      Imprs. I give and bequeath my Soul into ye hands of my heavenly Father that gave it, nothing doubting but ye same to receive again at ye general! Resurrection by his Almighty power and my body I give to ye Earth my Mother to be decently buryed at ye discretion of my Exectrs: hereafter nomynated and appointed;
      km I give to my Grand Son, ORIGINALL BROWN, one hundred and fifty acres of land lying on the Southside of COVENTREE RUNN to him & his heirs lawfully begotten for ever, butt in case of no issue, then to fall to my Son, ORIGINALL BROWN and his heirs, And I desire that my Daughter, MARY BOWLING, may quietly possess ye sd, land until my Grand Son, ORIGINALL BROWN comes of age;

      David Browne of Washington Parish, Westmoreland County, to John Hore of same. With consent of his wife Elizabeth and for 3000 pounds of tobacco. 43 acres, his wife's share of land. Elias Webb late of Westmoreland County dyed possessed of a tract joining upon the land of Mr. John Scott and Mr. Andrew Monroe, containing 130 acres, and formerly belonged to John Knott of the aforesaid county, deceased, and being found to escheat by an inquisition under the hands and seals of Lte. Colo. Peter Ashton by virtue of his deputation from Colo. Miles Carey, Escheator General, 8 March 1663/4, and granted to Elias Webb by an escheate patten 30 April 1664. Elias Webb at his decease left one son Elias and three daughters Jane, Elizabeth and Sarah. His son Elias dieing in a short time before his father in his minority, the above tract fell successively to the three sisters as coheirrs's. David Browne married with Elizabeth one of the daughters and coheirs.

In obedience to order dated 31 March 1714 in the action of trespass between Nathll. Gray and David Brown and John White, continued from a former order dated 29 July 1713, I surveyed for the bonds of a pattent granted Francis Gray for 675 acres dated 16 July 1654 ... on the south side of Potomack river on the head of a small creek called Rosier's Creek ... to the round hills abutting thereon the land of Mr. Thomas Boyse and John Hillier ... over the head of a branch which falls into river to the beaver damms of the forementioned creek ... down the three dams ... under which patent the plaintiff claims, and after many disputes amongst the jury and some tryalls I made for the jury to find a right begining, the jury caused me to begin at an antient marked pohiccory on the north east side of Rosier's Creek damms often known by the Indian name of Attopin dams, being the uppermost corner of another patent now in the possession of Thomas Chancellor, which patent doth mention the tree to stand on the head of the creek and from there I extended by the directions of the jury ... corner tree of Mr. Thomas Boyce now in the possession of Henry Ashton, Gent. ... which course brought me on the east side and on some part of the falling ground of the round hills ... to the land of John Hillier now in the possession of Mr. John Washington where the patent appearing to be elder the jury after some time of dispute amongst themselves ordered that I should alter my cours and goe around the same ... to the line of Mrs. Anne Bernard which cours brought me a little to the southward of the head of a branch as I was there told fell into Upper Machotick Creek or river ... along Bernard's line ... which gave me the breadth that should make up the complement of the patent according to the jury's instructions, adding in that part of Hillier's patent that interfeared with the second cours, but did not reach the reputed bounds of the plaintiff's claim. ... from thence I extended parralel with the first cours of the patent which brought me to Rosier's Creek dams a little above a new mill there sett by Mr. Watts and William Munroe where a locust tree is marked including a tobacco house and part of a corn field within the survey formerly claimed by David Brown ... thence to extend down the dams the several meanders being reduced to a right line, in which survey John White's plantation and dwelling house whereon he now lives were included. The chaine carryers were worn and trees marked round the land of the plaintiff including 673 acres.

