      I, Zephaniah Franklin Sr. of CC, being in perfect health and of sound and disposing mind, memory and understanding;
      Imprimis; I do hereby confirm to all my children to whom I have heretofore made gifts of negroes and other property and which are now in their possession.
      To son Zephaniah Franklin, the following tracts, "Miry Branch", The Enlargement" and "Sandy Knowls" during his natural or single life and then to decend to my other children if he does not have lawful heir.
      To grandson Francis Boucher Garrott, son of my daughter Ann Garrott, the land and plantation on which I now dwell, called "Winters Possession" including 50 acres of the same name I purchased of Richard Davis and Benjamin Burgess together with my mill and mill utensils in fee simple.
      To my two granddaughters Harriot Franklin and Juliett Caroline Franklin, daughters of my deceased son John Downing Franklin, 800 dollars each.
      To my granddaughters Sarah Young and Hannah Gray, daughters of my deceased son James Franklin, 1/4th part of my personal estate exclusive of other legacies and bequests equally divided.
      To two daughters Priscilla Garrott and Ann Garrott, each 1/4th part of my personal estate exclusive of other legacies and bequests equally divided.
      To my grandchildren, the sons and daughters of my deceased daughter Hannah Garrott, to wit; Middleton Garrott, Benedictor Cox or Cost, James Garrott and Barbara Garrott, 1/4th part of my personal estate exclusive of other legacies and bequests equally divided.
      Item: my executors to sell and dispose of the following tracts; "Randalls" or "Randolphs Addition", "The Addition to Johnsons Beginning", "Moulds Venture", another part of "Randolphs Addition" I purchased of Nehemiah Franklin, "Widows Righted", "Come By Chance", and "Betsey's Delight", and the proceeds divided as follows; ¼ part to each of my daughters Priscilla Garrott and Ann Garrott, ¼ part to granddaughters Sarah Young and Hannah Gray equally, and the other 1/4th part to the children of daughter Hannah Garrott deceased.
      Item: my executors to sell and dispose of my negroes and other personal property for the purpose of making distribution of the same as is herein before expressed.

      To son Zephaniah Franklin, negro man Oston provided he pay unto my daughter Ann Haislip the sum of eight hundred pounds of crop tobacco.
      To daughter Ann Haislip the sum of ten pounds current money to be paid to her at such time as the Zephaniah Franklin shall think she is in want of it.
      To my son Hezekiah Franklin, negro Pomphry, and twenty pounds current money.

The afd 2 parts of Winters Possession are the whole of the lands that were devised to me by my husband, Richard Davis, decd, during my natural life, and afterwards, to his son, Richard Davis, the presnt grantee.       At the request of George Jenkins, the following Notice and Depositions was recorded March 28, 1801
      Port Tobacco February 17, 1801; Mr. Brawner sir. This is to give you information that I intended to take the depositions of Zepheniah Franklin and Benedict Wheeler on March 16, 1801 at the house of Edward Pye in Port Tobacco agreeable to an act of assembly for perpetuating testimony to be read in evidence in a suit brought by the executrix of Robert Lawson against you in CC court.       CC Sct March 16, 1801; Then came Ignatius Ward before the subscribers two of the justices of peace for CC and made oath that he delivered a copy of the within notice to Benjamin Brawner on February 18, 1801. William McPherson, Joseph Green
      CC Sct; At the request of George Jenkins the following depositions were taken before the subscribers of the Justice of peace for CC this March 16, 1801 at the house of Edward Pye in Port Tobacco. The deposition of Zephaniah Franklin aged 63 yrs. being sworn deposeth and saith that he heard Mr. Benjamin Brawner say sometime last August that he stood charged on the late Robert Lawson's books with 2,000 pounds of tobacco for rent and that he did not deny that he was not to give the said 2,000 pounds of tobacco and further this deponent saith not.       The deposition of Benedict Wheeler aged 60 yrs being sworn and saith that he applied to Mr. Lawson about 8 or 9 years ago to rent the place Benjamin Brawner lived on and some time afterwards he met with the said Benjamin Brawner on the road and informed him that he had applied and that Mr. Benjamin Brawner informed him that he gave Mr. Lawson 2,000 pounds of tobacco for the place and that was too much but that he was obliged to give that sooner that to remove from the place as it was inconvienent so to do and further this deponent saith not.       At the request of Zephaniah Franklin the following Trust Deed was recorded September 5, 1808
      Indenture made September 2, 1808; between Nehemiah Franklin of one part and Francis H. Sheid and Samuel W. Franklin of the other part. Witnessed that Nehemiah Franklin in consideration of the trust and confidence in them the said Francis H. Sheid and Samuel W. Franklin reposed and herein after particularly set forth and also for in consideration of the sum of $1 current money of United States has sold all the interest right property claim and estate which he hath in two Negroes, Isaac (22 yrs.), and Gusty (12 yrs.) In trust for no other use intent and purpose whatever that is to say whereas the said Nehemiah Franklin at this time stands indebted to Zephaniah Franklin in the sum of $500 current money of United States to provide in the first place for the payment of the debt and the indemnification of Zephaniah Franklin for and on account of his engagements that the two Negroes aforesaid conveyed to Francis H. Sheid and Samuel W. Franklin in trust and the first place raised by a sale of one or both of the aforesaid Negroes in such manner as they or the survivor of them shall think proper at the expiration of 2 yrs. from the date hereof so much money as will be sufficient and apply it to the purpose of paying off and discharging the said debt with all interest and costs and reimburse Zephaniah Franklin the aforesaid debt of $500 and return pay to Nehemiah Franklin any surplus and Nehemiah Franklin does nominate and appoints Francis H. Sheid and Samuel W. Franklin his true and lawful attorney's for the purposes of fulfilling this trust.       At the request of Zephaniah Franklin the following Trust Deed was recorded September 5, 1808
      Indenture made September 2, 1808; between Aquilla Franklin of one part and Francis H. Sheid and Humphrey Barnes of the other part. Witnesseth that Aquilla Franklin in consideration of the trust and confidence in them the said Francis H. Sheid and Humphrey Barnes repose and herein after particularly set forth and also in consideration of the sum of $5 current money of United States has sold all the interest right property claim and estate which he has in virtue of the last will and testament of his late father Hezekiah Franklin deceased and to his part of a tract or parcel of land known by the name of "Winters Possession" lying in Durham Parish and containing 78 acres in trust nevertheless for the uses and purposes hereinafter expressed. That is to say whereas the said Aquilla Franklin stands indebted to Zephaniah Franklin in the sum of $200 current money of United States and for the indemnification of him and for the debt that all the premises herein are sold and conveyed by Francis H. Sheid and Humphrey Barnes in such manner as they or the survivor of them shall think proper at the expiration of 2 yrs. from the date hereof so much money as will be sufficient and apply it to the purpose of paying off and discharging the said debt with all interest and costs and reimburse Zephaniah Franklin the aforesaid debt of $200 and return pay to Aquilla Franklin any surplus and Aquilla Franklin does nominate and appoints Francis H. Sheid and Samuel W. Franklin his true and lawful attorney's for the purposes of fulfilling this trust.
