Branch wch. Divides this & a parcell of land in ye possession of JAMES GAYLARD & extending then South 140 poles to a marked Gum dividing this & ye land of DAVID JENNINGS, thense Southeast by East 160 poles to a marked red Oake standing in a line of trees dividing this & ye land of JAM.       Whereas DENNIS EYES complayned to this p Court that whereas he bought a parcell of land of WALTER ALLENSON being the moyety of three hundred and twenty acres of land held in joynt tenancy by the said WALTER and WILLIAM ALLENSON, his Brother, that he often desired of the said WILLIAM that a devision might be made thereof but the said WILLIAM refused it; it is ordered that the said land be devided and that the said DENNIS EYES have the full half of the said tract including the half of the ground that was cleared when the said WALTER and WILLIAM bought the land with the half of that ground that after the purchase WALTER helped to clear but the said EYES in noewise to be concerned or to have interest in such housing or other edificies or orchards which have been built or planted by the said WILLIAM without the help of the said WALTER

      CLEMENT ARLEDGE & MARY his wife relict of DENNIS EYES dec'ed haveing petic'oned this Court the said DENNIS was in his life time Seized of a Certaine Plantac'on in this county whereon he then lived with the Land thereabouts belonging & that the said Eyes did in and by his Last Will give and bequeath the same unto JOHN CONWAY of this County & that the said MARY is Intitled to her Dower or thirds of the said Plantac'on and Land but he hath hitherto refused to assigne the same & still persisteth in such his refuseall And prayed that the said CONAWAY might be Sum'oned to Appeare the next court to be held for this County to Answ' the premisses and that he might be Ordered by this Court to lay out & Assigne her Dower or Thirds of the Plantac'on and Lands etc. Its Ordered the said CONAWAY appeare at the next court to Answ' the said Complaint.
