      p. 120a IN THE NAME OF GOD Amen. 1 NICHOLAS BURNARD of Stafford County am very sicke and weake of body but of good and pfect remembrance blessed & praised
      be God for ye same & therefore doe desire to make this my Will & revokeinge all other Wills I doe make and appoint this to be my last Will & Testamt. in manner as followeth. Vizt lmpris. committ. my Soull into ye hands of all mighty God my onley maker & Jesus Xt my Redeemer & as to ye settlinge of my temporall Estate I shall leave to ye ordering of my hereafter named Executrix onley paying all such debts as shall be due & performinge my will as followeth
      lttem I give & bequeath to my two Daughters SUSAN & ELIZABETH my Plantacon lyeinge on ye North side of UPPER MACHODICKE in ye County aforesaid to remaine to them and their heires for ever allwayes Provided yt. my well beloved Wife shall quietly enjoy ye said piantacon dureing her life and after her Life ye said Lande to be equally divided betweene my aforesaid Children & to their heires for ever and if any one off my said children shall die wth out issue yt my disire is that her moiety shall redownd to ye Survivuur & if it shall please God that bothe SUSAN and ELIZABETH shall die without issue & before my said Wife yt un my will is yt my land shall be & remaine to my well beloved Wile ELIZABETH BURNARD & her heires forever.
      Item I give unto my Welbeloved Wife my personall Estate wth in door or wthout wtso ever shall or may appears to be mine yt she may take care of my said children till they come off Lawfull age to take care of ymselves and it my said Wife shall die before they come of age then my will is yt my Father in Law HENRY MEREST shall take um to himselfe untill they come of Age to pvide for themselves for ye better Setllinge & confirmineinge ye said I doe hereby make & appoint my well beloved Wife to be my whole sole Executrix. in Witness whereof I have hereunto sett my hande & fixed my Seall this 30th day of March 1689

ELIZABETH BURNARD the widow and Executrix of NICHOLAS BURNARD late of this County deceased humbly sheweth that whereas your petitioner having obtained probate of her deced husband will and now having fully paid and satisfied as the debts due from her deced husbands Estate to the respective creditors as far as assetts as she is ready to prove to this Court by her account here ready to be Exhibited Wherefore your Fehr humbly prayer your worships to grant her a full and free discharge and Quietus from any further Molestation from payment of her husbands debts as the Law Enjoyns And now forasmuch as it doth fully appear to this Court that Elizabeth Barnard in the Qualification aforesaid hath fully satisfied and paid all her husbands debts as farr as assets and hath rendered a Just and True accompt of the same under het oath to this Court and that the account is fairy transmitted to the Records Therefore cis ordered that Elizabeth Barnard shall have a full and free discharge and Quietus from her deceased husbands Estate as the Law Enjoyns and directs.

      MARGARET LADY CULPEPER, THOMAS LORD FAIRFAX and KATHERINE his wife Proprietors of the Northern Neck of Virga. .. Whereas EDWARD PRESCOT of Stafford County deced seized of 150 acres of land lying in said county of Stafford and left no heirs nor disposed thereof by will ELIZA. BERNARD widow of NICHOLAS BERNARD presented the same to escheat .. Know ye therefore that we for the composition arrearages & annual rents hereafter received have granted Elizabeth Bernard all that parcel of land of sd and all title therein belonging by virtue of said escheat bounded .. abating southerly upon ye upper Machotick River easterly upon the land of PETER PHYPORD wch said land is half part of a patent granted to PALMER HINTON bearing date 28th day of October
      1650 .. paying yearly the ffee rent of three shillings Sterling money .. Witness our Agent WILLIAM FITZHUGH and GEORGE BRENT either of them dated 13th day August 1695.

YOUNG late of this county deced do grant all my title & interest of the within mentioned 150 acres of land to ALEXANDER DONIPHAN but in case he dye without issue then to return to my heirs as if this writing had never been but if he live or hath issue then I do grant every part of the 150 acres ..
