- THOMAS KIDD haveing brought an action of Trespass to this Courte agt. JOHN BRISTO & JOHN MICHAM, and by his Petition complayneing that the Petitonrs; Father, THOMAS KIDD, late of this County, dyed seised in fee of a certaine Tract of Land scituated upon a Branch of PYANKETANKE SWAMP called WHITE OAKE BRANCH, conteyneing One hundred ninety foure acres granted to him by Patent beareing date ye 7th day of Aprill 1664, and that yor; Petitionr: hath good right title & interest in and to ye said Land as Sonn and Heir of ye said THOMAS: Yett nevertheless JOHN BRISTO & JOHN MICHAM into & upon ye said Land have entered & divers trespasses and other enormities thereon have done and continue to doe to ye Petitionrs: damage teen thousand pounds of tobaccoe & caske. and prayes that ye said JOHN BRISTO & JOHN MICHAM from off yesaid Land may be removed; and pay ye aforesd. damages wth: costs; & ye Plaintiff produceing a Patent beareing date ye 7th day of Aprill 1664, for ye grant of ye Land in question unto THOMAS KIDD, Father of ye Plaintiff, and ye Defendts. for plea saying that they have not comitted any trespass upon ye Land mentioned in ye Plaintiffs Petition, for ye Tryall of wch: matter, it is ordered that a Jury of ye Antientest and discreete freeholders of ye Neighbourhood be impanelled by ye Sheriff of this County & sworne before Mr. ABRAHAM WEEKS or some other of his Maties: Justices of ye Peace of this County, who are in company of Majr, ROBERT BEVERLEY and Mr. RICHARD WHITEHEAD, Surveyors, to survey measure & lay out ye said one hundred ninety foure acres of Land mentioned in the said Patent upon ye 2d. day of Decembr: next. and make returne thereof under their hands & seales to ye next Courte held for this County, And if they finde that ye Defendts. have comitted any trespass upon ye said Land, the said Jury are to returne there verdict accordingly and assess damages
