Commissioners appointed: Henry Hawkins, John Adams, William Middleton, and John Thomas, Gent (not being any way related to the Petitioner, contiguous Proprietor, nor interested in the sd land). Whereas Jona: Davies Sr and Allen Davies, seized of Nuthalls Branch, lying in CC, on Mar 17, petitioned to CC Court, before Robt. Hanson, Gent, and his associates, CC Justices, for Commission to examine witnesses to prove and perpetuate the memory of the bounds of sd tract of land.
      And now here, Wm. Middleton & Jno Thomas return to Court here the Commission afd with the following certificate and depositions: we certify that we took the examination of all such witnesses as came before us relating to the bounds of the land mentioned in sd Commission. The deposition of Colo: Robt: Hanson, age about 58, who says that in the year 1725, he resurveyed a tract of land called Nutwells Branch, for Charles Craycroft, and that he believes the bounded white oak by which he now stands, to be the beginning tree of the afd land. The deposition of Charles Craycroft, age about 38, who says that the bounded white oak by which he now stands is the beginning tree mentioned in Colo: Hanson's Deposition, and is the 1st beginning tree of the land which this deponent sold to Jana: Davies Sr and Allen Davies, by the name of Nuthalls Branch. The deposition of Peter Hoggins, age about 44, who says that the white oak mentioned in the other depositions, that he now stands by, he believes to be the beginning tree of Nuthalls Branch and the beginning boundary of a tract of land Charles Craycroft sold to Jona: Davies Sr and Allen Davies, and that this deponent carried the chain to lay the afd land out, and that Charles Craycroft was present at the same time. The deposition of Geo: Walls, age about 76, who declares that a white oak by which he now stands was shown to him by Thomas Lawson about 40 years ago, to be a bounded tree of a tract of land whereon James Bigger then lived on, and is now in the possession of Jona: Davies Sr, and the sd tree stands near the bounded tree mentioned in Colo: Robert Hanson's deposition.       Apr 21, 1738. The deposition of William Carter, aged about 79, who says that about 50 years ago, he saw a bounded white oak standing in a branch near the place where he now stands and near the tree mentioned in Geo: Walls' deposition. Signed - William (F his mark) Carter.

      Apr 21, 1738. The deposition of Philip Willoce, age about 73, who says that near the place where he now stands, he heard Elias Nuthall tell Mr. Ignat: Craycroft that there or thereabouts stood a bounded tree of his Brothers Land, which sd tree stands near the place mentioned in Walls' and Carter's depositions.       The deposition of Jona: Davies Jr, age about 34, who says that he was present when Charles Craycroft bound a chestnut tree by which he now stands for the 1st bound tree of a parcel of land containing 70 acres whereon Allen Davies now lives, which the sd Craycroft sold to Allen Davies for and in consideration of 100 acres of land, part of a tract of land called Aliens Addition, and a crown paid in hand at the sd bound tree. Robt: Hanson, age about 58, who says that in the year 1724, he surveyed and laid out for Allen Davies, a tract of land called Aliens Grove, and that he began the sd survey from a bounded white oak standing at the head of a small valley on the east side of the Cabin Branch, and that a bounded white oak where he now stands is in such a place and on such grounds as before described. The deposition of Charles Craycroft, age about 38, who says that about 6 years ago, he was walking in the woods with Allen Davies, and they came to a bounded white oak by which he now'stands, and is the oak mentioned in Colo: Hanson's deposition, which sd Davies told this deponent was the bound tree upon which the chief of his land depended. The deposition of Jana: Davies Jr, age about 34, who says that at the original taking up of a tract of land called Allens Grove, he saw the bounded white oak mentioned in the afd depositions, bounded for the beginning tree of Aliens Grove, surveyed by Colo: Robt.       Jun 11, 1739. The deposition of Saml Johnson, age about 46, who says that about 9 years ago, George Dement told him that at the place where he now stands, stood a bounded poplar which Wm Dement told him[,] the sd George Dement, was the beginning tree of a tract of land that John Burch then lived on, and that since this deponent was told that the sd land was called the two Friends.       The deposition of John Posten Sr, age about 61, who says that about 36 years ago, John Dosson & Geo: Demen[t] showed this deponent a beech tree by which he now stands, and told sd deponent that this was the 2nd bound tree of a tract of land called the two Friends, and that Nath'l Button told them so and showed them the tree afd.       The deposition of John Anderson, age about 62 years, who declares that about 10 years ago, that John Burch told him that this Spanish oak where he now stands was a bound tree and a dividing tree between a tract of land called the two Friends and a tract of land called Edenborough and has seen Edenborough run out, and that they began at the sd dead Spanish oak for the beginning tree of the sd Edenborough.

