MEMORANDUM that on the twelfth day of April Anno Domini One thousand seven hundred and sixty four It is agreed between BENJAMIN TYLER of County of Prince William in Colony of Virginia and MARY FOOTE of County of FAUQUIER in Colony aforesaid in manner and form following, to wit, Whereas BENJAMIN TYLER and MARY FOOTE are about to enter into the Holy State of Matrimony & being desirous to enter into a Contract conerning the Disposition of their Estates Now This Indenture Witnesseth that BENJAMIN TYLER doth agree with MARY FOOTE that he his heirs will and by these presents doth for ever quit claim of right, Title or interest whatsoever to the Estate MARY FOOTE now possesseth both real and personal or to any advantages that at present doth or hereafter may to the same belong, In consideration MARY FOOTE doth agree with BENJAMIN TYLER that she sd MARY FOOTE after the decease of BENJAMIN TYLER will forever quit Claim of right or Title to any part of BENJAMIN TYLER's Estate as her Right of Dower, and for the true performance of all the agreements above mentioned BENJAMIN TYLER and MARY FOOTE bind themselves their heirs firmly by these presents. In Witness whereof sd parties hereunto set their hands & Seals

At a Court held for Prince William County the 3d of December 1764
This Contract was acknowledged by BENJAMIN TYLER to be his act & deed and the same as to MARY FOOTE was proved by oath of BRERETON JONES and GEORGE FOOTE and the same was ordered to be recorded

Thomas Chapman for a felt hat; To Cash pd John Riddle for 1 pr. shoes; To Cash pd Dan'l. Payne for 1 pr. shoes; To Cash pd. Eliz. Wood for knitting 1 pr. stockings. 28 Nov.: To Cash pd Phillip Spiller for his wife making 4 shirts; To Cash pd Wm. Alexander for soleing 1 pr shoes; To Cash pd William Foote for timber sufficient to make 2200 boards for building your Tob'o house & cornhouse; Cash pd Mr. John Matthews School master; For sundry areares in Francis Moores Rents; Paid Mr. John Matthews School master 1 Spelling book 1s. 4d.; Cash expended in Gitting you a board to go to Col'o. Henry Lee's Matter; Cash pd Aaron Fletcher; Cash pd Phillip Spiller; Cash pd Sarah Fletcher for mending your shirts. 30 Nov.: Paid Mrs. Eliz. Wilkerson for your board six months; Paid Eliz. wood; Paid Perron a Taylor for 2 pr. Breeches; Cash of Mrs. Mary Tyler your Guardian for your part of your Fathers Estate.
Ret.: At a Court held for Fauquier County the 22d day
of Nov. 1773. This account was returned and made Oath to by Hannah Foote Administratrix of Gilson Foote dec'd. Guardian of the within named Richard Foote as a true copy taken from the Books of the said Gilson Foote and ordered to be recorded,