      THIS INDENTURE made the Twenty seventh day of May in the year of our Lord one thousand seven hundred & thirty four Between JOHN BROWN & WILLIAM BROWN of Parish of Washington in County of Westmorland, Sons of DAVID BROWN, late of the County aforesaid, deceased, of one part and ORIGINAL WROE of the same Parish & County of other part; Witnesseth that JOHN & WILLIAM BROWN in consideration of the sum of five shillings to them in hand paid by ORIGINAL WROE, the receipt whereof they do hereby acknowledge, have and by these presents do bargain & sell unto ORIGINAL WROE all that parcell of Land situate in Parish of Washington and County of Westmorland containing by estimation One hundred acres of Land; Begining at a Pohickory standing in the back line of Mrs. ANN BARNERD and extending along the line of the said BARNERD for the breadth so in this course as the Land may have three other courses proportionable in length & breadth to this course; tuning thence towards the Beaver Dams belonging to a Creek called ROSIERs CREEK, runing thence parrallel to the first course to the Land of FRANCIS GREY, then up the line of said GREY to the first mentioned begining; Together with all houses water courses advantages and appurtenances belonging; the Land is part of three hundred and forty acres of Land granted DAVID BROWN and MARY his Wife by Patent in the year one thousand six hundred and sixty two or thereabouts and was by DAVID BROWN given to his two Sons, JOHN and WILLIAM BROWN by Will bearing date the Eight day of July in year of our Lord one thousand seven hundred and twenty seven by vertue of which Will the Land came and descended to JOHN and WILLIAM BROWN; To have and to hold the land and premises with appurtenances unto ORIGINAL WROE his heirs, during the term of one year paying therefore the Rent of one year of Indian Corn on the Birth day of our Lord God next ensuing if lawfully demanded to the intent that by vertue of these presents & by force of the Statute for transfering uses into possession ORIGINAL WROE may be in actual possession of the premises and be thereby enabled to take a Release of the inheritance thereof; In Witness whereof JOHN BROWN and WILLIAM BROWN have hereunto set their hands and seals the day month and year first above written

      Jim Note: I've seen it stated that the children of Thomas Marshall d.1704 in Westmoreland Co. went to live with William Marshall in K&Q Co. soon after Thomas died. I think this very unlikely since the will of Thomas Marshall seems to have been enforced and says:

      e) Item: I will that if my wife marry, that David Brown, Sr., and John Brown be guardians over my children, and to take the estate into their hands, bringing it to appraisement, giving good security to what it is valued, and to pay my children their dues as they become of age.

      Could John Brown who d. 2 March 1725/6 in Westmoreland Co. have had a brother named David that wasn't named in the will of William Browne?

      "...Elizabeth Allen married 1) Francis Browne (died 1707), son of Daniel and Elizabeth (Smith) Browne. Elizabeth (Smith) Browne was the daughter of William Smith( died 1671) and wife Mary, whose land adjoined that of John Tucker and Rose Tucker Gerard Newton. Mary Smith married (2) Samuel Reeds and, when her son William Reeds bought his brother John's interest in their father's land in 1703, Benjamin Berryman (son-in-law of Rose Tucker Gerard Newton) witnessed the deed.
      In addition, Mary (Lawrence) Thomas Tucker, widow of John Thomas and of John Tucker, II, married (3) one John Browne. Although the relationship of John Browne to Daniel and Francis has not been established, there may have been one. ..."

      William Smith left 590 acres "opposite Capt. John Washington" to his wife Mary and daughter Elizabeth Browne. Mary (___) Smith married (2) Samuel Reade, as proven by deed of 7 September 1695. See Browne for this family. On 27/28 November 1738 Original Brown of Westmoreland County and William Reeds and Clator Reeds of Stafford County deeded to John Pope part of a parcel of land granted by patent to William smith on 1 April 1695 and since granted to Samuel Reeds and David Brown and then given by John Reeds to William and Clator Reeds and by a deed of gift given by David Brown to Original Brown. Issue:
      Elizabeth Smith married before 1675 Daniel Browne who, with Samuel Reade, escheated the land of William Smith in 1671. Issue:
      1. Francis Browne (died 1708) married, daughter of Valentine Allen. This researcher believes she married (2) William Gerard Tucker. See Allen for her line."
