      IN THE NAME OF GOD, Amen. I STEPHEN BALEY the Elder of Westmoreland County being in perfect health and memory, God be praised for the same, doe ordaine and opint this my Last Will and Testament in manner and form as followeth, First, I will that all my just debts be paid;
      Item. I give to my well beloved Son, STEPHEN BALEY, all my land in MATTOX to the dividing line between he & his Brother, JOHN BALEY, to him and his heirs for ever;
      Item. I give my well beloved Son, JOHN BALEY, my Negro girl known by the name of Hannah to him and his heirs for ever; -
      Item. I give to my Son, STEPHEN BAILEY, one Negro girl known by the name of Sue, to him and his heirs for ever; also one feather bed and furniture.
      Item. I give to my well beloved Son, WILLIAM BALEY, my Negro girl known by the name of Nell to him and his heirs for ever;
      Item. I give to my well beloved Son, JAMES BALEY, one Negro man known by the name of Will to him and his heirs for ever; also one Cow and Calf;
      Item. I give to my well beloved Son, STEPHEN BALEY my two Negro boys, Samson and Michel xxxxxxxxxxxxxxx, Daughters, ANN DANIELSON, MARTHA JENKINS and ELIZABETH xxxxxxxxxx the true value of them equally to be divided amongst the xxxxxxxxx Sisters, and each of their heirs;
      Item. My will is that my loving Wife, shall have the use of my whole Estate in during her natrall life or marriage if my Wife should marri then to have noe more than the Law will give her;
      Item. My Will if that at the death of my loving Wife that all the rest of my Estate not above giving be divided between my Sons and Daughters above named, and Lastly I opint my loving Wife, ELIZABETH, and my well beloved Sons, JOHN and STEPHEN, my whole and sole Executors of this my Last Will and Testament;

At a Court held for the said County the 28th day of August Anno Dom: 1753 This Last Will and Testament of STEPHEN BALEY, deceased, was presented into Court by all the Executors therein named and being proved by the Oath of FLEET COX, JAMES BALEY and JOHN BALEY, the witnesses thereto, is admitted to Record; And on the moron of the Executors and their performing what the Law in such cases requires, Certificate is granted them for obtaininga Probate thereof in due form

      THIS INDENTURE made the twenty forth day of December in ye twenty eighth year of the Reign of our Sovereign, Lord George the Second, by the grace of God of Great Britain France and Ireland, King, Defender of the-faith, &c., and in the year of our Lord one thousand seven hundred and fifty four; Between JOHN WALKER of the Parish of Cople and County of Westmorland of one part and STEPHEN BALEY, Son of WILLIAM BALEY, SENR., of the Parish and County aforesaid of other part; Witnesseth yt. ye sd. JOHN WALKER in consideration of the yearly rents and covenants herein after reserved and mentioned on part of STEPHEN BALEY to be paid done and performed hath and by these presents doth demise lease and to farm let unto STEPHEN BALEY during ye natural life of JOHN WALKER all that tract of land containing twenty five acres bounded by ye COOL SPRING BRANCH and including one of the Dwelling Houses by a line of marked trees, To have and to hold the tract of land with appurtenances unto STEPHEN BALEY during the life of JOHN WALKER paying every year during the natural life of JOHN WALKER unto JOHN WALKER his heirs the rent or sum of three hundred pounds of lawfull tobacco and the Quitrents thereof upon the twenty fifth day of December in every year; and STEPHEN BAILEY shall at all times during the life of ye said JOHN WALKER or his own life all the houses and fencing on the demised premises in good sufficient tenantable repair and said STEPHEN shllnot nor any person to be substituted make any manner of waste of the Timber growing or lying on the demised premises but only make such use of ye Timber as shall be necessary for building and repairing the houses fences and tobacco hogsheads to be made thereon, provided always the yearly rent of three hundred pounds of lawfull tobacco and the Quitrents to be behind the space of sixty days after the time appointed, or in case the buildings and fencings thereon be not kept in good sufficient tenantable repair or will- full waste be committed of the Timber belonging to the demised premises, that then it shall be lawfull for JOHN WALKER his heirs to reenter unto ye demised premises and ye same to have again and repossess; In Witness whereof the parties to these presents have interchangeably set their hands and seals ye day and year first above written

      this Deed of Lease for live (of Land) by him passed to STEPHEN BALEY to be his proper act and deed and on the mocon of the said STEPHEN BALEY is ordered to be recorded