      Charles Stuart vs Allen Davies & Sarah, his wife, Executrix of John Parker. TrCa: - Judgm:t per Confession.
      Allen Davies and Sarah, his wife, Executrix of the Will of John Parker, late of CC, planter, decd, was attached to answer unto Charles Stuart of a plea of trespass upon the case. Thereupon sd Charles Stuart, by Thomas Clark, his atty, complains that whereas the afd John Parker, in his lifetime, to wit, Jul 26, 1739, at CC, owed sd Charles 944 lbs of tobacco, being for sundry medicines and attendance as a physician by the sd Charles to the sd John at his special instance & request there before then administered, as per the account below, John promised to pay Charles sd 944 lbs of tobacco, but John, in his lifetime, or Sarah, since his death, or sd Allen and Sarah since their espousals, have not paid, to the damage of sd Charles, 1888 lbs of tobacco, and therefore suit is brought.

      Jul 21, 1739. Pulv Cordial, gutt ansidd, Sp: Volat: Antihystor, mixd bals, Iter & Phlebotam, Elect: Balsam, Iter 100, Rept. pulv, mixt febrifug, iter 100, Rept: Elect: suet: quant. Total: 944 lbs of tobacco.
      May 11, 1741. Then came Charles Stuart and made oath that the above account is true and that he has not received any part thereof, nor any security or satisfaction for the same. Sworn before JWilson.
      And the afd Allen and Sarah, into Court here in their proper persons come, and say that they cannot gainsay the action afd of the sd Charles, nor but that sd John, in his lifetime, did assume upon himself as charged. Ordered that sd Charles do recover against sd Allen & Sarah, his damages to 944 lbs of tobacco and 291 lbs of tobacco for his costs and charges.

      Allen Davies and John Estep return to the Court here the following certificate, viz - We certify to the CC Justices that we have viewed the way set forth in the within petition, and find it to be about a mile from the head of the Cr within named to Willsons Landing, and that it will be very convenient and of great service to the petitioners to have a road cleared to the sd Landing, and little or no prejudice to the neighbors, for it goes close by the sd Cr and will require but a small bridge to be made. Whereas a marriage is intended shortly to be solemnized between sd Allen Davis and Margarett Perrie, upon the contract of which marriage, in case the same shall take effect, sd Allen Davis has agreed, if Allen Davis dies before his sd future spouse, then all her hereditable and moveable estate whereof she now stands possessed shall not be liable for the payment of sd Allen Davies debts, nor be any manner of way in the despoils of the sd Allen Davis, in consideration of which, sd Margarett Perry hereby quits claim to all manner of dower thirds or any benefits or advantage that might fall to her from the estate of the sd Allen Davis by or through the sd intended marriage. If Margarett Perry dies before Allen Davis, then half of Margarett's moveable estate shall fall to sd Allen Davies. Whereas sd Charles Somersit Smith was, at the time of his death, seized in his demesne as of a fee, of all that tract of land in CC on Benedict Manor, adjoining to Patuxent River, which the sd Charles Sommersit Smith (father of the sd Charles Somersit Smith, party to these presents) devised by his will to his sd two sons, Richard Smith, decd, and the sd Charles Somersit smith, now this deed witnesses that sd Charles Somersit Smith assigns to sd Allen Davies and Margarett, his wife, the third part of the afd tract of land, which sd third part is bounded by a branch that divides George Maxwell's land from the land of Charles Somersit Smith afd, thence to Robert Anderson's land, then with sd Anderson's land to the Main Road by a gate, then down sd Main Road to the head of the Spring branch by the dwelling house, then down the afd Main Road that leads to Benedict Town, then to the Bridge by the Mill Swamp, then down and with the Ditch to the Marsh at the head of St. Nicholas Cr, then down sd Cr to Patuxent River, Swansons Cr. Excepted is the wood that is on a small island nigh Frazers Point.
