Northumberland County Court September 16, 1696
Upon the Petition of Mr. SAMUEL SMITH Executor, a Probate of the Iast Will and Testament of Lt. CoI. SAMUEL SMITH is granted him of the Will being proved by the oaths of Mr. JAMES AUSTIN and THOMAS HOBSON Witnesses to the said Will and is recorded.

THIS INDENTURE made the Nineteenth day of December in ye Eighth yeare of ye Reigne of or: Sovereign Lady Anne by ye grace of God of Great Brittaine &c. and in the yeare of or: Lord God one thousand seven hundred & nine; Betweene SAMUELL SMITH of the Parish of ST. STEVENS in ye County of Northumberld. & Colony of Virga., Gen tl., of the one part and WILLIAM NELMES of the same Parish & County of the other part: Witnesseth that the said SAMUELL SMITH for the summe of Tenn thousand pounds of good sound merchantable tobacco caske to him in hand paid path granted unto the said WILLIAM NELMES his heires & assignes all that NECK or par- cell of land in the said Parish of ST. STEVENS & County aforesd,, conteyning One hun- dred acres (be the same more or less) and bounded as followeth: Beginning at a marked red Oak standing in a Branch issueing out of RAYMONDS CREEK and the head thereof & running from thence by a line of marked trees to a marked Pine standing nigh ye Road that leads from SHAPLEIGHS QUARTER to the said SMITHs & soe along the sd, Road to a marked Pine standing nigh ye Road, thence to a marked Spanish Oak & from thence to a near red Pine standing in ye head of a Branch issueing out of HARRIES NECK CREEK and soe running the sevl: courses of HARRIES NECK CREEK, LITTLE WICCOCOMOCO RIVER and RAYMONDS CREEL to the first men coned red Oak, which said Neck or parcell of land is part of a greater Devident of land on which the said SAMUEL SMITH now liveth, & descended and came to him as heire apparent to SAMUEL SMITH, Gentl, his late Father, deced,, together with all woods trees waters houses tobacco houses orchards belonging; To have and to hold the said Land to him the said WILLIAM NELMES his heires & assignes forevermore, to be holden to the Cheife Lord or Lords of the Fee or Fees of the sd. pr:misses by the Rents and Services for the same due and the said SAMUEL SMITH for him selfe his heires grant that he the said Land shall be unto him the sd. WILLIAM NELMES his heires free from all claims of him the said SAMUEL SMITH his heires att all times hereafter In Witness whereof the parties first abovenamed to this pr:sent Indenture have sett their hands & seales the day & yeare first above written
