      Oct. 23, 1758 - The Charles Co., Md. will of Justinian Burch,
      Sr., planter, probated Feb. 23, 1760, leaves:
      --to son Justinian, a Negro man called Tameboy and a Negro
      girl called Lucy, 3 ewes, a heifer, and 1000 pounds of tobacco now in the hands of Mr. John Ariss/Auss.
      --to son Edward, a Negro man called Sam and 3 ewes.
      --to daughter Susanna, 56 acres of land, being part of a
      tract of land called "Lumley," and to my two grandchildren
      by my said daughter Susanna, two Negroes, a man called
      Fenner/Hannin and a girl called Henny~ but with the proviso
      that my said daughter Susanna shall have the use of the two
      said Negroes during her natural life.
      --to daughter Monica, 3 ewes and a heifer and a feather bed,
      and to my eldest grandson by my said daughter Monica, two
      Negroes, a woman called Tenny/Jenna and a boy called Cupid, but with the proviso that my said daughter Monica shall have the use of the two said Negroes during her natural life.
      --to daughter Mary, all that part of a tract of land called
      "Bowlings Plane" that lies within the following bounds:
      beinning at an old School house branch and thence running
      across to another branch and thence running up this last
      branch to a bounded gum tree, and thence to the beginning,
      containing 25 or 30 acres; and also 3 ewes and a heifer and
      feather bed; and to my eldest grandson by my said daughter
      Mary, I give 2 Negroes, a woman called Sarah and a boy called Dick, but with the proviso that my said daughter Mary shall have the use of said two Negroes during her natural life.
      --to daughter Elizabeth, all that tract of land called
      "Burches Addition," and also that part of "Bowlings Plain"
      which lies between the said "Burches Addition" and that part
      of the Mill branch where the Mill stands, from the said Mill
      down the said branch till it meets the bounded line of said
      "Bowlings Plain," but if Elizabeth has no children, the land
      shall go to whomsoever of the Protestant Burches my said
      daughter Elizabeth shall think fit to will it; also to
      daughter Elizabeth that part of "Bowlings Plain" I now live
      upon lying within the following bounds: Beginning at the
      Mill aforesaid and running up the mill branch to an oak not
      far from the head of said branch remarkable by its having
      a prize formerly fixed in it, thence across the pasture to
      a Spanish Oak standing on a knowl on the edge of a branch
      close by the present pasture fence, thence down the said
      branch till it meets the mill branch aforesaid, to her during
      her natural life and at her death to go to the next Protestant
      heir of the Burches; also to daughter Elizabeth, three
      Negroes, a boy called Clem and two girls called Jeny/Jenny
      and Stacy, and all my moveable effects [except?] such as
      are already bequeathed as aforesaid or shall be bequeathed
      as hereafter mentioned.
      --to my eldest Protestant grandson by my son Oliver, all
      that remains of "Bowlings Plain" after such parts as I have
      already bequeathed as aforesaid to my two daughters Mary
      and Elizabeth shall be laid off to them respectively, but
      with the proviso that my son Oliver shall have the use of
      said land during his natural life, but failing a Protestant
      grandson by my son Oliver, said land shall go to the next
      Protestant heir of the Burches; I also give to my eldest
      grandson by my son Oliver a Negro girl called Clare and 3
      sheep, but with the proviso that my son Oliver shall have
      the use of said Negro and the increase of said sheep during
      his natural life.

      --furthermore, my said daughter Elizabeth shall allow to
      be ground toll free such grain as her brothers and sisters
      aforesaid shall bring or send to the Water Grist Mill that
      belongs to my dwelling plantation and is included in the
      land given her as above, and my said daughter Elizabeth shall allow her said brothers and sisters the use of the Mill in like manner.
      Executors: son Oliver, brother Edward, and Isaac Campbell.
      Witnesses: Zephaniah Turner, Hezekiah Turner and Charles
      King.
      Justinian's will was proved Feb. 23, 1760 by the witnesses
      in the presence of Oliver Burch the heir at law who did not
      object to the same.

      Comment: When son Oliver was called "heir at law" at the
      will probate in Feb. 1760, it means that he was the eldest
      living son of Justinian. It is rather odd that, despite
      the great particularity of his will, Justinian then proceeds
      in the dozen or so records below to dispose by deed of the
      very property covered by his will. Sometimes these
      transactions are deeds of gift and sometimes they are sales.

      Mar. 4, 1760 - The Charles Co., Md. Inventory of Justinian
      Burch.
      Appraisers: Marsham Queen and Justinian Cooksey, Jr. (value: 94/3/3.)
      Creditors: John Urquhart and Justinian Cooksey, Jr.
      Next-of-kin: Thomas Burch, Sr., and John Burch.
      Executors: Isaac Campbell, Justinian Burch, Oliver Burch
      and Edward Burch approve the inventory on May 1, 1760.

      Comment: Harry W. Newman's abstract of Justinian's
      inventory in the Newman Collection at the Southern Maryland
      Studies Center shows the appraisers as Marsham Queen and Samuel Turner, showing Justinian Cooksey, Jr. only as a
      creditor. Newman shows the same 4 executors as Skinner.
      Justinian's Oct. 1758 will named only 3 executors: Isaac
      Campbell, Oliver Burch and Edward Burch. Isaac Campbell
      was the minister at Trinity Parish Church, Charles Co.

      May 15, 1767 - The Charles Co., Md. Administration Account
      of Justinian Burch.
      Surviving executors: Oliver Burch and Isaac Campbell, of
      Charles Co.
      Inventory value: 94/3/3.
      Payments made by the estate: includes a payment of 0/13/7
      made to Margaret Burch (no relationship stated), and payments
      of the following legacies:
      --3 sheep left to son Edward Burch (1/4/0);
      --3 sheep and 1 heifer left to son Justinian Burch (2/4/0);
      --3 sheep and 1 heifer left to dau. Mary (2/4/0);
      --3 sheep and 1 heifer left to dau. Monica (2/4/0).
      After all payments are made by the estate, the residue of
      the deceased's personal estate, which consists of 58/18/6,
      is paid to Justinian's daughter Elizabeth.

      Comment: Note the long delay between Justinian's death
      and inventory (1760) and his administration account in 1767.
      Justinian's brother Edward Burch (one of the executors) is
      not shown in Justinian's administration account because he
      died in 1765. There is no Balance Book record for Justinian.

      In the name of God Amen, I Oliver Burch of King and Queen Parish in Charles County being in perfect health& of sound mind and memory blessed be God for the same and calling to mind the uncertainty of this world that there is nothing certain but death and that most uncertain, when do make and ordain this my Last Will and Testament in a manner and form following (Viz) ----
      Imprimis: I give and bequeath my soul into the hands of Almighty God that gaveth me- Doubting nothing but that through the merits and intercession of my Blessed Savior and Redeemer Jesus Christ I shall receive it again at the last day with a full pardon of all my sins my body to the Earth to be buried in a Christian like manner at the appointment of Executors hereafter by me named and as for the worldly goods that it hath pleased God of his goodness to endow me with all, I bestow in manner and form the following ~ viz. ~
      Item: I give and bequeath to my son Benjamin Burch Seventy Five acres of land it being part of a tract of land called, Bowlings Plains to him and his heirs forever.
      Item: I give and bequeath to my two sons Thomas and John Burch five shilling sterling a piece.
      Item: I give and bequeath to my son Edward Burch one feather bed and covering, I give the said goods to my son Edward Burch.
