      MEMORANDUM that on the twelfth day of April Anno Domini One thousand seven hundred and sixty four It is agreed between BENJAMIN TYLER of County of Prince William in Colony of Virginia and MARY FOOTE of County of FAUQUIER in Colony aforesaid in manner and form following, to wit, Whereas BENJAMIN TYLER and MARY FOOTE are about to enter into the Holy State of Matrimony & being desirous to enter into a Contract conerning the Disposition of their Estates Now This Indenture Witnesseth that BENJAMIN TYLER doth agree with MARY FOOTE that he his heirs will and by these presents doth for ever quit claim of right, Title or interest whatsoever to the Estate MARY FOOTE now possesseth both real and personal or to any advantages that at present doth or hereafter may to the same belong, In consideration MARY FOOTE doth agree with BENJAMIN TYLER that she sd MARY FOOTE after the decease of BENJAMIN TYLER will forever quit Claim of right or Title to any part of BENJAMIN TYLER's Estate as her Right of Dower, and for the true performance of all the agreements above mentioned BENJAMIN TYLER and MARY FOOTE bind themselves their heirs firmly by these presents. In Witness whereof sd parties hereunto set their hands & Seals
