Beginning at a stake with a beech pointer in one of the orginial lines of Parkers survey then East 131 poles with said line to a stake the place supposed to be Parkers South East Corner then agin with Parkers line N19 W129 poles to a stake with a sugar tree and dowood pointers thens West 132 poles to a beech thens Sourth19 east 129 poles to the beginning. Payable 14th day of 1843.
Deed Book O, page 536; 16 January 1846; Between Reuben Lancaster and Sebastian Marshall for $20 per acre land where Reuben now resides and which was conveyed to him by Thos Butts(sp) 9 Nov 1833 on the waters of Gunpowder creek and bounded as follows: beginning at a rock near a white oak, in the orginal line of McDowell's claim thence with McDowells originall line ?? poles to a rock, thence S56W poles to a rock, thense S70E poles to the beginning containing about twenty nine acres. Boone Deed book 21, Page 45, Feb 1, 1859.
Whereas differences of opinion have heretofore existed between Oscar Conrad and Sebastian Marshall both of the county of Boone and state of Kentucky, in regard to a line between said Marshall's farm and that of said Conrad and as doubts have existed in regard to who is the owner of said fence, and whereas further troubles have existed between said parties in regard to a passway through the lands of said Marshall from the lands of said Conrad and the parties being descious of settling said matters, have this day made and entered into this contract in substance as follows; that said fence known as the division fence between the farms of said Conrad and Marshall shall be turned on the line recently established by M Dickerson, LL Youell together with the County Surveyor who were acting as commisssiners and siad Conrad to have and take possessions of all the lands East of said line to run and espablished to have the same to him his heirs and assigns forever, and said Marshall for himself and heirs does hereby quit claim to the same forever and it is further understood that each of the above named parties to be the owners of said fence in the manner and form as follows; said Marshall to be the owner of the ahlf of the fence sommencing at the corner of Wickliff Grubbs and Conrad where the commissioners set up a stone.
and thence with said line of Marshall and Conrad as established by the commissioners one half the distance of the line of said Marshall and Conrad said Conrad to be the owner of the other half each party to make and set his portion of fence near said line upon his own land and to fence at the ends where they meet, each party to make and keep up a good fence and staked and ridered and always to look to and keep in repair the respective portions, and it is further agreed that said Marshall in consideration of the privileges, rights and advantages aforesaid and the further consideration of the sum of ten dollars to him in hand paiddoes in addition to the above stipulations and obligations does hereby give and release to the said Conrad a passway from his said Conrad's farm to the big road running in front of Marshall's house, said passway to be located and run along the line of post and rail fence passing the stables of said of said Marshall , said Conrad to make and erect at each end of said passway to good and substanital gates and after the making and erection as aforesaid said Conrad is to keep the the one in good condition next to his farm and said Marshall to look to and keep the one open when necessary and keep the same in repair next to the road, said passway to be kept open and not to be obstructed by said Marshall or his heirs, vendors, and assigns and said Conrad to ahve the free use of said passway of sufficient width for horses. Marshall for himself and assigns vendors and heirs and those visiting him and it is considered that said passway shall be fifteen feet wide
