At the request of Barton Garrett the following deed was recorded 10th August 1790. to wit
This Indenture made this seventh day of August in the year of our Lord one thousand seven hundred and ninety Between John Garrett Prather Enas Prather and Jane Prather of Frederick County and State of Maryland of the one part and Barton Garrott of the same County and State of the other part Witnesseth that Whereas Samuel Prather did on the second day of September in the year one thousand seven hundred and seventy five purchase of a certain John Garrott one Lot or Portion of Ground distinguished by Number Fifteen being part of a Tract or parcel of Land situate lying and being in Frederick County and State aforesaid called and known by the name of The resurvey on Merryland as by deed recorded in Liber BD. Number two folio one hundred and sixty five one of the Land records of Frederick County will appear. And whereas the said Samuel Prather by his last Will and Testamony bearing date third day of February in the year of our Lord one thousand seven hundred and eighty five did give and bequeath one third part of his Estate both Real and Personal to his Wife during her life and after her death to his two Children Rhode and Cyras and the remaining two Thirds of his Estate both Real and Personal to be equally divided between his four Children John Garrett Prather Enas Prather Erasmus Prather and Jane Prather as by the said Will remaining on record in the Register of Wills Office for Frederick County may more fully and at large appear. Now this Indenture Witnesseth that the said John Garret Prather Enas Prather and Jane Prather for and in consideration of the sum of two hundred and forty pounds current money to them in hand paid by the said Barton Garrett . . . each of their undivided fourth part of the said two Thirds of a Tract or Parcel of Land distinguished by Number Fifteen being part of a Tract or Parcel of Land called and known by the Name of Resurvey on Merryland which they and each of them claim under Will herein before recited Together with all and singular the Buildings Improvements Profits Commodities Priviledges Advantages and Appurtenances whatsoever to the said three fourths of two thirds of a Tract of land as before described . . .
