      In the name of God Amen the third day of April in John Ryley the year of our Lord God one thousand seven hundred and eight. I John Rylay of Brittons Bay in St. Mary's County, being sick & weake of body but of sound, andperfect memory, thanks be to God for it, I doe make this my last will & Testament in manner following Revocking all wills before made either verbally or in writing.
      First I recomend my soul to Almighty God, My Creator that gave it me and my body tothe earth from whence it was taken to be buried in such decent, manner as my Executors hereafter named shall think fitt there to remaine in Christian buryall till the Resurrection of all flesh, which I believe and Export and first my will and desire is that all my lawful, and just debts be paid in convenient time after my decease, by my Executors hereafter named, and for that worldly Estate, it hath pleased almighty God to bestow upon me, I dispose of as Followeth.
      I give & bequeath unto my son John Ryley two hundred and fifty acres called Greenhill where I now dwell lying in the headof Brttons Bay, in St. Mary's County to have, and hould, the same Land from and after my decease to him and his lawfull begotton heirs from hisown loynes forever. Item my will is that if my son, John Ryley should Dye without issue, that then the said tract of land before me to him given beequally divided amongst my five Daughters to them and their heirs forever.
      Item I give to my Daughter Francis Rylay, an Equall portion to the full vallue as the which my three Daughters, Mary Bright, Elizabeth Peake andMargaret Tomson hath allready Recieved.
      I give to my son John Rylay one great table & cubbert two black walnut chairs,and one bed and furniture which now I lye upon. Item I give to my five Daughters, to them and their heirs forever Mary Bright, Elizabeth Peake, Margaret Tomson, Franseas Ryley, Winefred Rylay all that movable upon the said plantation Equally to be divided amongst my my two clothes, at the expiration of two years.
      Item I give to my God daughter Elizabeth Banister one yowe and one yow lamb at theexpiration of one year. Item I give to my grandchild William Peake one yow and one yow lamb atthe expiration of one year. and lastly I doe, ordaine constitute & appoint my son John Ryly to be full and sole Executors of this my last will and testament as wittness my hand and seal this third day of April one thousand seven hundred and Eight sealed signed and delivered in the presence of us whose names are hereunto subscibed John his Ryly seal Mark Francis Spink April 23 1709 William Brownthen came Francis Spink Thomas Odeand Thomas, T Ode Mary Banister three of the witnesses to the Mary Banister within mentioned will, and made Oath that they saw the above named John Ryley signe seale acknowledge publish and declare the above writing to be his last will and testament, and that at the doing th___ of he was of sound & perfect, mind & memory.       MARYLAND Whereas DAVID DARNELL together wth JOHN RAYLETY & JUSTINIAN TENISON SENR, of ST MARY's MANNER his Surety said DAVID did acknowledge to eve unto his Ldsp & proprietor ye some of Twenty pounds Sterl and said JUSTINIAN TENISON some of Tenn pounds to be levyed of their goods & chattels land & Tenemts in case ye said DAVID DARNELL doe not Indemnifie ye County of ye Woman wch hee ptends is his Wife & Children & make his psonall appearance here next Court & be in ye mane tyme Nine thousand abearance cancell toward his said Spts as all ye good people of this Province afterwards to wit ye 3 day of November 1685 att a County Court held ye same day for St. Marys County beinge & by ye said Recognizance bounde to appear this day beinge solemnly called came not & his Security beinge also called to bringe into Courrt ye same DAVID came not whereupon it is granted by ye Court that ye Recognizance is forfeited & out to be escheated to his Ldsp use
