IN THE NAME OF GOD, Amen. I now being in a loe contison as to my bodily health yet in perfect sences, I comied my body to the Earth and my Soul to God who gave it. First of all, I give unto my Son, WILLIAM HEADLEY, all my Land to him and his heirs lawfull begotten of his body and for want of such heirs to the nearest in Blood for ever;
Item. I give unto my Son, WILLIAM, my Cyder Cask and working tools after the debts are payed & after decyce of his Mother
Item. I give unto my Son in Law. DAVID HAILE, one Shilling and the remainder of my ( whole deicices) to be equally divided between MARY SMITH, my Grand Daughter, and ELIZABETH PICKRELL, my Grand Daughter

This Last Will and Testament of ROBERT HEADLEY deceased, was presented into Court by MARY HEADLY his Relict, who made Oath thereto and being proved by the Oaths of JOHN SMITH and RICHARD PICKRELL witnesses thereto is admitted to Record, And for that not any Executor being named in the said Will, upon the motion and her performing what is usual in such cases. Certificate is granted her for obtaining Letters of Administration thereupon with the Will annexed

Will of Ann Headly, being very sick and weak, dated 20 July 1713.
My son Robert Headly one cow and calfe, one ewe and 500 pounds of tobacco.
To my son William Headly one young cow, a ewe and a barrow.
To my son Henry Headly one flock bed and furniture belonging to it and a pott and a young cow and a ewe, a sow and a barrow.
To my daughter Barbary Weil [Webb] one cow.
To my daughter Eliza. Headly one mare and a larg dish, two plates, a porringer, a new feather bed and furniture, to be paid to her at the age of sixteen and a small book.
To my daughter Ann Headly one young horse and a new feather bed and furniture, to be paid to her at sixteen years of age, and a young cow, a dish, two plates, a porringer and a small pewter cupp.
My son John Headly executor and administrator, he paying to my two sonns William Headly and Henry Headly 500 pounds of tobacco to each.

In obedience to order dated 30 July 1718, we, being sworn by Thomas Newton, Gent., and in company with the surveyor, did meet on the lands in difference between Robert Headley and Jno. Rust, did survey and lay out the land of the plaintiff according to the most antient known and reputed bounds, having had regard to all elder patents and evidences, and doe say that the plaintiff is dampnified and damage hath sustained £1.5.0.

To the Worshipful) Court &c,
Wee the Subscribers being chosen by JNO:, WM: and SARAH HARTLEY to devide the Lands left them by the Last Will and Testament of their late Father, deceased, except a certain parcel! of land in dispute lying in the RICH NECK, which wee did as followeth. Wee appoint all the Lands in RICHMOND County, except the Land in dispute, for one parte and all the Land lying in Westmoreland and NORTHUMBERLAND Countyes for the other two parts, divided by a Branch commonly known by the name of JNO, HARTLEYS SPRING BRANCH, runing up the said Branch from the mouth to a marked white Oake standing on the South side of the said Branch and from thence extending along a line of marked trees to the line between the said Land and the Land of Mr. JOHN CRANLY; and JNO: HARTLEY having the first choice hath taken the part lying on the North side of ye said branch in which part was a certain parcell of Land sold to GEORGE: (? RINTLEG) for his life, And WM.: HARTLEY hath taken the part in RICHMOND County for his choice and JAMES SMITH, which hath intermarried with the said SARAH HARTLEY, hath the other part lying in Westmoreland and NORTHUMBERLAND Countyes.
