner to John Kilby thence North thence South to three pines on a Stony Ridge thence to the Begining the other Tract was purchased by the said Thomas Gaines from JOHN KILBY and AGATHY his Wife by Deed the 16th February 1777 containing seventy two acres and is bounded begining at a stake in an old Corner between said John Kilby and James Kilby thence North to two red oaks in line of the Pattent thence with that line North to a white oak corner Between said John Kilby and Thomas Gaines thence South seven degrees thirty minutes to the Begining to hold the two tracts of land containing together One hundred and forty four acres .

      [Page 17-18) James Gaines, Culpeper. £43.10 .3-1/2. due McCall, Smellie & Co. There were two persons of this name in Culpeper. One died in Culpeper in 1786 and left a very good estate but he never had any dealings with McCall, Smellie & Co., and was remarkably clear of debt, being a very honest man. He enumerated the few British debts which he owed shortly before his death and desired that they might be paid by his representatives. The other James Gaines removed to North Carolina in 1776 in very good circumstances and now lives in Tennessee on the Holston some small distance from the Block House. He is a member of the Senate in the Legislature of that state and is very able to pay his debts.

      [P . 19] Thomas Gaines, Culpeper. £4. 4.8, due Geo: McCall & Co . He was brother to the James Gaines mentioned in the latter part of the foregoing report and removed with him in 1776 . He now lives adjoining his brother James Gaines in Tennessee and is very able to pay his debts.
