      1. James GAINES was born 18 Jan 1709/1710 in King & Queen County, Virginia, and died 20 Mar 1786 in Madison County, Virginia/Culpeper County, Virginia He was the son of 2. Richard GAINES and 3. Catherine RAWLINS OR RAWLINGS. He married Mary PENDLETON 1731 in Culpeper County, Virginia, daughter of Henry PENDLETON and Mary Bishop TAYLOR. She was born 1717 in King & Queen County, Virginia, and died 1803 in Madison County, Virginia.

      i. Catherine GAINES. She married William BROADDUS, son of Edward BROADDUS and Mary SHIPP OR SHIPLEY.
      ii. Henry GAINES was born 1737 in King & Queen County, Virginia, and died 25 Jul 1830 in Pickens County, S. C.. He married Martha Anne GEORGE, daughter of Richard GEORGE and Elizabeth MAYO. She was born 18 Mar 1734/1735 inMiddlesex County, Virginia, and died 1801 in Donalds, Newberry Dist South Carolina. He married Anne MOORE. She was born in Edgefield, SC. He married Lydia. She was born in SC.
      iii. James GAINES Jr was born 1739 in Orange County, Virginia, and died 25 Nov 1788 in Orange County, Virginia. He married Mildred Bland POLLARD 1760. She was born 1736 in King & Queen County, Virginia, and died 1796.
      iv. Richard Edward or Edmund GAINES was born 1740, and died 1807. He married Elizabeth BROADDUS, daughter of Edward BROADDUS and Mary SHIPP OR SHIPLEY.
      v. Mary Anne GAINES was born 10 May 1742 in VA, and died 15 Jun 1829 in Va. She married Edward HERNDON 30 Nov 1762, son of William HERNDON and Anne DRYSDALE. He was born ABT 1738, and died 1831.
      vi. Edmund Pendleton GAINES was born 1743, and died 1816 in Madison County, Virginia. He married Tabitha RUCKER 1774, daughter of Ephraim RUCKER. She was born 1754, and died 1840.

      At a court continued and held for Orange County on Saturday the 29th day of June 1745.
      - On the complaint of Valentine Bostick against James Gaines as a constant and common disturber of the peace. It is ordered that the sheriff of this county do take the said James Gaines into his custody and him safely keep until he give security for his appearance at the next court to answer on the said complaint and in order to the taking the said Gaines, the sheriff is hereby impowered to raise the power of the county.

      - James Gaines who stands committed to the common goal of this County by order of the last court to appear here this day to answer the complaint of Valentine Bostick against him appeared accordingly whereupon the said Bostick and Gaines were formerly heard touching the matter of complaint on consider whereof it is ordered that the said Gaines be committed to the custody of the sheriff [Page 392] of this County and there to remain until he shall give bond with two securities for his good behavior for a year and a day next ensuing himself in the sum of 10 pounds at his securities each of the sum of 5 pounds current money to be paid to our Sovereign Lord the King his heirs and successors.

      - James Gaines who remains in the custody of the Sheriff of this County, Samuel Gay and Randolph Fugett [Fugate] came into court before his majesties Justices of the peace for the said County and acknowledged themselves indebted to our Sovereign Lord the King his heirs and successors in the sum of 20 pounds current money of Virginia that is to say the said Gaines in the sum of 10 pounds and the said Samuel and Randolph each of the sum of 5 pounds respectively to be levied of their goods and chattels lands and tenements and to our said Lord the King his heirs and successors rendered on this condition that if the said James Gaines shall be of the good behavior to all his majesties liege subjects for the space of one whole year and a day from this time that then this recognizance be void otherwise to remain in full force and it appearing to the court that the said Samuel Gay and Randolph Fugett [Fugate] had released the said Gaines by force out of the common goal of this County whereto he was committed by the sheriff by virtue of the aforesaid mentioned order, it is ordered that the said Gaines, Gay and Fugett [Fugate] pay all costs and charges that has been expended from the first apprehending the said Gaines to this time.

      - Joseph Walsh, John McKensey, Elexander Frazier and Margaret Dungan came into court and made oath that they were immediately imported into this colony and also James Gaines came into court and made oath that he was imported into the province of New York from whence he came immediately into this colony the said Walsh and Gaines from Ireland, the said McKensey, Frazier and Dungan from Scotland and that this is the first time approving their importations in order for each of them to obtain a right to 50 acres of land which rights the said Gaines, McKensey, Frazier and Dungan in open court assigned over to the said Joseph Walsh which is ordered to be certified.

For £55 current money. By Act of Assembly passed by George III instituted an Act to direct the sale of certain intailed lands whereof John Spotswood, Esqr., died seized for payment of the debts due from him and the estate of Majr. General Alexander Spotswood, it is enacted that Bernard Moore or the acting executors of the will of John Spotswood or the guardian for the time being of Alexander Spotswood the son should be impowered with the consent and approbation of John Robinson Esqr., Edmund Pendleton, Roger Dixon and John Campbell, Gent., to sell so much of the intailed lands whereof John Spotswood died seized (the mine tract excepted) so as that the whole of the money to be raised did not amount to more than £6000, and convey the land to the purchasers. 200 acres ... on the Robinson River in Gaines' cleared ground a corner to Wood's lott ... corner to John Spotswood ... corner to Spotswood and Thomas Graves ... with Graves' line to the Robinson River ...

      [Page 17-18) James Gaines, Culpeper. £43.10 .3-1/2. due McCall, Smellie & Co. There were two persons of this name in Culpeper. One died in Culpeper in 1786 and left a very good estate but he never had any dealings with McCall, Smellie & Co., and was remarkably clear of debt, being a very honest man. He enumerated the few British debts which he owed shortly before his death and desired that they might be paid by his representatives. The other James Gaines removed to North Carolina in 1776 in very good circumstances and now lives in Tennessee on the Holston some small distance from the Block House. He
      is a member of the Senate in the Legislature of that state and is very able to pay his debts.
