      Jane Peck, born 15 February 1723, was called "Mulatto Jane belonging to Alexr. Contee" in Prince George's County court on 24 June 1740 when she was presented for having an illegitimate "Malatto" child. She and her daughter Sarah were sold to her master. On 27 November 1744 the court bound her son Joseph to William Beanes until the age of twenty-one years and ordered that he give the boy one year of schooling and his freedom dues at the completion of the indenture. She could not pay her fine, so she received ten lashes. The court ordered her daughter Priscilla bound to Robert and Edith Richards until the age of sixteen years and ordered that they teach her to read, spin, knit and sew. On 28 November 1749 the court bound her fifteen month old son John to Thomas Contee until the age of twenty-one, and on 22 March 1757 the court bound her seven month old son David to Thomas Contee until the age of thirty-one. On 25 November 1766 she confessed to having another illegitimate child for which the court ordered that she only pay a fine and court costs for which her son Joseph provided security [Court Record 1723-6, 340; 1738-40, 653; 1740-2, 18, 617; 1746-7, 620; 1748-9, 80, 85, 174; 1751-4, 174; 1754-8, 411; 1765-6, 27].

Benjamin Fendall, in his lifetime, was possessed of 20 acres on Allens Fresh in CC, granted unto Robert [Yates] and sd Benjamin Fendall by a lease dated Jun 10, 1752, and by the death of sd Robert Yates, survived to sd Benjamin Fendall, on which tract there is now erected 1 water grist mill, 1 bake house with sundry other buildings and improvements, and Benjamin Fendall, being thereof possessed, died, having first made his will, wherein he directed that his water grist mills on Allens Fresh, together with the land condemned by virtue of a writ of ad quod damnum to erect sd mills on, should be sold. The afd Thomas Contee and Henry Fendall, Benjamin Fendall's executors, sold the tract of land to sd James Swan. This deed therefore witnesses that James Swan, for 235 £10 shillings sterling and for divers other good causes, sells to Thomas Contee one moiety of the tract of land situated as afd. Oct 15, 1766 from the Revd Mr. John Macpherson, Rector of William and Mary Parish in CC, to Thomas Contee and Philip Richard Fendall of CC, Gentleman. John Lewellin of St. Mary's County, Gentleman, by virtue of 2 deeds or leases, one dated Sep 8, 1738, and the other dated [blank month and day], 1739, and recorded in CC Liber SN #2 pages 258-29, and Liber SN#2 pages 298-299, leased unto Samuel Chunn, Susanah Chunn, his wife, and Acquilla Chunn, his son, during their natural lives, part of a tract of land in CC called Westwood Manor, containing about 154 acres, the Chunns paying to sd John Lewellin, yearly, 100 lhs of tobacco in 1 cask, and 200 lbs of tobacco and 3 shillings. Sd Acquilla Chunn being the only survivor, on Dec 7, 1757, as recorded in CC Liber G #3, conveyed the land to sd John McPherson the afd land, during the natural life of sd Acquilla, and sd McPherson is now in possession of sd land. Sd McPherson at this time has 8 Negroes, to wit, George, Jack, Ned, Jem, Will, Peg, sail, and Ned, which Negroes are the property of William and Mary Parish, and held by sd McPherson as Rector. Now this deed witnesses that sd McPherson, for the rents and covenants hereafter mentioned, has granted to ad Contee and Fendall, during the natural life of sd Acquilla, all of McPherson's right to the afd leased lands, and the use.of the afd 8 Negroes, during the term of his Rectorship, to be employed by Contee and Fendall. Contee and Fendall are to pay, yearly, to sd Lewellin, 1000 lbs of tobacco in hogshead and 200 lbs of tobacco and 3 shillings, and to sd McPherson, 2800 lbs of tobacco, and for the use of the 8 Negroes, yearly, 1240 lbs of tobacco for each Negro man, and 1000 lbs of tobacco for each Negro woman. Contee and Fendall will find the Negroes meat, drink, and clothing. McPherson will have any Negroes that need it, tended by a physician or midwife. Aug 24, 1767 from the Revd Mr. John McPherson, Rector of William and Mary Parish in CC, to Thomas Contee and Philip Richard Fendall, all his right to a certain messuaye of land in the Parish afd and CC, called the Glebe, and being part of a tract of land called Burrow Hall, and also the Negroes following, to wit, Sam, Nat, Nan, Poll, Edy, and Daniel (the property of the Parish afd), during sd McPherson's natural life or his continuation as Rector of the Parish afd. For and in consideration of the land and Negroes afd, sd Contee and Fendall agree to pay McPherson, yearly, during the term afd, 2000 lbs of tobacco for the land aid and at the rate of 930 lbs of tobacco for each of the Negroes afd, by crediting him yearly for the like sum on his bond. McPherson, for 20 £to him in hand paid by receipt on his bond to Contee and Fendall of this date, sells to Contee and Fendall, 1 pinch back watch, and 399 volumes of small and large books of different kinds. If the death of the Negroes afd or either of them being rendered incapable of labor by age or infirmities, it shall exculpate sd Contee and Fendall from paying wages for them as afd. By a deed dated Mar 29, 1788, between Benjamin Contee of the 1st part, Sarah Russell Lee (now Sarah Russell Contee) of the 2nd part, and Eleanor Ann Lee, Thomas Contee, and Philip Richard Fendall of the 3rd part, it was agreed between sd Benjamin Contee and Sarah Russell Lee, between whom a marriage was then intended shortly, that sd Sarah, during her coverture, should enjoy, exclusively, all the slaves, stock, furniture, money, and other property, that she was entitled to, free from any claim of sd Benjamin. Sd Sarah, with the consent of sd Benjamin Contee, for 5 shillings, via CC deed, sold to sd Eleanor Ann Lee, Thomas Contee, and Philip Richard Fendall, all the property she was entitled to, and the increase thereof, in trust for the persons sd Sarah directs during her coverture. The intended marriage was afterwards solemnized. Sd Eleanor, Thomas, and Philip want to give up the trust to some other persons; Sarah wants sd property to be invested in lands and other property for the use and support of Sarah, and transferred to the Trustees, for the use of Sarah and for Sarah to dispose of, or, if no disposition is made, to Sarah's heirs. Sarah, for the confidence she has for her friends, John Campbell, John Marshall Sr, and Thomas Harris, appoints them trustees, to receive from sd Eleanor, Thomas, and Philip, all the sd property. Now know that I, sd Sarah Russell Contee, by virtue of the power reserved to me by the afd deed, hereby direct that sd property shall be held by sd Trustees, for the use of myself and my heirs, until transfer of the same shall be legally made by the Trustees to sd Campbell, .
