Mr. FRANCIS CLAY ( ) July ye 28th 1660 & was recorded in the County Court of Northumberland aforesd more at large it may appeare; And whereas by the sd: conveyance ( ) sett downe how the sd: Land shalbe devided between. the said RICHARD EATON & ADAM YARRETT shall have their land severally ( ) by these presents that the sd: EATON & YARRETT ( ) & eyther of their heires & assigned ( ) of Law concerning the devidingof ( ) and by these pr:sents doe agree that ( ) hereafter eyther of the sd: plies or any ( ) assignes shall desire the sd: land to be ( ) bounded that then hee or they shall make choyce of ( ) honeste men to devide & bound the sd: land & if an ( ) that two men cannot agree about the equal devision that then those two men shall have full power & authority to chuse an Umpire for to end & conclude the controversie which shall be in debate and wee doe bind ourselves by these pr:sents in the summe of Ten thousand pounds of tobacco & caske each to other to stand to that devision the sd: three men shall award; And Lastly, it is agreed upon by both p:ties aforesd, that if eyther of them dye before the sd: land shall be laid out and bounded, that the survivor shall not have the whole, any Law custome or pr:scription to the contrary in any wise notwithstanding; In Witness whereof I the sd. Whereas the 20th of March last a Commission of Administration was granted to ADAM YARRATT on the behalfe of RACHELL his Wife, Sister to AUGUSTINE RHODES [deced] on the Estate of AUGUSTINE RHODES who did then give security to the Court for her due administration of the Estate, And whereas the 17th of Aprill last, the Nuncupative Will of AUGUSTINE RHODES was proved by the Oaths of CHARLES JACKSON and SAMUELL JACKSON, wittnesses of the Will, at the request of EDWARD BARNES who has a suite depending between ADAM YARRATT and EDWARD BARNES and EDWARD BARNES fayleing of his appeareance ye last Court, it was ordered that EDWARD BARNES should appeare at this Court or otherwise the Court to proceed to Judgment, And whereas this Court theCouncell of ADAM YARRATT did produce Law whereby the Will was made voyd and prayed confirmation of the former Order past for his Commission of Administration of the Estate of AUGUSTINE RHODES, the Court doe therefore order that ye former Order of the 20th of March be confirmed and that ADAM

Whereas WILLIAM MAN brought his action against JOHN WEBB and RACHELL his wife for five pairs of shoes alleged to be due from ADAM YARRATT, deceased, late husband to the said RACHELL, and whereas the said Defendants are not qualified by law in any wise to dispose of the said deceased's Estate, being neither Executors nor having Administration granted on the Estate. Upon the motion of the said Defendant a Nonsuit is granted against the said Plaintiff and ordered he pay Damages according to Law with costs of Suit alias execution.
