John Billingsley Sr's Will.
Feb 8, 1785. I, John Billingsley Sr of CC, am sick and weak of body, but of perfect mind and memory.
To my son Hezekiah Billingsley - a tract of land called Whitsun Monday, containing, by patent, 178 acres in CC.
As to personal estate, I have given him his equal proportion before. He must build, on land specified by my executors, a 16 foot clapboard house, for either my daughter, Mary Magruder, or either of my youngest sons, in case they should choose to live separate.
To my son John Billingsley - 150 acres of land where he now lives, to be laid off as it may suit him. Also 1 Negro fellow named Frank, 2 heifers, and 1 bull. Also 4 shoats and 4 pigs.
To my sons James Billingsley & Clement Billingsley - the rest of my land, to be equally divided between them, if they find my daughter Mary Magruder a house and home during her life.
My 3 sons, John, James, & Clement are to have the use of my Manured Tobacco land where I now live, for 5 years. I want my sons James & Clement to find my daughter Mary Magruder (out of the land bequeathed to them) a sufficiency of land for her to tend during her life, unless Mary's husband returns, or unless he returns but leaves her in distress as he has now done.
To my son James - a Negro fellow called Moses, a Negro girl called Amey, and 1 sorrel horse colt and 3 heifers, 1 bed and furniture.
To my son Clement - a Negro woman named Agness & a Negro boy named George. Also 1 bed and furniture and 1 young mare called his mare.
To Mary Weston - 1 cow & calf and 1 bed & furniture.
To my son Clement & daughter Mary Magruder - the rest of my cattle, to be equally divided between them.
To my daughter Mary Magruder - the 5 following Negroes, viz, Abbey, Ally, Henney, Maribrough, and Wat, during her natural life, and after her death, I give sd 5 Negroes and their increase (if any) to my grandson, George Alexander Magruder, and if my sd grandson should die without issue lawfully begotten of his body, then give the afd Negroes to my sons, James & Clement, to be equally divided between them. I also give Mary 1 bed & furniture and my best table.
To my son John, my son James, & my son Clement and my daughter Mary - the rest of my estate, after my just debts are paid, to be equally divided between them. executors; my sons John, James, & Clement.

Probated Apr 9, 1785 by all 3 executors, and by the oaths of witnesses Magruder and Adams. Letters of Administration were granted to the 3 executors; security was Hezekiah Billingsley.

2. George Alexander Magruder -son of Nathaniel Jones Magruder
-after the death of testator's widow and daughter Mary, to have the land left to her
3. Nathaniel Jones Magruder --son
-to have the remainder of the above named tract of land and who is also to see that testator's widow have a sufficient maintenance during her natural life
-after widow's decease the remainder of the estate is to be divided w/ testator's daughter Mary Kidwell

James Thomas s/o William late of the State of Maryland but now a resident of Bedford County, Virginia saith about 11 years ago he was bargaining with Benjamin Ward for part of a tract called "Pascuom" where Isaac Smith now lives and when they were running it out through the old fields by Mr. George Magruder's they ran near a white oak which Benjamin Ward told Mr. George Magruder it was a line tree betwixt them. And afterwards he bought the land and it was never claimed by any other and afterwards he sold the tract to Mr. Isaac Smith. Signed James Thomas in taken by Alexander Howard Magruder, March 13, 1782
Nathaniel Jones Magruder of PGCo saith about 11 years ago he was present when Benjamin Ward and James Thomas s/o William and when they were running the land out through the old fields by Mr. George Magruder's they ran near a white oak which Benjamin Ward told Mr. George Magruder it was a line tree betwixt them. Indenture made October 16, 1786; George Magruder in consideration of the natural love and affection which he hath and beareth unto his daughter Mary Magruder as also for the better maintenance and preferment of her has given part of a tract of "Anchovies Hills Enlarged" and including my dwelling house, apple and peach orchards and other improvements but not to include the new house lately built by my son Nathaniel Jones Magruder.
