DIGGES, EDWARD, St. Mary's Co. 10 Jun, 1769 18 Dec, 1769
Being conscious that it was my father's will that bros. William and Henry Digges, shd. have an equal pt. with me of all the lands in Maryland, or elsewhere, shall put up lands for sale for the discharge of debts; all lands in Frederick County, which belong to me, shall be sold for equal benefit of daus.: Elizabeth, Ellanor and Mary Digges; desire my share of the Hampton Iron Works be sold.
To son John Digges, 1/5 of personal estate; in case he returns to this Province of Maryland and not a religious otherwise, It shall be equally divided between daus. Elizabeth, Mary and Eleanor.
To son Edward Diggs, and dau, Anne Digges, 35 lbs. currency annually, during their life, by 3 daus,
Desire son John, pay 1/5 pt.
To sons-in-law Charles and Jesse Wharton, 10 guineas,
To bro, Wm, Digges, 1/2 of the money due on "Dillinger's" bond, when discharged, and the other half to 3 daus. Desire bro, William Digges, to have a patent for tract on Little Pipe Creek, which we had a dispute with Barrister Charles Carroll, Esq., which we agreed to divide when patented.

At the request of Henry Digges the following Power of Attorney was Recorded this 20th day of March
Anno Domini 1793
To all Persons to whom these Presents shall come Elizabeth Courts send Greeting Whereas the said Elizabeth Courts is entitled to dower in the following Lands namely Courts Discovery Also all that part of a tract of Land called Barnhill Lying on the north Side of a Run passing thro' the whole of the said Tract Also all that fourth part of a tract of Land called Barnhill lying on the south side of a Run passing thro' the whole of the said Tract Also one fourth part of a tract of Land called Spring Bottom all which Lands are situate in Charles County and were conveyed to Henry Digges of said County by Joseph Courts Husband of the said Elizabeth Courts and to which the said Elizabeth Courts never relinquished her right of Dower Know ye that the said Elizabeth Courts for divers good causes and considerations hath deputed and constituted and by these presents doth depute and constitute Nathaniel Ewing of Saint Marys County her true and lawfull Attorney to demand her dower in the aforesaid Lands of the said Henry Digges and to treat with the said Henry Digges for the selling and Disposition of all her right and Title to the aforesaid Lands and after any Agreement concluded as aforesaid for and in the name of the said Elizabeth Courts to sign seal and deliver any Conveyance to the said Henry Digges or he the said Nathaniel Ewing in his Discretion shall think fit And the said Elizabeth Courts doth hereby ratify and make firm in Land whatsoever acts the said Nathaniel Ewing should do or cause to be done in pursuance or by virtue of these Presents or the Power hereby given And if the said Henry Digges and Nathaniel Ewing should not agree for the sale of the right of the aforesaid Elizabeth Courts the said Elizabeth Courts doth constitute the aforesaid Nathaniel Ewing her Attorney to sue forth and prosecute against the said Henry Digges in her name a writ of Dower for the recovering or obtaining the possession of one third part of the aforesaid Lands In witness whereof the aforesaid Elizabeth Courts hath hereunto put her Hand and seal this Twentieth day of February 1792.

Charles County Land Record Book O#3, 1765-1770; Page 273. Lease and Release. Sep 13-14, 1767 from James Keech Jr of CC, planter, to Henry Digges of CC, planter, for 441 £, a tract of land in CC {being 1 tract called Hardship, and part of 2 other tracts of land called Spring Bottom and Courts' Choice) and of which sd tract a common recovery was suffered to the use of sd Keech at a Provincial Court held at the City of Annapolis before the Justices of the same Court in May Term Last, Sd tract is bounded by Hardshift, the land of Robt Henly Courts, the main Road, the land of George Elgin, containing about 200 acres and 5 perches. Charles County Land Records 1786-1790; Liber D#4; Page 294. Instrument of writing, recorded at the request of Henry Digges. Whereas on Dec 22, 1777, an agreement was entered into between us, Henry Digges Sr and Edward Sanders of CC concerning the purchase of a tract of land in CC called Wilkinsons Throne, the property of Edward Sanders, for which sd land the sd Henry Digges agreed to give the price of a sum of 35 shillings sterling per acre. And whereas sd Henry Digges has instituted a suit in the Court of Chancery to compel the sd Edward Sanders to convey the sd land to him, the sd Henry Digges, which sd suit is now depending, and also whereas we, sd Henry Digges and Edward Sanders, have compromised and agreed the sd affair as follows, to wit, the above mentioned agreement relative to the sale of the sd land to be considered and held as null and void, and the sd Edward Sanders be permitted to enter upon and take again in his possession the sd tract of land as of his former right, sd Henry Digges to pay the sd Edward Sanders 5000 lbs of crop tobacco, and also to convey to him a Negro girl, about age 14, on account of the former use and occupation of the sd land by the sd Henry Digges, and it is also agreed that the suit in chancery above mentioned, shall be struck off the next term, each party paying his own costs. Charles County Land Records 1790-1792; Liber K#4; Page 7. Mortgage. I, Benjamin Reeder of CC, for 300 £, have sold to Henry Digges of CC, 5 slaves named Jacob, Nell, Prism, John, and Matthew. Henry Digges, as a surety for sd Benjamin and for his debt, stands bound to Olivia Jurningham (Jerningham), now the wife of Henry Hamersly of CC, by bond in the penal sum of 940 £conditioned for the payment of 470 £and interest at a day now past, of which about 160 £now remains due. Henry Digges as a surety for Benjamin Reeder for his debt, stands bound to Ann Edwardina Jurningham (Jerningham), now married to Joseph Queen of Prince Georges County, by bond in the penal sum of 940 £, conditioned for the payment of 470 £and interest, at a day now past, of which about 410 £now remains due. Henry Digges, apprehensive he may sustain some injury from alarming circumstances in consequence of his several securityships afd, and sd Benjamin being willing to indemnify him against all possible harm that may ensue, has conveyed to ed Henry Digges the afd 5 slaves. If sd Benjamin Reeder pays Henry Hamersly and Joseph Queen the balance of the afd several suns, and shall in the meantime indemnify Henry Digges from all losses he may sustain because of the afd securityships, then these presents to be void.
