SMITH, HENRY, 15 April, 1684; 4 June, 1684.
To my sons Toby and Henry Smith my whole tract of land to be equally divided between them and their heires forever but if in Case there be a valluable seate Land Cleared in the Matrums Neck and is Justly found & surveyed my will is that my son Henry have it. And then he have only ye land that is above the Creek Called the great Creek where on George now liveth to him and his heirs forever. To wife one Sorrel pacing horse with a side saddle to her and her heirs forever. I give and bequeath all the Rest of my goods & Chattles to be equally divided between my wife and my two sons share & share alike. Wife Executrix and Edward Adcock Executor of his will for the performance and managing hereof. I bequeath Col. Wm. Loyd & Mr. Sam'. Peachy overseers to see this my will pformed.

In the Name of God Amen.
I ffrances Godson being Sick & Weake in Body but in perfect memory do make this my last Will and Testamt. in manner & forme as followeth-
1. I bequeath my Soul to the hands of Almighty God my Creator & maker in full and assured hopes of Salvation in & through the meritorious death & Passion of my deare & blessed Saviour Jesus Christ.
2. I bequeath my Body to the Earth from whence it Came to be Christian-like buried by the discretion of friends-
3. I give & bequeath all my worldly Goods & Estate both reall & Personall in manner & forme as followeth-
4. I give & bequeath all the money that is due to me by Rappa : County Court Records to be Equally divided between Toby Smith & Hen : Smyth and their heires for ever-
5. I give & bequeath unto Hen : Smyth all my Estate of Land that is Joyning to Bridgetts Land it being to the sd Henry Smyth & his heires for ever-
6. I give & bequeath unto Mrs : Elizabeth Smyth all other things of my Estate and what may Come out of England from my -Unkle to her own proper use and behalf In Witness whereof I have sett my hand & fixed my Seale this 27th day of January 1685/6--

TO ALL XPIAN PEOPLE to whom these shall come I DANIEL DOBYNS of the County of Rappa. in the Colony of Virginia send Greeting in our Lord God everlasting.
Whereas I the said DANIEL DOBYNS for certain considerations by me reced before Marriage to ELIZABETH my now Wife as also out of the natural affection I beare unto HENRY SMYTH have given made over and sett unto sd HENRY SMYTH an estate as is here following in manner and forme expressed (Vizt) three young Cows and one three year old heifer being all of the sd HENRY SMITHs Fathers marke and one of the said Cows being red with a white tayle and known by the name of Coll, the other two Cows being of a black colour with some white about them, the one called Young Bacon the other Double Deeggs, the heifer being red and called Rose, wch said Cattle with their en crease male and female I give unto the said HENRY SMYTH and his heirs forever. Also I give unto the sd HENRY SMYTH one large feather bed and bolster, a pair of Blanketts, a Rugg answerable also I give unto sd H. SMYTH two good pewter dishes and six plates answerable, Two good silver spoons, six good leather Chairs, one Iron Kettle of fourteen gallons, one Iron pott of six gallons, two good Tables, one good Chest, one Gold Ring, one large Silver Tobb: box, ten ewes and a Ram, four Breeding Sows and four thousand pounds of good sound sweet sent.ed Tubb. and Caske, all which said Cattle or Estate to be secured and delivered unto the said SMYTH my me the said DANIEL DOBYNS my heirs at the severall ages of the said SMYTH hereafter nominated (Vizt) the Stock of Cattle and hoggs with the household Stuff and the Ring and Silver Box be delivered to the said HENRY SMYTH at the age of Sixteen years; also that Two thousand pounds of Tobb. and Caske be delivered him at the same age; And that the said HENRY SMYTH be at liberty to act and do for himself at the age of Sixteen and to have the Plantation to himselfe whereon GEORGE SUGGETT now liveth when attayned to the age aforesd. And the other Two thousand pounds of Tobb: and Caske to be paid when the sd SMYTH atteyneth to the age of Twenty one alwais provided that the Estate all and singular rest and remaine on the old Plantation belonging to the said SMYTH until the delivery according to the true intent and meaning of these presents and that if any of these Cattle or their encrease becom so that be more advantage to the sd SMYTH to have them killed and a younger of the same kind put in lieu or the just value of Tobb: to pay unto the sd SMYTH for any beast so killed, Also that if it should so happen that the sd HENRY SMYTH decease before age or without heirs before age or willing his estate that then the whole right of this Estate return to ELIZABETH my now Wife and her heirs forever as being the only Auther thereof. Now Know yee that I the said DANIEL DOBYNS do by these presents Ratifie confirm and estate the aforesd. granted premises according as is above expressed and mentioned and acknowledge the same in Court As Witness my hand and Seale this 5th day of February 1689

The Condicon of this obligacon is that if the above bound HENRY SMITH, Admr. of MARY his late Wife, who was Widow of RICHD. CARTER deced, doe make or cause to be made a true & perfect Inventory of all ye goods & credit, of the said deceast which have come to the hands of ye sd HENRY & doe exhibit the same to the next Court that shall be held for the County of Essex, & make Oath thereto, & truely adminstr: on the said Estate according to Law & give true account of his Administracon when thereunto lawfully required & pay unto such persons as the sd Court p:suant to Law shall appoint, Then the above obligacon to be void, otherwise to stand in full power

DOBYNS did give confirme & make over unto the said HENRY SMITH, her Son, by a Deed acknowledged in RAPPA. Court beareing date the first day of February 1688, the Tenure of the said Deed haveing regard to these proposalls that if it should please God the said HENRY SMITH should decease wthout heires of his body lawfully begotten or undr: age of twenty one yeares to will & devise the said Estate, that then the said Estate to reverie to me the said DANLL. DOBYNS & ELIZABETH my Wife to be att or: disposall as being ye only authors thereof And the estimate vallue of ye Deced Estate being three cows & calves, one two yeare old heifer three thousand six hundred & fifty pounds of tobo: and thirty one pounds Sterling money is justly taken by Capt. JAMES BAUGHAN & Mr. JOHN BAKER of GLOCESTER County by request of my Wife, ELIZABETH, & selfe, Now Know yee that I the said DANLL. DOBYNS have given & made over unto my three Children hereafter named whome I have by ELIZABETH my said Wife (vizt.) WILLIAM, CHARLES & KATHERINE DOBYNS, the above Estate in manor & forme as followes (vizt) I doe give unto my Son, WILLIAM DOBYNS, three cows & calves, one two yeare old heifer & seaven hundred and fifty pounds of tobo: & caske; Item I doe give and make over unto my Sone, CHARLES DOBYNS, Two thousand nine hundred pounds of tobo: and Item I doe give and dispose of unto my Daughter, KATHERINE DOBYNS thirty one pounds sterling money or the vallue thereof to be paid in tobo: at teen shillings p cent & that all & every the above Estate be paid & made out of my Estate unto my three Children aforenominated when they shall attains o he age of Twenty and one yeares but if my said Daughter, KATHERINE, should marry before ye age abovesd, then her due to be paid att the time of her Marriage but if it shall please God that either of the ahnvenamed Children should decease before they attaine to the age aforesd. or marryd. that then his or her part shall be equally devided betweene the Surviveing Children aforesd. I the said DANLL.
