517. WILLIAM BARTON son of NATHAN BARTON of this County late deced made petition to this Court that FFRANCIS HAMMERSLEY detains and keeps from him his two Brothers and one Sister Orphans of the said Nathan Barton deced under a specious pretense that the said orphans was left to his care and Tuition from their deced Father and seeing that the said ffrancis Hammersley is a Roman Catholic he doubts that the said Orphans may be brought up by him in the Roman religion he therefore prays that the said orphans may be delivered from the said Fras. Hammersley into his care and tuition or that the said boys be bound out to some Trade according to Law in such cases hath provided concerning orphans And the Court having Throughly considered the premises doe accordingly order therefore tis ordered that NATHAN BARTON the oldest of the two boys orphans to Nathan Barton deceased shall remain in the custody of AUGUSTINE KNEATON until the next Court that he may then be by the Court bound out to the afsd Kneaton or some other good trade and that THOMAS the Younger son of Nathan Barton shall remain in the custody of Majr. ANDREW GILSON until the next Court to be bound out to him or some other Trade according to Law and that WILLIAM BARTON the Petr as afsd shall have the tuition of his Sister MARTHA the other orphan she being to be delivered from Mr. Fras. Hammersley as afsd William Bar-ton paying the costs.

Ordered that the action depending in this Court between THOMAS BARTON Plt and FRANCIS HAMMERSLEY the deft shall be referred to next Court to the intent that the said Hammersley a true and perfect account of the Estate of JAMES GERRARD that Judgment may pass against him as far as assets or else for him to obtain a Quietus for the said Estate.

BARTON complaining sheweth that FRANCIS HAMMERSLEY as Trustee to the Estate of JAMES GERRARD deced stands indebted to the Plt the sum of sixteen hundred pounds of Tobacco and Caske for funeral charges accomodation Trouble & attendance of him the said Gerrard in his Languishing Sickness which the said Hammersley hath not paid the Plt .. and now forasmuch as it doth appeare to this Court that the said Hammersley hath paid out of the said James Gerrards Estate almost as far as assets Therefore tis ordered that Francis Hammersley make payment of eight hundred pounds of tobacco in cask

Page 507-514 This Indenture made 4th and 5th Aprill 1728 between THOMAS BARTON SENR. of County Stafford and ABRAM FARROW SENR. of Coty & Colony Gent. by deeds of lease & release .. for 21 thousand pounds of good sound Merchantable Tobacco hath granted 400 acres whereon now lives WILLIAM GROVES & JOHN MADDENE said 400 acres being the uppermost part of a greater tract of 2000 acres granted to Capt. JOHN LORD by Hbl. WM. BERKELEY Sometime Governor of Virginia & being on Quantico Creek on the South side thereof then when granted in Westmoreland Coty but now in Stafford Coty afsd as by Patent 27 September 1664 & by John Lord assigned over to THOS. BOWRNE of Stafford County as by Conveyance endorsed in said Patent & acknowledged in Stafford County Court the 30th August 1665 may likewise fully appear Then 400 acres was sold by WM. BOURNE, SAMLL. MASE & MARY his Wife to Thomas Barton by Deed of sale dated the 1st day of July 1678 which deed was acknowledged in Stafford Coty Court on 10th of said month and afterwards was by the afd Wm. Bowrne as heir of the afsd Thos. Bowrne quit claimed & released to Thos. Barton on 10th October 1685 and is bounded .. Beginning at Quantico Creek upon the land of sd FARROW thence extending into the woods .. to marked corner tree near the head of the Little Creek .. finally up Quanticoe Creek being surveyed for 400 acres afd by Capt. GEORGE BRENT Surveyr. of Stafford County on 20th Octr. in 1681 in the Presence & by the Consent of sd Wm. Bourne and Thos Barton ..

Know all men I Thomas Barton Senr. of Stafford County Planter do stand & am bound to Abram Farrow Gent. ., sum of 400 pounds lawful Sterling mony of Great Britain 5th April] 1728. The condition of this obligation Whereas Thomas Barton by certain pair of Indenture .. hath granted unto Abram Farrow land on South side of Quantico Creek in Stafford Coty .. if Thomas Barton well & truly perform all covenants & more especially if the Wife of said Thomas Barton shall within three months release any claim she may have then this obliges. he voyd otherwise remain .

Grace Barton, widow of Thomas Barton dec. for love and goodwill I bear to my children Lydia Drummond and William Barton.... deliver to my two children.... to daughter Lydia Drummond one cow and calf, one sow and piggs and gold ring to be delivered when she arrives to sixteen years of age and to my son William Barton, feather bed and bolster, two blanketts, one rugg, one cow and calf, one sow and piggs and one gun to be delivered when he arrives to twenty one years of age.
