      In then name of God Amen I John COCKERILLE Gent. Of the County of Northumberland being of sound & perfect Memory blefsed be God & knowing the fraility of mankind & the uncertainty of this tranxitory World doe make this my laft Will & Testament in Manner & form following -
      (Viz) Item I give & bequeath my Soul to Almighty God that Gave it truftign through the Merritts of my Saviour Christ Jefus to obtain pardon and forgiveness for all my sins and my body to ye eath from when it was made to be decently buried according to ye descretion of my exors instrucuft hereafter named & for that worldly estate it hath please almighty God to endow me with all after all my just debts & funirile expenses are fully sattiffied. I difpose as followeth: Item I give and bequeath unto my Dear & loving wife Hannah COCKERILL all that tract of land whereon I now live with all houfes and orchards woods underwood & all other priviledges thereunto belonging with all the Cattle Sheep hogs household stuffe & all debts that are juftly due unto me & all other things wfoever during her naturall life it is my defire & I after her deceafe all the afore- Goods and Chattles to difposed of as followeth & I doe make her my whole & sole exec. Of this my last Will & Testament Item it is my desife after my wifes deceafe yt my land be equally divided between my three sons John Cockarille Jun. Edward Cockarill & Richard Cockarill- Viz Two hundred acres thereof to Jno it being - of yt devident I now live on & begin at the lower end thereof & to extend yt whole breath of my land from Creek to Creek until the aforeff two hundred acres be comployed with all houfe & orchards & all privileges whatfo ever to him ye said John Cockarill Junr, his heirs & afsigns forever. Item it is my will and defire that my son Richard Cockerill have one hundred acres of land it being pt of the above specified tract & to have it laid out at the upper end of my land joining to the land of Jno Motley to the County decd & John Reafon & to extend it Se--- downwards the full breadth of my land until the aforesaid one hundred acred be complied with to have & to hold the said land with all houfes & orchards to him ye said Richard COCKARILL his heirs & afsigns forever. Item it is my will and defire that my son Edwd COCKARILL have all the refidue of my land with all appurtenances thereunto belonging to him and his heirs & afsigns forever item it is my will & desire that if any of my three sons dy without lawfule issue by them begotten then ye survivors to have his part equally divided between them & to have & to hold the same to them their heirs and Afsigns forever. Item it is alfoe my defire that all my housefhold stuff cattle sheep equally divided betwixt my three sons John Cockerille, Junr Edwd Cockarill and Richard Cockarill if it should pleafe God that any of my Said three Sons depart this life with out lawfull ifsue by them begotten that then their part of ye afore bequeathed estate on all be equally divided betwixt the survivrs to them their heirs & Afsigns forever & Laftly it is my will & dfire that my wife Hannah Cockarill be whole and Sole exor of this my laft will & Testament this will revoaking all former will made to the Contrary Witnefs my hand & seale the 30 Day of

      - Collo. BRERETON's Will proved Whereas Mr. THOMAS BRERETON did in Court this day produce the Will and Testament of Collo. THOMAS BRERETON his deceased Father, of which he prayed a Probate might be granted, THOMAS haveing seen and read the said Will and all of them knowing the hand writing of the said Collo THOMAS BRERETON and assured that the said Will was that of the deceased, though Mr. JOHN JENNY and Mr. PETER PLATT witnesses of the said Will are since the writing of the said Will dead, Mr. THOMAS HOBSON, SENR. upon his Oath declareing that when the said Collo. BRERETON had in his office before the said witnesses signed sealed and delivered the said Will he brought the said Will and Testament in his hands and shewing it to the said HOBSON told him that was his Last Will and Testament and asked his advice about it who then approveing of it sealed it up and gave it ye said HOBSON to keep who hath kept it by him until a little time before the said Collo's death when he called for it and said he would alter some things in it but dyed before he effected it. The Court doe therefore grant the said Mr. THOMAS BRERETON a Probate of his said deceased Father's Will according to Law

      At the August Session Continued August 19,1708
      Whereas MARY NUTT daughter to WILLIAM and MARY NUTT late of this County deceased by her Guardian EDWARD COLE brought her Bill in Chancery against JOHN HOWSON and RICHARD WRIGHT Executors of the Last Will and Testament of LEONARD HOWSON late of this said County deceased therein setting forth that MARY NUTT her late Mother deceased did before her Intermarriage with THOMAS BRERETON late of the said County deceased give her all that her the said MARY the Mother's part and proportion of household stuff (One bed and Furniture excepted and all other the Estate that was left her the said MARY by her then deceased husband WILLIAM NUTT or anyways given her by the Last Will and Testament of her said deceased husband which said Goods was [sic] during her Intermarriage with the said BRERETON kept apart from the said BR ERETON's Estate for the Use of the said MARY the Daughter and further that after the decease of the said THOMAS BRERETON the said MARY the Mother again Intermarried with the said LEONARD HOWsoN whereby me said goods Came into his Custody and possession during which Intermarriage the said MARY the Mother Died and Shortly after the said LEONARD HOWSON also deceased Leaving the aforesaid Defendants his Executors by means whereof the said Goods belonging to the said MARY the daughter fell into their possession who intending to defraud the said MARY the daughter pretended and gave out that never any goods of the said MARY the Daughter ever came to their hands or possession for which she prayed Process of Subpoena to be Granted her etc. [continued]
      And the said Defendants now Appearing for Answer to the said Bill say that before the said MARY the Mother Married with the said BRERETON the said BRERETON Did Oblige himself in the Sum of One hundred pcunds Sterling to One THOMAS HOBSON that he the said BRERETON should after his Marriage with the said MARY the Mother at her request make such Instrument in Writing to the said HOBSON or any other whom the said MARY should appoint as should Convey and make Over unto the said MARY the Daughter One Negro woman named BESS and her Increase and all that part or proportion of household stuff (one bed Excepted etc.) to be solely wholly and properly the Right Title and Estate of the said MARY the Daughter All which Estate the Defendants do not deny but that the same is Come into their hands and possession as the right and proper Estate of the said LEONARD HOWSON because the said MARY the Mother never made and such Gift to her daughter nor did she ever request or require any One to demand any such Instrument in Writing of the said BRERETON to Convey and make over the said Goods to the said MARY the Daughter whereby it appeared that after her Intermarriage with the said BRERETON she never intended any advantage to her said Daughter by means of the said Obligation but The said Estate as she had Right to do did detain and keep and do further say that in their own Right and for their said Testator they Lawfully and Rightfully hold the same Without etc. Upon hearing of which whole matter and weighing tho same the Court do Consider and Order and Decree that the said JOHN HOWSON and RICHARD WRIGHT Executors as aforesaid Do forthwith deliver up unto the said EDWARD COLE Guardian as aforesaid for the Use of the said MARY the Daughter All such Goods and Estate belonging to the said MARY the Daughter which was given her by her late Mother deceased as also all other of her Estate as is come to their hands Custody or possession or any other person Else for them together with Costs of Suit alias Execution
