At the request of Charles Byrne of CC, planter, the following bond was recorded this May 25, 1727.
We, Mary Smallwood and John Smallwood, executors, of the will of James Smallwood, late of CC, decd, bind ourselves to Charles Byrne and Margery, his wife, of CC, in the penal sum of 100 £sterling money of Great Britain, this Jan 5, 1725. The condition of the above obligation is such that, whereas a certain parcel of land formerly belonging to Hugh Thomas, father of the sd Margery, containing 200 acres, part of a tract called Friendship, originally granted unto Bennett Hoskins, Esq, lying on Mattawoman Swamp in CC, was by the reciprocal consent of sd Mary Smallwood and John Smallwood & sd Charles Byrne and Margery, his wife, on Nov 29 last, surveyed & divided by Robert Hanson, surveyor of CC, which sd parcel of land is bounded by the ENE line of William Hoskins' part of the afd tract called Friendship between 2 plantations now in the possession of sd Mary Smallwood & John Smallwood, and divided by a line drawn SSE from a hickory standing in the afd ENE line of William Hoskins, part of Friendship by the side of Piney Branch for the length of 132 perches thru the afd 200 acres of land, now if sd Mary Smallwood & John Smallwood and James Smallwood shall abide by sd division and be content with the easternmost part or moiety of sd parcel of land and not disturb sd Charles Byrne and Margery, his wife, from the peaceable possession of the westernmost part or moiety thereof, then this obligation to be void. The plat of a parcel of land containing 200 acres, being part of a tract called friendship (shows Byrne's part, 100 acres, and Smallwood's part, 100 acres].
On Nov 29, 1725, the above land was, at the instance and request of Mary Smallwood & John Smallwood and Charles Byrne and Margery, his wife, surveyed and divided according to the above plat by Robt Hanson, surveyor.

Pursuant to the order of last Aug CC Court, Commission issued, returnable here, to William Middleton, Thomas Hawkins, Samuel Hawkins, and Henry Acton, Gent, to examine witnesses touching the bounds of a tract of land called Hull, lying in CC, in the possession of Mary Cawood, as follows: To William Middleton, Thomas Hawkins, Samuel Hawkins, and Henry Acton, Gent. Whereas Mary Cawood, seized of sd Hull, did, on Aug 10, being in the 28th year of our Dominion, prefer her petition to our Court before Robert Hanson, Gent, and his associates, our Justices within CC, for Commission to examine witnesses to prove and perpetuate the memory of the bounds of sd land, know that we have given you (not being any way related to the petitioner, contiguous proprietor, nor interested in sd land) you authority to examine witnesses as afd. Signed Aug 14, 1742 - Edmd Porteus, Clk.
And now here, William Middleton, Thomas Hawkins, and Samuel Hawkins, Gent, 3 of the Commissioners afd, return the Commission afd, with a certificate thereon, and subsequent depositions thereunto annexed, viz - We did meet on the within mentioned tract of land called Hull, and there took the depositions of all such witnesses as were offered to us in relation to the bounds thereof. CC. Oct 8, 1742. John Clubb, aged about 88, who declares that about 40 years ago, he was on a resurvey made by Stephen Cawood, late of CC, decd, and then he understood by sd Cawood and others, that the white oak on which this deponent now lays his hand, to be a bound tree of sd Cawood's land.
James Griffeth, aged about 50, declares that his father-in-law, James Smallwood, told him that the white oak mentioned in the foregoing deposition, was a bound tree of sd Smallwood's land called Hopewell.
Stephen Cawood, aged about 42, declares that the white oak on which he now lays his hand, being the same that's mentioned in the above deposition, he was shown by James Smallwood, decd, and Samuel Berry, to be a bound tree of his father, Stephen Cawood, decd's land called Hull.
William Atchison, aged about 23, declares that the white oak by which he now stands, mentioned in the foregoing depositions, his grandfather, Stephen Cawood, decd, showed him it to be the 2nd bound tree of sd Cawood's land.
Ignatius Windsor, aged about 23, declares that the white oak mentioned in the several depositions above, Stephen Cawood, decd, showed him to be the 2nd bound tree of the sd Cawood's land.
