I made a trip to Jackson Co. OH to dig and photograph the grave marker for Zephaniah.
Name is given as Zehpeniah Swan
      Died Jan. 6,1864
      Aged 83ys & 5ms
Burial: Bethel Church Crmetery- Jackson, Jackson Co. OH

**His wife Elizabeth Barrett Swann 1799-1880 (married 1821) is also buried there.

This means that Zephaniah (b.Aug. 1780) could not be a son of Zephaniah Swann b1740 as Thomas Coates Swann was born 3 months later in Nov. of 1780.

My theory is that this Zephaniah Swann was born to Zephaniah Swann I010906. We are waiting on YDNA results to come in that should also confirm this.

The 1803/4 probate records of Samuel Douglas mention Hezekiah, William, and Zephaniah (Jr) Swann in several places. This leads me to believeWilliam was the middle son (born about 1775) of Zephaniah Swann and Mary Hawker. The "naming convention" method also applies here. 1st son Hezekiah after paternal grandfather, 2nd son William after maternal grandfather, and 3rd son after the father himself.

Zephaniah (Jr) and William Swann were laborers in Brooke County (W) VA. in 1807. It is unclear exactly where they were living or working. But in May 1807 both were arrested for stealing horses. The case was handled in the District Court in nearby Monongalia Co. (W)VA. While Zephaniah's name is at the forefront in most of the records, both were found guilty after a trial. Zephaniah was sentenced to 5 years, and William 6 years, in the State Penn. at Richmond, VA. The last record of Zephaniah and William is from Sept. of 1807 when the jailor turned in his bill for guarding them. It appears that it was then that they were transferred to Richmond. The records of the State Penn are almost non-existent for the years of 1807 - 1813 by which time bothshould have been released.

"FHL #007616731 Court Records 1774-1875 West Virginia. Circuit Court (Monongalia County) Pg. 24 & 25; Zephaniah Swann (no age) of Brooke Co. (W)VA laborer, was found guilty of horse stealing and sentenced to 5 YEARS in the State Penitentiary. Monongalia CountyRecords, Box 17, District Court, May Term 1807."

" William Swann (no age) of Brooke Co. (W)VA laborer, was found guilty of horse stealing and sentenced to 6 YEARS in the State Penitentiary. Monongalia County Records, Box 17, District Court, May Term 1807."

The 1820 census of Jefferson Co. OH, which borders Brooke Co. WV., has Hezekiah and William listed. Zephaniah Jr. was not in the 1820 census but married Elizabeth Barrett in Jefferson Co. OH Nov. 1, 1821. So William and Zephaniah must have migrated back tothis area soon after their release from jail.
