Oct 10, 1793 from Walter Smith of CC (Carpenter), to Ignatius Middleton and James Middleton, both of CC (planters), for 294 £13 shillings and 4 pence, all of Walter Smith's right to all the surplus lands in a tract of land called Jourdan, in CC, that my grandfather, John Smith decd, made over to me, sd Walter Smith, by deed of gift (except 97 acres where James Montgomery now lives, binding with certain courses as heretofore laid down by Joseph Owen, Surveyor for sd Mongomery; also 122.33 acres which was formerly laid down for Smith Middleton). General Petition Information
Abstract: Elizabeth Montgomery, administratrix of the estate of Priscilla Richards, seeks an injunction and subpoena against Ignatius H. Hagan, constable, to prevent him from selling a female slave named Lucy. Hagan has levied a fieri facias against Lucy to satisfy judgments rendered against Leonard Richards, Priscilla's son, who was indebted to Elizabeth Montgomery's husband, James. Montgomery claims that Lucy belongs to Priscilla Richard's estate and explains that she bought Lucy from Leonard Richards before the judgments were rendered against him. In her duties as administratrix, she has disposed of the full amount of Richards's estate, paid off the debts, and claims that Lucy is property that is "not legally liable" for the estate's debts.
Result: granted; injunction dissolved; dismissed
