Apr. 1756 - John Hanson, Jr. vs. John Butridge, Wharton Philbert, Simon Smith and Henry Butridge, of Charles Co., planters. In Apr. 1756, the 4 defendants, at Charles Co., Md., signed their note to Hanson (produced in Court) in which they agreed to pay Hanson 990 lbs. of crop tobacco on or before Jan. 1st next ensuing, and for their certain payment, bound themselves in the penal sum of 1872 lbs. of crop tobacco if they did not do so. All 4 men signed the note as opposed to just making their marks. When the note became due (Jan. 1, 1757), Hanson requested payment which was not made. He therefore brought suit against the 4 defendants for the penal sum of 1872 lbs. of tobacco. There is nothing further on this case until the Mar. 1758 Court, at which time the case is carried forward against only Philbert, the other 3 defendants not being mentioned.

The condition of the obligation was that if John Buttridge paid John Stewart & Co. 2200 lbs. of crop tobacco by Nov. 10 next with legal interest, then the above obligation was void.
